Ross Jr., Secretary ~ r North Carolina Department of Environment and Natural Resources ~_ ~ ~ ~ Colleen Sullins, Director Division of Water Quality January 17, 2008 DWQ Project # 07-2046 Brunswick County CERTIFIED MAIL: 7006 2760 0003 35301867 RETURN RECEIPT REQUESTED Funston Land and Timber, LLC Attn: Mr. Fleming Gibson 1007 Evangeline Drive Leland, NC 28451 Subject Property: Brunswick Forest Subdivision Phases 3 & 5 Brunswick County REQUEST FOR MORE INFORMATION Dear Mr. Gibson: On December 11, 2007, the Division of Water Quality (DWQ) received your Pre-Construction Notification application to fill or otherwise impact 0.386 acres of 404 Wetlands and 152 linear feet of stream to construct the proposed residential subdivision. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore unless we receive five copies of the additional information requested below at the DWQ central office, we will have to recommend moving towards denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Additional Information Requested: 1. In the December 20, 2007 letter from the U.S. Army Corps of Engineers, Kimberly Garvey requested an accurate, approved depiction of the extent of waters and wetlands of the U.S. on the parcel. Indicate all approved isolated or non-isolated wetlands, streams, or other waters of the State as overlays on the site plan. 2. Indicate all wetland and stream impacts including all fill slopes, crossings, dissipaters, and bank stabilization on the site plan. 3. Locate any planned sewer lines on the site plan. 4. Provide building envelopes for all lots with wetlands and streams on the site plan. 5. Indicate proposed lot layout as overlays on the site plan at a scale of no smaller than 1 "=50'. Submit a detailed full-size site plan, which includes all of the phases that have been approved through the Town of Leland. Provide cross sectional details for the road crossings showing the provisions for aquatic life passage. 7. Provide cross sectional details for the proposed elevated walkways referenced in the application. 8. Revise the Pre-Construction Notification application to reflect revised impacts as referenced above and below. Also, revise the application to reflect changes in the type of DA permit required or any other changes as necessary. 9. You do not appear to have avoided and minimized to the greatest extent practicable. As requested in the December 20, 2007 letter from the U.S. Army Corps of Engineers, explain why the proposed road crossings appear to be larger than normally would be needed for this type of development. List the alternatives considered and why they may or may not be viable, specifically bridging the crossings. 10. The crossing labeled as `Wetland Impact #6' leads to a stub road labeled on the site map that ends abruptly. The DWQ cannot permit such "roads to nowhere". Please remove or change this stub road to a terminal feature such as a cul-de-sac or provide details on the future development to which this stub road is pointed. Respond within 30 calendar days of the date of this letter. If we do not receive the above requested information within 30 calendar days of the date of this letter, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
