Brookhaven Properties, LLC. (c/o Mike Hargett) Page Two 9. PROJECT DESCRIPTION: The project site is located on Brookhaven Trail, adjacent to Sturgeon Creek, located in Leland, Brunswick County. To locate the property from Wilmington, take US-17/US-76W from Wilmington. Exit at NC-133 S and turn right onto Village Road NE. Turn right onto Fairview Rd. at the first stoplight. Travel to the end of Fairview Road and turn right onto Live Oak Drive. Brookhaven Trail is the first street on the left. To locate Pier 1, turn right at the end of the road (which is also Brookhaven Trail) and the pool, clubhouse and docking facility will be located immediately on the left. Pier 2 would be located at the end of the cul-de-sac if~ou were to turn left from Live Oak Drive onto Brookhaven _ Trail and then turn left at the end of the road (Brookhaven Trail). Lots 1-22 are deeded to Mean High Water (MHW). A CAMA General Permit (#33411-D) was issued to Brookhaven Properties on 5/19/03 for a dock at Lot 1 1, which was never constructed. CAMA Major Permit #131-04 was issued on September 15, 2004 for development of the 20.12-acre parcel. The permit authorized Brookhaven subdivision, a 36-lot residential community with associated utilities and amenities (pool, pool house and two community docking facilities). The first docking facility consists of a pier, measuring approximately 145' in length by 6' in width, leading to a approximately 20' by 20' gazebo with a floating dock, measuring 240' in length by 8' in width, with eight (8) 30' side-to slips. The gazebo was originally permitted at 13' in length by 13' in width, but was refined on 6/6/05 to increase the size of this structure to its current dimensions. The refinement also authorized a relocation and reconfiguration of the pool and pool house adjacent to the dock. This structure is referred to as Pier 1 in the current application (see Sheet 1 of 5). The current water depth adjacent to the boatslips is approximately -2.8' at Mean Low Water (MLW). Water depths were surveyed, and refer to Mean Sea Level (MSL). Note that MLW = -1.34' MSL. As permitted, the second docking facility (currently referred to as Pier 2 in the application and on the plans) consisted of a 345' long pier, measuring 6' in width, leading to a 13' by 13' gazebo. As planned, the gazebo then lead onto a 20' in length by 8' in width floating dock, and authorized an additional two slips to serve paddle crafts and transient boats. It appears that all work has been completed under this permit with the exception of Pier 2 facility, which has not yet been constructed. Condition #8 of the CAMA Permit #131-04 required deed restrictions to be placed on Lots 1-10, 12-22 and the community recreational areas. The Brookhaven Declaration of Conditions, Covenants and Restrictions, as recorded August 2005, states, "no individual piers shall be constructed adjacent to any individual lot without the prior written consent and approval from the Declarant which consent may be withheld for any reason. All piers shall be subject to CAMA and other applicable governmental regulatory agencies". An amendment has been proposed, but has not yet been recorded, which would state, "No individual piers shall be constructed adjacent to any individual lot with the exception of Lot #11. A proposed pier in conjunction with Lot #11 shall be subject to prior written consent and approval of the Declarant and/or the Association which consent may be withheld for any reason. All piers shall be subject to CAMA and other applicable governmental regulatory approvals." Lots 1-7, and Lots 9-17 within Brookhaven subdivision have been sold to individual property owners (see attached list of property owners and date of sale). An Environmental Assessment was submitted to the Division of Coastal Management for State Clearinghouse review of the proposed marina project on September 22, 2006. A Finding of No Significant Impact was issued on November 7, 2006. Brookhaven Properties, LLC. (c/o Mike Hargett) Page Three Highground vegetation consists of Cypress (Taxodium spp.), Oak (Quercus spp.), Red Maple (Ater rubrum), and Pine (Pinus spp.). Wetland vegetation consists primarily of Cattails (Typha spp.) and Giant Cordgrass (Spartina cynosuroides). The Brunswick County Land Use Plan classifies the adjacent waters as Conservation. The waters of Sturgeon Creek are classified SC by the Division of Water Quality. They are designated as inland fishing waters and therefore are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to. theharvest of shellfish PROPOSED PROJECT: As originally proposed in the Environmental Assessment (EA), 24 slips were proposed at Pier 1 and the dock would have measured 720' feet in length; 14 slips were originally proposed at Pier 2 and the dock would have measured 420 feet in length. Due to the uncertainty as to whether Lot 11 has riparian rights, the applicant has chosen to modify the permit request to avoid the riparian corridor of Lot 11. It was determined that this was a minor modification and which did not require a resubmittal of the EA. As currently proposed, the applicant is requesting to modify the permit to allow the extension of the floating dock at the first docking facility to measure 630' in length. It would remain 8' in width and would accommodate a total of 22 vessels, which includes a proposed floating jet ski dock measuring approximately 12' in length and 6' in width. The jet ski dock is proposed on behalf of a private property owner and was not included in the EA. Additionally, the applicant proposes to expand the second docking facility to accommodate a total of 17 vessels. The pier, as proposed, would be reduced in size to measure approximately 310' in length by 6' in width. The permittee is requesting the permit be modified to increase the dimensions of the gazebo to measure 16' in length by 20' in width and is also requesting an increase in the length of the floating dock from 20' (as permitted) to a length of 540', while remaining 8' in width. Again, no construction has commenced at the Pier 2 site. All slips would be for the exclusive use of property owners and would not be open to the general public. No additional services, such as fuel or restrooms, are to be provided. The applicant states no overboard discharge would be allowed. No dry docks or maintenance areas would be provided. Four "No Wake" signs are proposed, which are to be posted at either end of both docking facilities. Both docking facilities, as proposed, would accommodate a total of 38 vessels in side-to slips, each measuring approximately 30' in length, with an additional slip at the eastern end of Dock 1 in the location of the jet ski dock. 10. ANTICIPATED IMPACTS The two docking facilities would incorporate an additional 7,672 sq. ft. of Estuarine Waters and Public Trust Area. The construction of Pier 2 would shade approximately 1,860 sq. ft. of coastal wetlands. It is unclear whether the waterfront property owners within Brookhaven have riparian rights due to ambiguous wording of the Covenants & Restrictions. If so, the two docks would likely usurp the riparian access of Lots 4-10 and Lots 13-20. Eleven of these 15 lots have presently been sold to private property owners. Minor increases in turbidity should be expected during construction. The proposed docking facility would extend approximately 25' into the waterbody, which measures approximately 100' to 120' across, thus conforming to the ~/4 width rule. Project Description: Brookhaven Subdivision is an existing subdivision at the north east end of the Town of Leland located along Sturgeon Creek and the Brunswick River in Brunswick County. The project was initially constructed by clearing and grubbing of vegetation, grading of the road right-of-way, water main installation, sewer collection line installation, and sediment and erosion control measures such as a silt fence, gravel construction entrance, and water quality swales. The existing CAMA Permit allowed for construction of two community piers for this - 'est: One~as-~gazeb ~ o er was a pier with one long eight space floating dock. A permit had also been issued in the past for Lot 11 but no structures had ever been built and then the lot was sold to another individual, so we consider this previous permit void. The proposed Permit Modification is to allow 38 total boat slips. The existing Pier 1 location has already been built out with the pier, gazebo, and 8 boat slips. This area is proposed to add 13 slips bringing the total at Pier 1 to 21 boat slips. Pier 2 has nothing currently constructed and is proposed to add 17 boat slips, pier, and gazebo. 2. Site Description: The project site is in Brunswick Co., NC, located directly on Sturgeon Creek and the Brunswick River. The property on which the development will take place is currently owned by Brookhaven Properties, LLC. On site soils are fine sands to sandy loams. Existing wetlands have been delineated and approved jurisdictional determination by the USACE. Coastal vegetation has also been approved by CAMA. Permits have been applied for impacts to wetlands on site for the pipe /road crossings. Approval has been granted by NCDENR and awaiting approval from USACE. Upland construction onsite has been conducted and consists of paved roads with swale sections, pipe crossings, and water quality swales. Also included in the road right-of- way will be a water distribution system and sewer collection. Land use in the vicinity is residential. 3. Adjacent Property: The areas adjacent to the project site are mostly residential areas. 4. Drainage Considerations: The project is proposed as low density with total impervious to be 30 percent. The areas adjacent to Sturgeon Creek and the Brunswick River will naturally sheet flow to the marsh areas. All roadway runoff will be collected in roadside swales and drain to the water quality swales or the natural drainage way that crosses the site. 5. Erosion Control Considerations: The following erosion control measures have been used on this project: 1. For dimensions and specifications, see construction details. 2. Land Grading The existing slope of the site is from south to north toward Sturgeon and Brunswick River. If needed, silt fence should be cleaned and replaced if damaged. See Construction Detail for dimensions and specifications. 4. Water Quality Swale with Check Dam Water quality swales with 5 to 1 side slopes are located where road runoff drains off the road to marsh. The swale will be at least 100 feet long prior to a coastal wetland area. At the end of the swale will be a temporary rock check dam to prevent sediment erosion during construction.
