8. PROJECT SUMMARY: The applicant is proposing to install a new boat lift west of the

9. Narrative Description:
The Seagrave Properties, LLC project is located at 117 Maxwell Dr. in Harkers Island, Carteret
County. Maxwell Dr. is found by turning south off of Hwy 70 east onto Harkers Island road.
Follow this road over the existing Harkers Island Draw Bridge, which turns into Island Road, and
then turn onto the second right which is Maxwell Drive. The site lies on the north side of Brooks
Creek in this area.
The subject property is 17,685 square feet in its entirety and averages 3'-4' in elevation above
NHW. Currently on the high ground portion of the site is asingle-family home. Extending
off the high ground over the coastal marsh is an existing 6'x200' pier, 10'x20' existing
platform and a 15'x 15' existing boatlift. Along the shoreline of this property is a 50' fringe
of Coastal Marsh that contains Smooth Cordgrass (Spartina alterniflora) and Sea lavender
(Limonium). The high ground portion of the track is vegetated with Wax Myrtle (Myrica
cerifera , Yaupon Holly (Ilex vomitoria), Oleandar (Nerium oleandar) and Red Cedar
(Juniperus virginiana).
Brooks Creek has an evident shellfish resource within the intertidal area. There are
significant SAV resources at the mouth, but limited within the creek itself. During the site
visit there was no indication of either resource within the proposed excavation area as shown
on plats dated 11/20/2007. The shoreline has a total length along the NHW line of 100 ft,
There are single-family homes with private docks on both sides of the proposed project. .
The Division of Water Quality classifies this area as SA, HQW waters. This area is not a
Primary Nursery Area. This portion of Brooks Creek (also known as Knuckles Landing
Harbor per DMF) is closed to the taking of shellfish., Morehead City's Land Use Plan dated
1999 classifies this area as Limited Transition within the AEC's. There are no shellfish leases
in this area.
10. Proiect Description:
In order to obtain deeper water the applicant is proposing to excavate around the existing
dock, boatlift and new boatlift area. An access channel will also be excavated to connect to
recently dredged channel, which was dredged under Major Permit # 35-07.
In order to accomplish what is proposed the applicants are proposing using a bucket to barge
dredge and excavate a 47' x 20' channel increasing to 49', which will connect to the recently
dredged channel by existing neighbors. Additional dredging around the existing dock, boatlift
and new boatlift will be in a 54' x 51' area increasing to 57'. The cubic yards to be excavated
for the total project will be 369. The maximum excavation for the recently dredged
channel was -~ ft below NLW with the connecting waters at -6ft below NLW. The properties
involved with major permit # 35-07 were 119,123 and 125 Maxwell drive. A 13'x13' Boatlift
is also being proposed at the west end of the existing platform. Water depths around the
existing dock and platform average -1.8'NLW. The final depth for the new connecting channel
and excavation area around existing boatlift, platform, pier and new boatlift will not exceed -4
feet below NLW. Substrate composition is mostly silty/sand. Riparian lines were set through

major permit 35-07 and this application coincides with this.
11. Anticipated Impacts:
This proposed installation of the new boatlift and pilings would result in temporary turbidity
and would incorporate 169 square feet of Public Trust Area. An increase in turbidity will also
occur during excavation. The area proposed for excavation is a silty sand shallow bottom
habitat. There should be no hazard to navigation resulting from this project, as there are other
docks of equivalent length along the same shoreline. No coastal marsh would be filled or
excavated during this project. There is not a potential to impact SAV's or shellfish with
docking ingress and egress.

The following are my comments and recommendations regarding the aforementioned
proposal. The proposal is to install a 13'x13' boatlift, excavation of an 20' x47' channel
increasing to 49', which will connect to a recently dredged channel under major permit #
35-07. They are also proposing excavation around the existing dock, boatlift and new
boatlift area. This will be in a 51'x54' area increasing to 57'. The total cubic yards for the
project will be 369. The final depth will not exceed - 4 ft below NLW, which is the final
depth of the recently dredged channel. Numerous field visits and location of the _
proposed new channel, boatlift and dredging area around existing dock indicate that
SAWS and shellfish would not be disturbed. Therefore, I recommend the project be
authorized as proposed, contingent upon the following conditions:
1. This permit authorizes only the docks, piers, and other structures and uses
located in or over the water that are expressly and specifically set forth in the
permit application. No other structure, whether floating or stationary, may
become a permanent part of this docking facility without permit modification. No
non-water dependent uses of structures may be conducted on; in or over public
trust waters without permit modification.
2. No attempt will be made by the permittee to prevent the full and free use by the
public of all navigable waters at or adjacent to the authorized work.
3. The authorized structure and associated activity must not cause an unacceptable
interference with navigation.
4. The permittee will maintain the authorized work in good condition and in
conformance with the terms and conditions of this permit. The permittee is not
relieved of this requirement if he abandons the permitted activity without having it
transferred to a third party.
5. This permit authorizes a maximum of 2 boat slips. At no time shall more than 2
vessels be moored or docked at the facility. The restriction of the number of
vessels shall apply to all marine vessel .types, including but not limited to

The proposed project will serve an existing single-family residence located at 117
Maxwell Drive, Harkers Island, North Carolina. The project site is located adjacent
Brooks Creek in the Harkers Point subdivision. An existing 200' pier with platform and
one boatlift were previously installed at the site.
The project consists of installation of a second boatlift and excavation of an access
channel and additional dredging to accommodate the existing dock, lift, and proposed lift
facilities.
The proposed access channel will connect to a recently dredged channel located west of
the Segrave property. The existing channel provides access to the Harbor of Refuge
Channel for three properties west of the Segrave site as shown on the site plans.
The proposed access channel will measure 47' by 20' increasing to 49'. The project
includes additional dredging for better access to the existing dock, lift, and proposed lift
facilities associated with the Segrave property. The area of additional dredging will
measure 54' x 51' increasing to 57'.
A boatlift measuring 12.5' x 12.5' is also proposed. The new boatlift will be installed on
the west side of the existing dock and platform as shown on plan drawings.
