Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: The corridor for the proposed infrastructure varies from being a bottomland hardwood forested to a grass right-of-way. with intermittent driveway crossings and utility easements. An existing conditions map has been provided for detail, please see Existing Conditions sheet 1. The land use in the vicinity consists of rural residential with the American Tobacco Trail to the north. US Army Corps of Engineers (USACE) property at White Oak Creek and the Apex/Cary Water Treatment Plant to the south. 3b. List the total estimated acreage of all existing wetlands on the property: The wetland B stream delineation consisted of evaluating a corridor 50' beyond the edge of pavement from the north side of the USACE property down to the Apex/Cary Water Treatment Plant, on the east side of Wimberly Road. The construction corridor was then determined. The only jurisdictional wetlands that are present are identified and shown on the existing conditions maps and are within the easement on the USACE property. There is a total estimated acreage of 0.024 acres of wetlands within the project boundaries. 3c. List the total estimated linear feet of all existing streams (intermittent and perennial) on the property. The wetland 6 stream delineation consisted of evaluating a corridor 50' beyond the edge of pavement from the north side of the USACE property down to the Apex/Cary Water Treatment Plant, on the east side of Wimberly Road. The construction corridor was then determined. The only jurisdictional stream that is present is White Oak Creek and shown on the existing conditions maps and is within the easement on the USACE property. 3d. Explain the purpose of the proposed project: The purpose of this project is to provide a regional pump station, sanitary sewer and water to the White Oak Creek drainage basin. 3e. Describe the overall project in detail, including the type of equipment to be used The proposed regional infrastructure will consist of the White Oak Creek Sewage Pump Station, a 16 -inch force main and 12 -inch water potable water line that will connect south of the Apex/Cary Water Treatment Plant along Wimberly Road. In addition, there is a proposed 18 -inch gravity sewer line and a 12 -inch potable water line crossing the USACE property to the north, terminating on the north side of an existing 50' Colonial Pipeline Gas Easement. The easement(s) through the USACE property will overlap in order to minimize construction impacts through the USACE property, both the sanitary sewer and water line will utilize the bore 8 jack construction method when crossing White Oak Creek. From the pump station south, the easement for the force main and water fine will be 20' and will be utilizing the existing Right -of- Way. Comments: Please note that the disturbance for the construction is for two (2) separate utilities (i.a sanitary sewer and water line) crossing White Oak Creek. In order to minimize riparian buffer impacts, this construction easement has been combined for both utilities. In addition, the Town of Apex has agreed to a 10wide permanently maintained easement for each of the utilities, again minimizing future impacts to the riparian buffer 03-07-16-Additoinal Temporary Sedimentation 8 Erosion Control devices were needed during construction activities which resulted in disturbance within the riparian buffers, but no tree removal. Page 7 of 15 D. Impact Justification and Mitigation 1. Avoidance and Minimization la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. S&EC completed a wetland, stream and riparian buffer delineation for the proposed infrastructure project so that the project engineers could design a plan to minimize impacts to the natural resources to the maximum extent practicable. This delineation included evaluating the parcels of land directly south of the USACE property on the east and west side of Wimberly Road for the proposed pump station. In addition, this delineation consisted of evaluating a corridor 50' beyond the edge of pavement starting from the USACE property along the east and west side of Wimberly Road and south to the Apex/Cary Water Treatment Plant. SBEC also evaluated an additional route through the USACE property which followed the Colonial Pipeline Gas Easement. The proposed infrastructure project, which consists of a pump station, a gravity sanitary sewer and water line crossing White Oak Creek and a force main and water line going south along Wimberly Road will result in one impact area (see sheets Exhibit 1-3) on USACE property. This proposed impact area consists of permanent and temporary impacts to jurisdictional wetlands and riparian buffers associated with construction clearing, excavation and the pits required for a Bore and Jack construction method. it's important to note that the construction easement through the USACE property includes two different utilities and varies in width in order to minimize impacts to wetlands and riparian buffers. It's also important to note that Town of Apex has agreed to a 10' wide permanent maintenance corridor for each utility (i.e. sanitary sewer 8 water line) through the USACE property, therefore permanent (i.e. conversion of wetlands from forested to herbaceous) impacts and future riparian buffer clearing for this project have been minimized to the maximum extent practicable. 03-07-16- The Bore & Jack construction activities commenced and unanticipated flooding events of White Oak Creek were encountered which resulted in stream a bank failure. These flood events determined the need for dewatering the stream during the bore & jack construction activities. Therefore a temporary stream bypass was put in place to create a safe work environment and sand bags were utilized to stabilize the stream banks. Additionally, unexpected large debris (i.e. boulders, wooden timbers and tree stumps) have been come across during the bore & jack construction activities. A temporary trench box was put in place to control the work area and to minimize stream bank failures. All temporary stream and temporary buffer impacts will be restored and stabilized once the construction activities have completed. A stream bank stabilization plan will be submitted at a later date once the most appropriate plan is agreed upon by the Town of Apex, the US Army Corps of Engineers and the NC Division of Water Resources. in summary, the total updated impacts for this project are 0.024 acres of wetlands, 327 linear feet of stream, 6,233 W of Zone 1 and 3,482 ft' of Zone 2. Furthermore, the applicant is aware of the regional conditions associated with the Nationwide Permits 12 With respect to utility line activities (NWP 12 -Regional Conditions section 4.0), the applicant is proposing the Bore & Jack method to minimize impacts to streams and wetlands, any temporary discharges into wetlands during construction activities will be kept to minimum period of time and will be contained with appropriate erosion control methods, construction corridor proposed to be 45 'wide because sanitary sewer and water line both to be constructed at the same time within the same easement. utilities are not crossing the AIWW, the utilities are not aerial communication lines, the cleared wetlands within the construction corridor will be re -vegetated with native species and the permanently maintained corridor has been minimized to 10' wide with impacts less than 0.10 acres so mitigation has not been proposed, use of riprap will not be necessary and construction area will be monitored for hydraulic fracturing/hacking. 11b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Bore and Jack installation of the sewer line and the water line is being utilized. Sediment and Erosion Control methods will be employed and enforced during construction and removed once the project is completed. Following construction. grade will be returned to the original contours and planted with native wetland species. The Town will maintain only a 10' maintenance corridor over the sewer and water lines. 2. The Bore 8 Jack construction activities commenced and encountered unanticipated flooding events of White Oak Creek which resulted in a stream bank failure. These flood events determined the need for dewatering the stream during the bore 8 jack construction activities. Therefore a temporary stream bypass was put in place to create a safe work environment and sand bags were utilized to stabilize the stream banks. Additionally, unexpected large debris (i.e. boulders, wooden timbers and tree stumps) have been come across during the bore 8 jack construction activities. A temporary trench box was put in place to control the work area and to minimize stream bank failures. 3. Cumulative Impacts (DWQ Requirement) 3a. The proposed White Oak Creek Infrastructure project may result in future cumulative impacts however the Town of Apex has addressed these potential secondary and cumulative impacts within their "Secondary and Cumulative Impacts Master Mitigation Plan' and Biennial Reports found on the Town of Apex SC/ Master Mitigation Plan website: http //www. apexnc ora/servrcesiuubGc- works/environmental-programs-division/scr-master-mitigation-plan. We anticipate that the DWR will advise us if any additional information is necessary. 4. Sewage Disposal (DWO Requirement) 4a Clearly detail the ultimate treatment methods and disposition (non -discharge or discharge) of wastewater generated from the proposed project, or available capacity of the subject facility. This overall prgect is a proposed pump station, a sanitary sewer going north and a force main going south. No occurrences of federally protected species are documented within the project site, no federally protected aquatic species are documented by NH to occur in the project's HUC, and no federally protected species are documented by NHP to occur within 2 miles of the evaluated area. In addition, a preliminary evaluation of potentially suitable habitat for federally protected species was performed by reviewing available mapping including 2013 USGS quadrangles and 2013 aerial imagery. The preliminary review showed that potentially suitable habitat for Michaux's Sumac. A target species survey for Michaux's Sumac and an on-site assessment of potentially suitable habitat for federally protected species was performed by S&EC on June 10, 2014. Transects along the transition area between managed herbaceous roadside and forested areas were walked in search of Michaux's Sumac, and M specimens wet found. Several specimens of Winged Sumac (Rhus copallinum) were observed within the transitional area between managed/herbaceous roadside and planted pine forest.
