Because of the holidays, the receipt of this letter by the applicant, engineer and I were delayed. Currently, the engineer is working towards the changes requested in the December 20th letter but needs some additional guidance from your office. Therefore, the engineer and I have scheduled a meeting with Annette Lucas on January 22, 2008 at 1:00 PM. This letter is to request the DWQ to not withdraw this project from the 401 Certification Program and to allow an extension of our response time to the December 20, 2007 letter. Subject Property: Brightwood Trails Subdivision p ~ ~ ~ IJ LI L55 D Ut to Lick Creek [03Q401, 27-11-(0.5), WSIV, NSW] JAN i 8 2008 REQUEST FOR MORE INFORMATION DENR - WATER t]WWTY VdETLANDS AND STt)RMWATER BRAkC:h Dear Mr. Ohmann: On November 16, 2007, the Division of Water Quality (DWQ) received your application dated November 16, 2007, to fill or otherwise impact 0.172 acres of 404/wetland, 1391inear feet of perennial stream, and 8,122 square feet of Zone 1 Neuse River basin protected riparian buffers and 5,128 square feet of Zone 2 Neuse River basin protected riparian buffers to construct a residential subdivision. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. The riprap level spreaders that are proposed at the outlets of wet detention basins 3, 4, 5 and 6 do not meet the current state standards for diffuse flow. Please redesign these level spreaders with concrete lips per Chapter 8 of the NC Division of Water Quality Stormwater Best Management Practices Manual. In your resubmittal, please provide one completed Level Spreader Supplement Form for each proposed level spreader (make sure to include the Required Items Checklist with all required items attached.) If any of the filter strips down slope of wet detention basins 3, 4, 5 or 6 are not appropriate for level spreaders, then please provide an alternative BMP that removes a minimum of 30 percent of total nitrogen. Please design the BMP per the requirements of the BMP Manual and provide a BMP Supplement Form for each proposed BMP. See the web site above for the BMP Manual and the BMP Supplement Forms. 3. Please show contour lines down slope of the detention basin 2 scour hole so that the DWQ can confirm that it has been correctly sited per Chapter 8 of the BMP Manual. Please submit this information within 30 calendar days of the date of this letter. If we do not receive this requested information within 30 calendar days of the date of this letter, your project will be withdrawn and you will need to reapply with a new application and a new fee. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
