Dear Sirs:
Pursuant to paragraph 8 of the Settlement Agreement entered into on October 20, 2006, by the
North Carolina Department of Transportation (NCDOT) and the North Carolina Department of
Environment & Natural Resources -Division of Water Quality (DWQ) regarding the Vass
Bypass Project (TIP Project R-210), NCDOT is providing the following information:
A. NCDOT has installed all of the emergency spill control measures and devices as
listed in Attachment A to the Settlement Agreement, with the exception explained below, and all
the measures and devices are now operational. Attachment A required NCDOT to construct
grass swales on Section C of the project at station numbers 29+10 (Lt) [labeled as 29+10 Med in
the Settlement Agreement] and 31+10 (Lt) [labeled as 31+10 in the Settlement Agreement].
NCDOT constructed the swales earlier this year and installed the final device on June 25, 2007,
but received a Cease and Desist letter from the United States Corps of Engineers on July 3, 2007
requiring the removal of the swales and the restoration of the site. NCDOT has fully complied
with all requirements of the Corps regarding the site. It is NCDOT's understanding that DWQ
will require no further action at those station numbers.
