drop bay and additional wet slips. This project impacts approximately 12 acres outside of the Riparian Buffer
and less than 0.1 acres within the 30' zone of the Riparian buffer.

The project site consists of 425 acres of land owned by the USACOE and leased by the state of North Carolina
and thence leased to Rollingview Marina. The property is bounded on the north, east and west by Falls Lake
and the south by Baptist Road and Falls Lake Road. The entire property is in Durham County and is accessed
off of NC98 and Baptist Road

A general permit to perform work in or affecting navigable waters of the United States
and waters of the United States, upon recommendation of the Chief of Engineers,
pursuant to Section 10 of the Rivers and Harbors Act of March 3, 1899 (33 U.S.C. 403),
and Section 404 of the' Clean Water Act (33 U.S.C. 1344), is hereby renewed and
modified by authority of the Secretary of the Army by the

TO AUTHORIZE MAINTENANCE, REPAIR AND CONSTRUCTION ACTIVITIES
IN THE LAKES AND RESERVOIRS OWNED AND/OR OPERATED BY THE
WILMINGTON DISTRICT, U.S. ARMY CORPS OF ENGINEERS WITHIN NORTH
CAROLINA. THESE INCLUDE JOHN H. KERB RESERVOIlt, FALLS LAKE, B.
EVERETT JORDAN LAKE, AND W. KERB SCOTT RESERVOIR.
These lakes and reservoirs were constructed and exist primarily for the purposes of
hydroelectric power generation, flood storage, and/or water supply. They were
constructed and are operated under laws and regulations administered by the U.S. Army
Corps of Engineers. Activities within these waters are the primary concern of, and
should be regulated by the Wilmington District, U.S. Army Corps of Engineers. This
general permit applies to all waters on or within lands owned or under flowage easement
to U.S. Army Corps of Engineers. Activities authorized are:
a. Construction of piers, floating boat docks, boat shelters, boat houses, boat ramps,
jetties and breakwater structures and installation of dolphins, pilings and buoys,
using commonly acceptable materials such as pressure treated lumber, unsinkable
flotation materials, and confined concrete.
b. Excavation and maintenance of recreational boat basins and canals/channels
where excavated material is placed and retained on high ground.
c. Stabilization of eroding shorelines utilizing appropriate bioengineering
techniques, construction and backfili of bulkheads, and the placement of riprap
material.
d. Installation of submerged and aerial utility lines provided U.S. Coast Guard
requirements for aerial lines are met and pre-project elevation contours are
restored.
e. Maintenance of existing water intake and outfall structures provided all State and
Federal required authorizations have been obtained. Construction of new water
intake and outfall structures is not authorized under this general permit.
f. Excavation of accumulated sediments, when lake drawdown allows, with all
excavated materials placed and retained on high ground.
Special Conditions
a. Anyone wishing to accomplish work under the authority of this general permit
must submit a written description of the proposal with detailed plans, location maps, and
other supplemental information explaining the nature and scope of the work to the
Operations Manager at the lake or reservoir in which the work is to occur.
b. Prior to the commencement of any work, the permittee must receive written
approval from the Operations Manager. The Operations Manager may include any
additional conditions and/or restrictions that he or she determines to be appropriate.
Failure to comply with the Special and General Conditions contained herein or any
conditions and/or restrictions stipulated by the Operations Manager could result in a
violation of Federal law and appropriate action by the Office of the U.S. Attorney.
c. To be authorized by this permit, all piers, docks, boathouses and boat shelters
shall be pile-supported or floating structures, incompliance with each individual
reservoir's shoreline management plan. Piles, dolphins, jetties and breakwater structures
may be of wood, metal or precast concrete. Breakwater structures will be designed to
provide for adequate water circulation landward of the structures.
d. This general permit does not authorize construction across or into any natural
or manmade channel or water body in any manner that may adversely affect navigation
by the general public.
e. On natural waterways 30-foot wide or greater that have been designated as
navigable waters of the US pursuant to Section 10 of the Rivers and Harbors Act of 1899,
this permit does not authorize placement of any pier segment or structure further
waterward than one-third the width of the water body. For navigable water bodies less
than 30 feet wide, pier requests will be evaluated on a case-by-case basis and may be
restricted to less than one-third the width of the water body.
f. Docks or piers and adjoining platforms, decks, boathouses, boat shelters,
docks, and "L" and "T" sections will not cumulatively exceed the maximum allowable
size of such structures identified in the reservoir's shoreline management plan. Docks
and piers extending over wetlands will be elevated sufficiently (minimum of 4 feet above
the wetland substrate) to prevent total shading of vegetation, substrate, or other elements
of the aquatic environment.
g. Floating docks, boathouses and boat shelters will not be constructed over
wetlands.
h. Wooden jetties will not extend farther than 100 feet waterward of the NWL
elevation contours.
i. Decking for piers, docks, boathouses and boat shelters will accommodate loads
not less than 50 pounds per square foot.
j. Wood must be pressure-treated except in areas of boathouses or boat shelters
protected from the weather.
k. Metal pilings or beams will have a minimum section thickness of 3/16 inch.
1. Floating structures will be supported by material that will not become
waterlogged or sink when punctured, will be installed to provide for fluctuations of water
elevation and will be secured in such a manner as to not break away.
m. If the display of lights and signals on the authorized structure is not otherwise
provided for by law, such lights and signals as may be prescribed by the U.S. Coast
Guard will be installed and maintained by and at the expense of the permittee.
n. This general permit does not authorize any habitable structure or associated
facility for nonwater-related use.
o. This general permit does not apply to structures within existing or proposed
marinas. For purposes of this General permit, a marina is defined as any publicly or
privately owned dock, basin or wet boat storage facility constructed to accommodate
more than 10 boats.
p. Boat ramps will not exceed 20 feet in width. During boat ramp construction
and maintenance, no fill or construction material may be placed in wetlands.
q. Excavation associated with boat ramp construction or maintenance is limited
to the area necessary for site prepazation and all excavated material must be removed to
uplands.
r. This general permit does not authorize the installation of fueling facilities on
authorized structures.
s. Where wetlands are present along a shoreline, all shoreline stabilization
activities (bio-engineering techniques, construction and backfill of bulkheads, and the
placement of riprap material) must be undertaken landward of the wetlands. This general
permit does not authorize the discharged of dredged of fill material within wetlands.
t. Bulkhead and riprap alignments will not extend farther waterward than an
average distance of two (2) feet, maximum distance of five (5) feet from the normal pool
elevation contour and may not extend more than 500 feet along a shoreline.
u. R.iprap, if required by the Operations Manager, will be placed at the base of all
bulkheads and will extend a maximum of three (3) feet waterwazd on a 2:1 slope. All
other fill material will be confined landward of bulkheads.
v. Material placed for shoreline stabilization will not exceed an average of one
cubic yard per running foot placed below the plane of the ordinary high water mazk.
w. Excavation for the removal of accumulated sediment from existing basins,
access channels and boats slips must not exceed the lesser of the previously authorized
depths or controlling depths for ingress/egress.
x. To avoid potential impacts to fish spawning areas, excavation activities will
not occur during the months of March, April, May, or June of any year.
y. Dredging will be limited to channelwazd of the normal pool elevation.
Finished depths will not exceed the depth of the receiving waters channelward of the
work.
z. All excavated material will be placed landwazd of the normal pool elevation
contour on high ground and confined by adequate dikes or other retaining structures to
prevent erosion and sedimentation into adjacent waters or wetlands. The temporary
placement or double handling of excavated or fill material waterward of the normal pool
elevation is not authorized.
aa. The minimum clearance for aerial power lines will be governed by system
voltage as shown below:

Clearances aze based on the low point of the line under conditions that produce the
maximum sag considering temperature, load, wind, length, span and type of supports.
Clearances-for communication-lines, stream gauging cables, ferry cables and other aerial
crossings will be a minimum often (10) feet above ceazances for bridges. Installation of
utility lines will conform to the special conditions of general (regional) permit No.
198100049.
bb. If an easement to fill or cross utility company, State or Federal property is
required, such easement must be obtained prior to commencement of work.
cc. If the permitted work is on lands subject to an easement in favor of the United
States for the maintenance and operation of a Federal lake or reservoir, the permittee will
remove such structure and improvements at this own expense in the event that, in the
judgement of the U.S. Army Corps of Engineers acting on behalf of the United States, the
lands aze needed at any time for any purpose within the scope of the easement. All
construction within the easement, either temporary or permanent, must be incompliance
with the terms and conditions of the applicable easement estate.
General Conditions.
a. Except as authorized by this general permit or any USACE approved
modification to this general permit, no excavation, fill or mechanized land-clearing
activities shall take place within waters or wetlands, at any time in the construction or
maintenance of this project. This permit does not authorize temporary placement or
double handling of excavated or fill material within waters or wetlands outside the
permitted area. This prohibition applies to all borrow and fill activities connected with
this project.
b. Authorization under this general permit does not obviate the need to obtain
other federal, state, or local authorizations.
c. All work authorized by this general permit must comply with the terms and
conditions of the Clean Water Act Section 401 Water Quality Certification Number 3492
issued by the North Carolina Division of Water Quality on December 31, 2004.
d. The permittee shall employ all sedimentation and erosion control measures
necessary to prevent an increase in sedimentation or turbidity within waters and wetlands
outside the permit area. This shall include, but is not limited to, the immediate
installation of silt fencing or similar appropriate devices around all azeas subject to soil
disturbance or the movement of earthen fill, and the immediate stabilization of all
disturbed areas. Additionally, the project must remain in full compliance with all aspects
of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes
Chapter 113A Article 4).
e. The activities authorized by this general permit must not interfere with the
publics right to free navigation on all navigable waters of the United States. No attempt
will be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work for a reason other than safety.
£ The permittee understands and agrees that, if future operations by the United
States require the removal, relocation, or other alteration, of the structure or work herein
authorized, or if, in the opinion of the Secretazy of the Army or his authorized
representative, said structure or work shall cause unreasonable obstruction to the free
navigation of the navigable waters, the permittee will be required, upon due notice from the
Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused
thereby, without expense to the United States. No claim shall be made against the United
States on account of any such removal or alteration.
g. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will, without expense to the United States and
in such time and manner as the Secretary of the Army or his authorized representative
may direct, restore the affected water of the United States to its former conditions.
h. The permittee will allow the Wilmington District Engineer or his .
representative to inspect the authorized activity at any time deemed necessary to assure
that the activity is being performed or maintained in strict accordance with the Special
and General Conditions of this permit.
i. This general permit does not grant any property rights or exclusive privileges.
j. This permit does not authorize any injury to the property or rights of others.
k. This general permit does not authorize the interference with any existing or
proposed federal project.
1. In issuing this permit, the Federal Government does not assume any liability for
the following:
(1) Damages to the permitted project or uses thereof as a result of other
permitted or unpermitted activities or from natural causes.
(2) Damages to the permitted project or uses thereof as a result of current
or future activities undertaken by or on behalf of the United States in the public interest.
(3) Damages to persons, property, or to other permitted or unpermitted
activities or structures caused by the activity authorized by this permit.
(4) Design or construction deficiencies associated with the permitted work
(5) Damage claims associated with any future modification, suspension, or
revocation of this permit.
m. Authorization provided by this general permit may be modified, suspended or
revoked in whole or in part if the Wilmington District Engineer, acting for the Secretary
of the Army, determines that such action would be in the best public interest. The term
of this general permit shall be five (5) yeazs unless subject to modification, suspension or
revocation. Any modification, suspension or revocation of this authorization will not be
the basis for any claim for damages against the United States Government.
n. This general penmit does not authorize any activity, which the District
Engineer determines, after any necessary investigations, would adversely affect:
(1) Rivers named in Section 3 ofthe Wild and Scenic Rivers Act (15
U.S.C. 1273), those proposed for inclusion as provided by Sections 4 and 5 of the Act
and wild, scenic and recreational rivers established by state and local entities.
(2) Historic, cultural or archeological sites listed in or eligible for
inclusion in the National Register of Historic Places as defined in the National Historic
Preservation Act of 1966 and its codified regulations, the National Historic Preservation
Amendment Acts of 1980 and 1992, the Abandoned Shipwreck Act of 1987 and the
Native American Graves Protection and Repatriation Act.
(3) Sites included in or determined eligible for listing in the National
Registry of Natural Landmarks.
o. This general permit does not authorize any activity that will adversely affect
any threatened or endangered species or a species proposed for such designation, or their
designated critical habitat as identified under the Federal Endangered Species Act (16
U.S.C. 1531). Information on the location of threatened and endangered species and their
critical habitat can be obtained directly from the Corps field offices or at the following
internet address: httu://www.ncnhp.or Paees/heritaeedata.html. Permittees should
notify the Corps if any listed species or designated critical habitat might be affected by
the proposed project and may not begin work until notified by the Corps that the
requirements of the Endangered Species Act have been satisfied and that the activity is
authorized:
p. Permittees are advised that development activities in or near a floodway may
be subject to the National Flood Insurance Program that prohibits any development,
including fill, within a floodway that results in any increase in base flood elevations.
This general permit does not authorize any activity prohibited by the National Flood
Insurance Program.
q. The permittee must install and maintain, at his expense, any signal lights and
signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on
authorized facilities. For further information, the permittee should contact the U.S. Coast
Guard Marine Safety Office at (910) 772-2191.
r. The permittee must maintain any structure or work authorized by this permit in
good condition and in conformance with the terms and conditions of this permit. The
Permittee is not relieved of this requirement if the Permittee abandons the structure or
work. Transfer in fee simple of the work authorized by this permit will automatically transfer
this permit to the property's new owner, with all of the rights and responsibilities enumerated
herein. The permittee must inform any subsequent owner of all activities undertaken
under the authority of this permit and provide the subsequent owner with a copy of the
terms and conditions of this permit.
s. At his sole discretion, any time during the processing cycle, the Wilmington
District Engineer may determine that this general permit will not be applicable to a
specific proposal. In such case, the procedures for processing an individual permit in
accordance with 33 CFR 325 will be available.
t. All fill material placed in waters or wetlands shall be generated from an upland
source and will be clean and free of any pollutants except in trace quantities. Metal
products, organic materials (including debris from land clearing activities), or unsightly
debris will not be used.
u. Except as authorized by this general permit or any USACE approved
modification to this general permit, all excavated material will be disposed of in approved
upland disposal azeas.

Water Quality Certification Number 3693 Is issued in conformity with the requirements of Section
401, Public Laws 92-500 and 95-217 of the United States and subject to the North Carolina
Division of Water duality Regulations in 15A NCAC 2H, Section .0500 and 15A NCAC 26.0200
for the discharge of fill material to waters and wetland areas as described in the Wilmington
DisMcYs Regional (General) Permit Number 198200030 and Regional Permit Number
198200079 and for the Riparian Area Protection Rules (Buffer Rules) in 15A NCAC 26 .0200.
The State of North Carolina certifies that the specified category of activity will not violate
applicable portions of Sections 301, 302, 303, 308 and 307 of the Public Laws 92-500 and 95-217
if conducted In accordance with the conditions hereinafter set forth.
Activities which require approval by the US Army Corps of Engineers under either of these
Regional Permits, but do not result in fill, dredging or excavation of waters or wetlands (such as
docks, piers or boathouses), do not require written approval from the Division of Water Quality as
long as they compty v~ith all other conditions of this General Certlflcation.
Activities that do result in fill, dredging or excavation of waters or wetlands under this Water
Quality Certlflcation, require written approval from the Division of Water Quality.
Projects that have received a Notice of Violation from the Division of Land Resources and/or the
Division of Water Quality are required to submit a complete application and receive written
approval to use this Water Quality Certification regardless of the proposed impact amount to
streams, wetlands, and waters.
Any impacts to streams and/or buffers in the Neuse, Tar-Pamlico, Randleman and Catawba River
Basins (or any other basins with Riparian Area Protection Rules [Buffer Rules) in effect at the
time of application [in accordance with 15A NCAC 2B .0200)), unless the activities are listed as
"EXEMPT" from these Rules-
In accordance with North Carolina General Statute Section 143-215.3D(e), any requirement for
written approval fora 401 Water Quality Certification must include the appropriate fee. If a
project also requires a CAMA Permit, then one payment to both agencies shall be submitted and
will be the higher of the two fees.
Conditions of Certification:
No Impacts Beyond the Thresholds Authorized by this General Certlflcation
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas
beyond the thresholds established for use of this Certification, beyond the footprint of the
impacts authorized in the written approval, including incidental impacts. All construction
activities, including the design, installation, operation, and maintenance of sediment and
erosion control Best Management Practices, shall be performed so that no violations of
state water quality standards, statutes, or rules occur.
2. Standard Erosion and Sediment Control Practices
Erosion and sediment control practices must be in full compliance with all specifications
governing the proper design, Installation and operation and maintenance of such Best
Management Practices:

a. Design, installation, operation, and maintenance of the sediment and erosion
control measures must be such that they equal, or exceed, the requirements
specified in the most recent version of the North Carolina Sediment and Erosion
Control Manual. The devices shall be maintained on all construction sites,
borrow sites, and waste pile (spoin projects, including contractor-owned or
leased borrow pits associated with the project.
b. For borrow pit sites, the erosion and sediment control measures must be
designed, installed, operated, and maintained in accordance with the most
recent version of the North Carolina Surface Mining Manual.
c. Reclamation measures and implementation must comply with the reclamation in
accordance with the requirements of the Sedimentation Pollution Control Act and
the Mining Act of 1971.
d. Sufficient materials required for stabilization and/or repair of erosion control
measures and stormwater routing and treatment shall be on site at all times.
e. If the project occurs in waters or watersheds classified as Primary Nursery Areas
(PNA's), Trout (Tr), SA, WS-I, WS-II, High Quality (HQW), or Outstanding
Resource (ORW) waters, then the sediment and erosion control requirements
contained within Design Standards in Sensitive Watersheds (15A NCAC 04B
.0124) supersede all other sediment and erosion control requirements.
3. No..Sediment and Erosion Control Measures in Wetlands or Waters
Sediment and erosion control measures should not be placed in wetlands or waters
without prior approval by the Division. If placement of sediment and erosion control
devices in wetlands and waters is unavoidable, design and placement of temporary
erosion control measures shall not be conducted in a manner that may result in dis-
equilibrium of wetlands or stream beds or banks, adjacent to or upstream and down
stream of the above structures. All sediment and erosion control devices shall be
removed and the natural grade restored within two (2) months of the date that the Division
of Land Resources or locally delegated program has released the project.
4. Construction Moratoriums and Coordination
All moratoriums established by NC Wildlife Resources Commission (WRC), US Fish and
Wildlife Service (USFWS), NC Division of Marine Fisheries (DMF), or National Marine
Fisheries Service (NMFS) to protect trout, anadromous fish, or other aquatic species must
be obeyed.
All work within the twenty-flue (25) designated trout counties, or identified state or federal
endangered or threatened species habitat shall be coordinated with the appropriate WRC,
USFWS, NMFS, and/or DMF personnel.
5. Riparian Area Protection (Buffer) Rules
Activities located in the protected 50-foot wide riparian areas (whether jurisdictional
wetlands or not) within the Neuse, Tar-Pamlico, Catawba, or Randleman (or any other
basin with buffer rules), shall be limited to "uses" identified within and constructed in
accordance with 15A NCAC 26 .020233, .0259, .0250 and .0243, and shall be located,
designed, constructed, and maintained to have minimal disturbance to protect water
quality to the maximum extent practicable through the use of best management practices.
All buffer rule requirements, including diffuse flow requirements, must.be met.
For sites with buffer rules in effect at the Ume of application, forested vegetation removed
from buffer areas for construction access purposes shall be re-established within the next
growing season following construction of the project.

6. Water Supply Watershed Buffers
The 30-foot wide vegetative buffer (low-density development) or the 100-foot wide (high-
density development) shall be maintained adjacent to all perennial waters except for
allowances as provided in the Water Supply Watershed Protection Rules (15A NCAC 26
.0212 through .0215J. .
7. If concrete is used during the construction, then a dry work area should be maintained to
prevent direct contact prevent direct contact between curing concrete and stream water.
Water that inadvertently contacts uncured concrete should not be discharged to surtace
waters due to the potential for elevated pH and possible aquatic life/fish kills.
8. Rip-rap shall be installed waterward of bulkheads installed in freshwater lakes to ensure
protection of aquatic habitat Construction over wetlands shall be elevated at least three
(3) feet above any wetlands, and floating structures shall not rest periodically on the
bottom.
9. Piers and boat houses shall be constructed to provide for storage and removal of sewage
rather than allowing raw waste or other sewage to be disposed directly into surtace
waters.
10. Deed notifications or similar mechanisms shall be placed on all retained jurisdictional
wetlands, waters and protective buffers in order to assure compliance for future wetland,
water and buffer impact. These mechanisms shall be put in place at the time of recording
of the property, or of individual lots, whichever is appropriate. A sample deed notification
can be downloaded from the 401/V1letlands Unit web site at
http://h2o.enr.state.nc.us/ncwetlands. The text of the sample deed notification may be
modified as appropriate to suit the project.
11. If an environmental document is required under NEPA or SEPA, then this General
Certification is not valid until a Finding of No Significant Impact (FONSI) or Record of
Decision (ROD) is issued by the State Clearinghouse.
12. For activities requiring written approval, additional site-specific conditions may be added
to the approval letter in order to ensure compliance with all applicable water quality and
effluent standards.
13. When written authorization is required for use of this certification, upon completion of all
permitted impacts included within the approval and any subsequent modifications, the
applicant shall be required to return the certificate of completion attached to the approval.
One copy of the certificate shall be sent to the DWQ Central Office in Raleigh at 1650
Mail Service Center, Raleigh, NC, 27699-1650.
14. This General Certification shall expire three (3) years from the date of issuance of the
approval letter from the Division or on the same day as the expiration date of the
corresponding Regional Permit 198200030 or 198200079. The conditions in effect on the
date of issuance of Certification for a specific project shall remain in effect for the life of
the project, regardless of the expiration date of this Certification. If the construction
process for approved activities will overlap the expiration and renewal date of the
corresponding 404 Permit and the Corps allows for continued use of the 404 Permit, then
the General Certification shall also remain in effect without requiring re-application and
re-approval to use this Certification for the specific impacts already approved.

15. The applicantlpermittee and their authorized agents shall conduct all activities in a
manner consistent with State water quality standards (including any requirements
resulting from compliance with §303(d) of the Clean Water Act), and any other
appropriate requirements of State and Federal Law. If the Division determines that such
standards or laws are not being met, including failure to sustain a designated or achieved
use, or that State or Federal law is being violated, or that further conditions are necessary
to assure compliance, then the Division may reevaluate and modify this General Water
Quality Certification.
Non-compliance with or violation of the conditions herein set forth by a specific fill project shall
result in revocation of this General Certification for the project and may result in criminal and/or
civil penalties.
The Director of the North Carolina Division of Water Quality may require submission of a formal
application for Individual Certification for any project in this category of activity If it is determined
that the project is likely to have a significant adverse effect upon water quality including state or
federally listed endangered or threatened aquatic species or degrade the waters so that existing
uses of the wetland or downstream waters are precluded.
Public hearings may be held for specific applications or group of applications prior to a
Certification decision if deemed in the public's best interest by the Director of the North Carolina
Division of Water Quality.
