On October 20, 2015, the Division of Water Resources — Water Quality Programs (Division) received your
application dated October 7, 2015, requesting a 401 Water Quality Certification from the Division for your
project. On November 12, 2015 the Division requested additional information regarding this project. The
Division received partial responses to the request on January 6, 2016, February 8, 2016 and February 18,
2016 however the request was not completely addressed. The Division has determined that your
application remains incomplete and cannot be processed. The application is on -hold until all of the
following information is received:
1. Please provide more details regarding avoidance and minimization of the stream impacts for this
project. [15A NCAC 02H .0506(f) and (g)]
• This should include alternative designs and layouts of the road crossings. It appears that
there is an existing crossing within the project.
2. Please provide building envelopes for all lots with buffers on the site plans to demonstrate these
lots are able to be developed without additional impacts. [15A NCAC 02B .0267]
3. Please enumerate all riparian buffer impacts on the site plan and clearly label impacts (Buffer
Impact 1, etc.). The Division recommends highlighting by hatching or shading all impacts areas for
temporary impact areas and permanent impact areas. These impacts must be approved by the
local delegated municipality. [15A NCAC 02B .0267(8)(b)(iv)]

4. Per Condition 6 of GC 3890, all work must be done "in the dry". Therefore, dewatering methods
will be necessary to temporarily dewater the stream channel during pipe installation. Please
provide a construction sequence that details the method of dewatering to be utilized at the site
and the sequence of construction events to be followed to ensure compliance with this condition.
In addition, please ensure that the location of the temporary impacts are shown on the
construction drawings and clearly indicated in the impact table in the PCN. [15A NCAC 02H

Pursuant to Title 15A NCAC 02H .0502(e) and 15A NCAC 02B .0267, the applicant shall furnish all of the
above requested information for the proper consideration of the application. If all of the requested
information is not received in writing within 30 calendar days of receipt of this letter, the Division will be
unable to approve the application and it will be returned. The return of this project will necessitate
reapplication to the Division for approval, including a complete application package and the appropriate
fee.
Please respond in writing within 30 calendar days of receipt of this letter by sending three copies of all of
the above requested information to the 401 & Buffer Permitting Unit, 1650 Mail Service Center, Raleigh,
NC 27699-1650.
Please be aware that you have no authorization under the Water Quality Certification Rules for this
activity and any work done within waters of the state may be a violation of North Carolina General
Statutes and Administrative Code.
