Joe, It was good to talk with you today. Per your request, I wanted to follow up with you on the authorization of an additional extension until October 11, 2024. As discussed, Shenandoah has their own "in house" engineer and that engineer left in June (I thinkthat was the timeframe). They then hired another engineer, and that engineer left a few weeks in. So now they have hired another new engineer that is building a team and trying to catch up on all of the backlog of work. That said, we do not have enough information to respond to the Division with a thorough response today and I don't feel comfortable responding to only a portion of Zach's questions. Please confirm if the Division will allow an extension until October 11, 2024 to respond to the RFAI dated 7/19/2024. Thankyou, DEBORAH E. Zach, Shenandoah just recently hired someone to replace Andy Mills (project manager) and the Curtis Gautier (in house engineer) and I have scheduled a meeting with them next week to discuss the RFAI. That being said, I do not think that we are going to have time to get a formal response back to you by 8/18. Would it be possible to grant us a 30- day extension? The buffer determination letter provided as part of the application appears to be missing the USGS Topo Map page, possibly due to an upload error. Please provide a copy of the missing page for our application file. 2. Impact 1 Road Crossing a. The proposed culvert placement appears mis-aligned with the existing stream channel on the upstream side and placed in a relatively sinuous section of the stream. Road crossings should be designed to cross the stream at a perpendicular angle on a relatively straight section to minimize impacts to the extent possible. Please revise plans such that the culvert better aligns with the stream channel or provide a detailed justification for why the crossing cannot be relocated or modified. b. The retaining walls appear to be installed along the edge of the 50-foot riparian buffer but there are no impacts proposed to Zone 2, either temporary or permanent, for installation of certain sections of the wall. Please provide clarification on how the wall will be installed without impacting the riparian buffer or provide updated plans that include any additional impact totals necessary for the installation of the full retaining wall. 3. Impact 2 Road Crossing a. Stream A (SA) that is proposed to be impacted was determined to be subject to the Neuse Riparian Buffer Rules throughout the project boundary. The current impact maps appear to show a start location of the stream channel and temporary coffer dam on the upstream side of the culvert. Please provide clarification on this discrepancy. b. The culvert placement at this road crossing is proposed as 127.99 LF of 24" RCP @ 7.67% grade buried at 1 foot. We have found that burying steep -sloped pipes creates instability, exacerbates erosion, and can impede aquatic passage. For structures less than 72" in diameter/width, and topographic constraints indicate culvert slopes of greater than 2.5%, culvert burial is not required, provided that all alternative options for flattening the slope have been investigated and aquatic life movement/connectivity has been provided when possible (e.g. rock ladders, cross -vanes, sills, baffles etc.). Please redesign the culvert to incorporate alternative options as referenced above to ensure up and downstream stability and aquatic passage. If alternative options are not feasible, please provide an explanation and redesign the culvert to be placed at -grade. The proposed LOD line shows a stark grade/fill line with no associated retaining wall on the upstream side of the crossing. Please provide detailed documentation and clarification for how this grading proposal will be accomplished without resulting in additional impacts to buffers from fill/grading and/or instability or provide revised site plans and impact tables that clearly depict buffer impacts in these areas and any mitigation information that may be required if impacts exceed the mitigation threshold. Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please respond within 30 calendar days of receipt of this email. Please note that upon review of the above -noted information, additional requests for information could be necessary to complete the Division's review. If all of the requested information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee.
