The North Carolina Departmcnt of Trausportation (NCDOT) is proposing ro repince the subject
bridge. The existing 20' W x I T L(span) timber bridge needs to be replaeed due to deterioration
and insu�cient width. The proposed replace�uent sh�ucture will be a 22'9" W(spau) x 5'4" H x
3T6" L aluminum box culvert on a 1.2% slope and I05° skew. The culvert inlet, mid-point, and
outlet will have LS H sills with 5' W x 6" D notches to help retain stream bedload, maintain a
b�se flow channel width, and facilitate fish passage. An off-site detour will be used while the
bridge is removed and the culvert is consh ucted in the same location.
Enclosed are a PCN application, preliminai}� jurisdictional fonn, SI IPO forms, culvert avoidauce
and miuimization forms, Division of Mitigation Seivices mitigation acceptance letter, pl�n sheets
showiug the proposed work, e marked vicinity map, a USGS quacl map, photographs, and other

The North C�rolin� Natural Heritage Program d�t�base ���Ts checked for records of threatened
and endangered species. There are S1 species Iisted for Haywood Connty thathave federal status.
The bog �urtle (Gl��p[e»»�s nnJrlenbergii) is listed as threateued due to similarity of appearance to
the listed noithern bog turtle. Bald e�gle (Hnlineetus leucocephalus) is listed under the IIald and
Golden Eagle Protection Act (HGPA). Nine species, Carolina no�theru tlying sqairrel
(G/nucomys soln•inus co(ornh�s), gray b�t (itl��oiis grisescens), Indinna bat (iYL��o1is so�lolis),
AppalTchian elktoe (dlasmidonla rorene/irnm), spruce-fir moss spider (d�licrohe.��m•a iurntlivngn),
small tvhoiied pogonia (Isoh•ia inedeoloides), spreading aveus (Gernu radiotrnn), rock gnome
lichen (G��ninorterma linern•e), and noithern long-eared bat (nd��otis septenh•ionalis, NLEB) Tre
kno�vn from current records and are listed as eitlier thre�tened or endangered. According to the
USPWS, Ha}�vood County is now considered occupied sunuuer rTnge for Indiana bats and
NLEB.
Appalachian elktoe are found in some well-oxygenated streams with moderate to fast flo�ving
water and stable, mised substrates of silt, sand, gravel, and/or cobble. Streams that suppo�t this
mussel are typically much lerger than Rogers Cove E3ranch. The only records in Haywood
County are from the Pigeon River and the lo���er portions of the East Pork Pigeon and West Fork
�Nothing Compares`�.�

Pigeon rivers upsti�eam of Canton; there are no records from a��y tributaries to these rivers. The
Pigeou River is about 2.5 miles downstream of Uie bridge site aud this reach of the river is over 8
river miles do�vnstream of occupied mussel l�abitat.
With rare esception, gray bats roost in caves year-round and Indiana bats and NLEB winter in
caves or mines with stable, but not freezing, cold temperatures. Tliis project only involves a
small bridge replacement, so conshvction work will not e�tend far fi�om the existing right-of-�vay
into areas where caves could occur. There are no caves or mines visible ne�r tlie bridge and,
accordiug to USGS d1ta, the nearest underground mine is over 10 miles away. Therefore, gray
bats and hibernating Indiana bats and NLEB �vill not be affected by the p�roject.
In summer, Indiana bats and NLEB generally roost on sh•uchu•es or under the loose bark of trees,
either dead with peeling bark or cavities, or live trees with shaggy bark such as white oak,
maples, sycamore and hickories. The bridge tvas smveyed on June 1, 2015 and there were no
roosting bats or any evidence of bat usage (i.e. staining or g�iano). The structure is only a fe�v
feet above the water surface and very cool underneath. There are no known NLEB hibernacula or
maternity roost trees �vithiu 0.25 mile or l50 feet, respectively, of the bridge site. Therefore, the
project sliould be consistent with exceptions for incidental take outlined in tlie NLEB Final 4(d)
rule. Tfie construction work may require tlie removal of 2-3 large willow trees near the bridge.
To protect Indi�na bats, any obstructing trees will be removed fi•om October l5 to April l5
(winter clearing). With this measw•e, we recouunend a"may affect, not lilccl,y to adversely
affecP' determination for Indiana bat.
Small whorled pagonia general ly occurs in open, dry, deciduous woods with acid soil, though
habitats can include slopes along streams and mesic forest witli white pine aud rhododendron.
Land use adjacent to the bridge is maintained road shoulders, lawns, and landscaping. There is
no l�abitat near the bridge capable of suppo�ting small whorled pagonia.
The Carolina northern flying squirrel, rock gnome lichen, spruce-fir moss spider and spreadiug
avens are found in sp�lice-fir forests and other isolated high elevation locations in �vestern North
Carolina. However, rock gnome lichen is an exception because it can occasionally be fow�d at
lower elevations in deep river gorges with liigh humidity or on some vertical rock faces that are
periodically wet. Tlie bridge site l�as an elevatiou of only 2,580 feet and Iacks rock faces and
other habitat conditious required by these species.
The project is limited in scope. Erosion and sedimentation control measures will be implemented
to minimize adverse effects of tlie work on aquatic habitats. Habitats for listed species appear
lacking at tlie project site and none of these species were observed during field visits. For these
reasons and those discussed above, �ve recommend that a detenuination of"uo eSfect" on listed
species apply to this project, except for bats as noted above.
This project was revietved by NCDOT's Human Environment Unit in 201 I. Surveys were not
required for historic struchires or archeological resources �vitli determinations of no effect (see
attached forms).
NCDOT best management practices will be used to miuimize and control sediment�tion and
erosion on this project The construction foremau will review all erosion control measures daily
to ensw�e sedimentation and erosion controls are being effectively controlled. If the devices are
not fimctioning as intended, they will be replaced immediately with better devices.

Rogers Cove Branch (DWQ Class: C) is shown on the USGS topographic map as a perennial
stream. The channel is well defined with a substrate of sand, silt, gravel, and rock attd is
approximately 5 feet in widtl�. TUe sh•eam has safficieut flow to support fish and ot6er aquatic
life. Rogers Cove Branch flows to Richland Creek, �vliich then flows to the Pigeon River (about
2.5 miles downstream of the bridge). Tl�e Pigeon River meets the definition of a Traditional
Navigable Water (TNW). For these reasons, we believe Rogers Cove Branch is a Relatively
Pennanent Water (RPW) and is under the jnrisdiction of the U.S. Army Corps of Engineers. In
order to wnstruct tlie project, it rvill be necessa�y to impact waters of the United States in the
French Broad River Basiu (CU 06010106). Specifically, NCDOT is requesting to replace Bridge
No. 430309 �vith an aluminum box culvert. Listed below is a summary of the proposed impacts.

The aluminum box culvert was designed to meet the hydraulic needs ot the site. The culvert will be on a 1.2% grade and
will be buried 1-foot into the stream substrate. Three (3) notched sills will be added lo reduce velocity and maintain a
natural channel widih and aquatic life passage during periods of low flow (see plan sheets).

All instream work will be pertormed in a dry work area using an impervlous dike and diversion to divert the water around

1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the permit applicant or other affected party
who requested this preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
"pre-construction notification" (PCN), or requests verification for a non-reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization
based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option to request an approved
JD before accepting the terms and conditions of the permit authorization, and
that basing a permit authorization on an approved JD could possibly result in less
compensatory mitigation being required or different special conditions; (3) that
the applicant has the right to request an individual permit rather than accepting
the terms and conditions of the NWP or other general permit authorization; (4)
that the applicant can accept a permit authorization and thereby agree to comply
with all the terms and conditions of that permit, including whatever mitigation
requirements the Corps has determined to be necessary; (5) that undertaking
any activity in reliance upon the subject permit authorization without requesting
an approved JD constitutes the applicanYs acceptance of the use of the
preliminary JD, but that either form of JD will be processed as soon as is
practicable; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a preliminary JD constitutes agreement that all
wetlands and other water bodies on the site affected in any way by that activity
are jurisdictional waters of the United States, and precludes any challenge to
such jurisdiction in any administrative or judicial compliance or enforcement
action, or in any administrative appeal or in any Federal court; and (7) whether
the applicant elects to use either an approved JD or a preliminary JD, that JD
will be processed as soon as is practicable. Further, an approved JD, a proffered
individual permit (and all terms and conditions contained therein), or individual
permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331,
and that in any administrative appeal, jurisdictional issues can be raised (see 33
C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes necessary
to make an official determination whether CWA jurisdiction exists over a site, or
to provide an official delineation of jurisdictional waters on the site, the Corps will

BrieJdescriptron ojrevietiv activities, results of revietv, and conclusions:
Review of HPO quad maps, HPO GIS infonnation, historic designations roster, and indexes was
undertaken on September 2, 2011. Based on this review, there are no existing NR, SL, LD, DE, or SS
properties in the Area of Potential Effects, which is 75' from the centerline each way and 300' from each
end. Cuaent Haywood County GISlTax information indicate that there are several structures within the
APE, two over fifty years of age, PIN 8617-82-9422 contains a 1932 house, however Bing Maps "Birds
Eye" view and Google Maps "Street View" wncluded Wat it has been heavily altered and is not NR
Eligible. Modem Mobile homes occupy the rest of the parcel. PIN 8617-92-0731 contains a house built
in 1930, however Bing Maps "Birds Eye" view and Google Maps "Street Vie�v" concluded that it is not
NR Eligible. Other structures within the APE are modem homes and various outbuildings including
detached garages and &ame sheds. There are no historic structures within the APE, and No Survey is
required. In addi[ion, Bridge No. 309 is not NR eligible based on the NCDOT Historic Bridge Inventory.

fhat there m•e no :midenlifred hislaric properties in the APE:
HPO quad maps and GIS infonnation recording NR, SL, LD, DE, and SS properties for the Haywood

Briejdescrip�ion ofreview activilies, resu!!s ofreview, and conclusions:
A map review and site file search was conduc[ed at the Office of State Archaeology (OSA) on Tuesday,
September 6, 2011. This work disclosed the location of no previously recorded arohaeological sites
situated within the projecPs APE or directly proximal to the APE. Most of the archaeological sites
recorded in the area contain prehistoric components and are located several miles north of the curcent
project area along the Pigeon River. No existing National Register of Historic Places (NRI-IP), State
Study Listed (SL), Locally Designated (LD), Determined Eligible (DE), or Surveyed Site (SS) properties
are within or proximal to tl�e defned APE as well. Topographic maps, historic maps (NC Maps website),
NRCS soil survey maps (Sf�, EvD), archaeologicaUhistorical reference materials, aerial photographs
(NCDOT(Haywood County GIS) and the Google Street View map application were utilized/inspected by
the culwral resource specialist to evaluate factors that may have contributed to historic or prehistoric
settlement within the project area; and to assess the level of modern, residential, agricultural, or other
erosive disturbances that may have impacted any potential resources contained within the project
construction footprint.

fhal there are no unidenlrfred hrstoric properlies in 1he APE:
USDA soil survey maps ofHaywood County illustrate that the majority of the project area (central
floodplain portion) is characterized by Saunook-urban land complex 2% to 1 S% slopes (SfG�, a gently to
strongly sloping soil within areas of urban land, bracketed by (EvD) Evard-Cowee complex 15% to 30%
slopes. As most prehistoric and historic archaeological sites in the region are chiefly relegated to flat land
surfaces arid slopes of less than 6%, the topography and urban land complex soils of the project area,
along with the extremely restricted and diminutive construction footprint, present a low probability of
containing intact significant archaeological resources.
Relatively few archaeological resources have been recorded in the vicinity of the ptoject area, though this
does not necessarily reflect a potential lack of resources here. It simply signals a sampling/survey bias as
few compliance-driven improvement projects necessitating archaeological survey have been conducted in
this residential portion of Haywood County directly north of Lake Junaluska. Likewise, a review of local,

county, and regional historic maps did not reveal any structures, features, or any other evidence of past
historic occupation in the projecPs AP&. This is not to say that past occupation of the project area did not
occur, but rather the maps inspected tended ro focus on physical attributes of the landscape and the more
homogeneous political and social features.
Finally, the Google Street View map application revealed that the hvo northern project quadrants are
characterized by disturbances associated with driveways on both eastern and western sides of SR1373, as
well as residential landscapes and signi6cant slope (ne quad). The southem quadrants were marked by
numerous residential disturbances (mobile homes, graded parking areas) and sloping ground surfaces near
the southem APE boundaries. The urban comple7c/sloping soils of the project study area, the lack of
undisturbed and long-term prehistoric residence sites nearby, the dismrbed nature of the maintained
SRI373 right-of-way corridor and those residential areas abutting it, and the diminutive and restricted
character of this state-funded construction effort make it highly unGkely that any significantcultural
resources or archaeological sites would be present within the APE as currently defined. No further
archaeological work is advocated for the Bridge No. 309 (Haywood County) replacement project.
