On behalf of LG Carolina Beach and Independence Blvd, LLC, we are requesting authorization from
the USACE to use NWP 39 for 0.12 acres of permanent impacts to jurisdictional wetlands for
construction of the Carolina Crossings commercial center. We are also requesting a DWR 401
WQC for the referenced impacts.
The project is ±5.13 acres in size and is located north of the intersection of Independence Blvd and
Carolina Beach Road, in Wilmington, New Hanover County (Latitude: 34.176769N; Longitude: -
77.924803W). The project is located in the Cape Fear River basin and onsite waters drain to
Barnard's Creek. The Water Quality Classification for Barnard's Creek is C; SW and the Stream
Index Number is: 18-80. The cataloging unit for the site is 03030005.
Proposed Project
The purpose of the proposed project is to construct a mixed use commercial center to service this
rapidly growing area of Wilmington. The proposed project will consist of a Circle K gas station on
the corner lot, with anticipated retail and office buildings on the two parcels adjacent to Carolina
Beach Road.
Project History
The proposed project was previously issued a NWP 39 (AID SAW -2010-01906) in February 2011
under the project name Independence Ventures Center. The previous NWP 39 authorized the
impact to all0.18 acres of onsite wetlands for construction of the commercial center. A copy of the
previous NWP 39 has been provided as an Appendix. The previous permit required 0.36 acres of
wetland mitigation (2:1 ratio), which was purchased from NCEEP (now NCDMS) on 12/15/11,
which satisfied the mitigation requirements. The NCEEP mitigation payment receipt has been
provided as an Appendix.

The 0.06 acres of authorized wetland impacts associated with the Azalea Health and Rehab Center
were completed prior to expiration of the previous NWP 39 on March 18, 2012. Additionally, the
stormwater management pond for the entire project was also constructed. However, due to the
economy at the time, the additional development was never constructed, and the remaining
authorized impacts were never completed. The property has since been purchased by LG Carolina
Beach and Independence Blvd, LLC, and the remaining areas of the proposed project will now be
developed. Therefore, we are requesting authorization for 0.12 acres of previously permitted
permanent wetland impacts in order to complete construction of the project.
The project was previously issued a "No Written Concurrence Needed" letter from NCDWR
(Project # 11-0130) on 03/24/11, as the impacts were below the 1/3 acre threshold at the time. A
copy of the previous "No Written Concurrence Needed" letter has been provided as an Appendix.
As a result of changes to the WQC No. 3890 conditions, the proposed 0.12 acres of permanent
wetland impacts exceeds the current 1/10 acre threshold, and therefore will require a 401 WQC.
Ms. Emily Hughes with the Corps of Engineers issued a Jurisdictional Determination (AID# SAW -
2010 -01906) for the subject property on December 22, 2010, which has expired. We have included
a Preliminary JD Request for the remaining wetlands with this submittal for issuance of the
requested NWP 39.
Proposed Impacts
The proposed impacts consist of 0.12 acres of permanent wetland impacts as a result of
construction of the proposed project.
Avoidance and Minimization
Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted
to identify the jurisdictional wetlands within the proposed project.
The onsite wetlands consist of very small, disconnected wetland pockets that are remnants of a
historically larger inter -stream wetland system. As a result of the existing development
surrounding the project site, the onsite wetlands have been severed from offsite wetlands, with the
only hydrologic connection being provided through a series of culverts and road -side ditches, which
has greatly reduced the functional value of the onsite wetlands. As a result of the surrounding
development, the watershed/drainage area of the onsite wetlands has been reduced to the 7.6 acre
project site. In the current condition, the onsite wetlands are recharged by direct rainfall and runoff
from onsite uplands with very little, if any, influence from groundwater fluctuations.
During the planning stage of the proposed project, it was determined that impacts to onsite
wetlands could not be completed avoided. The City of Wilmington requires that all runoff from high
density developments be captured and treated in a stormwater management system. If direct
impacts to onsite wetlands were avoided in the site plan, the stormwater management system
would divert water away from the wetlands and into the stormwater pond, severing the natural
hydrologic recharge source of the onsite wetlands. Due to the small size of the wetlands, hydrology
sufficient to maintain wetland function could not be maintained without runoff from adjacent

uplands and the onsite wetlands would eventually dry up and convert to uplands in the matter of a
few years. Therefore, it was determined that the integrity and long term viability of the onsite
wetland pockets could not be maintained in the post -development condition and the onsite
wetlands would be secondarily impacted even if direct impacts were avoided. It was determined
that the functional value of the onsite wetlands would be better served through the provision of
wetland mitigation within a significant wetland system. Therefore, the proposed site plan has been
designed to directly impact all onsite wetlands and will result in 0.12 acres of permanent wetland
impacts.
Mitigation
The previously issued NWP 39 required mitigation at a 2:1 ratio, resulting in 0.36 acres of wetland
mitigation being required. The 0.36 acres of wetland mitigation was purchased from NCEEP (now
NCDMS) on 12/15/16. Therefore, the mitigation requirements for the proposed permanent
wetlands impacts has been provided. A copy of the NCEEP mitigation payment receipt has been
provided as an Appendix.
The current request is for re -authorization of 0.12 acres of permanent impacts to jurisdictional
wetlands to complete the previously authorized wetland impacts (see the attached maps and
PCN for details).

A NWP 29 (AID SAW -2010-01906) was issued for the proposed project on February 22, 2011 under the previous project
name Independence Ventures Center, which authorized 0.18 acres of permanent wetland impacts for filling of all onsite
wetlands. The authorized impacts associated with the rehab facility included in the previously permitted project were
completed prior to expiration of the permits in March 2012. The authorized impacts for the remaining wetlands were not
completed prior to expiration of the permits, and therefore we are requesting authorization to complete the previously
approved wetland impacts.

The previously issued NWP 39 documented that the project would not result in impacts to federally endangered species
or designated critical habitat. Since the original permit was issued in 2011, the Northern Long -Eared Bat has been listed
as "threatened" by the USFWS.
WR reviewed the NC Natural Heritage Program database, located at https://ncnhde.natureserve.org/content/map to
identify if there were any known occurrences of endangered species on or near the proposed project. The review of the
NHP data did not identify any occurrences of endangered species or critical habitat on the subject property or within 1.0
miles of the project, see attached NCNHP project review letter. Site reviews did not identify any potential habitat for any
federally protected species known to occur in New Hanover County, except for the Northern Long Eared Bat.
Potential habitat for the northern Long-eared bat (NLEB) is listed as mature forest with trees over 3" dbh, which is used
for roosting during the day. Since the project area contains small areas with trees over 3" DBH, there is potential northern
long eared bat habitat present. The USFWS Final 4(d) rule for the Northern Long -Eared bat specifies that tree removal
within the White Nose Syndrome (WNS) Zone is not prohibited as long as it occurs more than 0.25 miles from known
hibernacula and does not result in destroying known occupied maternity roost trees, or any other trees within a 150 ft -
radius from the maternity tree, during the pup season (June 1 — July 31). The proposed project is not located within 0.25
miles of any known hibernacula, nor is there any known maternity roost trees present on the project. Additionally,
clearing of mature forest between June 15' and July 315' is not anticipated for construction of the proposed project.
Therefore, WR concludes that the project "may affect, but is not likely to adversely affect' the northern long-eared bat.

I. REQUESTS FOR CORPS APPROVAL OF SURVEY PLAT
Prior to final production of a Plat, the Wilmington District recommends that the Land
Surveyor electronically submit a draft of a Survey Plat to the Corps project manager for
review.
Due to storage limitations of our administrative records, the Corps requires that all hard-
copy submittals include at least one original Plat to scale) that is no larger than 11"x17"
(the use of match lines for larger tracts acceptable). Additional copies of a plat, including
those larger than 11 "x17", may also be submitted for Corps signature as needed. The
Corps also accepts electronic submittals of plats, such as those transmitted as a Portable
Document Format (PDF) file. Upon verification, the Corps can electronically sign these
plats and return them via e-mail to the requestor.
(1) PLATS SUBMITTED FOR APPROVAL

1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the permit applicant or other affected party
who requested this preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
