Please see the final, updated PCN and Impact map exhibits. With the stream and riparian buffer at Impact 2 going
all the way to the western Property Boundary, that increased the riparian buffer impacts and elevated the need for
riparian buffer mitigation. So, Michael Jeska, the project engineer, also had to move the retaining wall on the east
side of the crossing in a few feet, to minimize the riparian buffer impacts and avoid the buffer mitigation. This in
turn resulted in a decrease in wetland impacts and added temporary stream impacts.
Please let me know if you require additional information to continue your review of the application package.

#3: Understood. Yes, all of the proposed buffer impacts are identified and quantified, however if the stream
connects to the P13, then there would likely be temp stream impacts for the coffer dam.
I will request that @michaeljeska@shenandoahhomes.us verify if Impact #2 could be updated to avoid the coffer
dam on the upstream side of the crossing?

Apologies for the delay. I am trying to finalize this 401 WQC, but prior to doing so I need more information: Please
see #3 (1).
#1: Response: S&EC did not do the delineation work or attend the buffer determination site visit for this project, it was
completed by a different consulting firm. I did look up the letter on the Divisions Laserfiche site, and the buffer letter for
this project did not include a USGS map, this seems to be the letter provided by the Division and forwarded to us for use.
• Error on my part when creating the buffer letter back in 2021. No further action is needed from you in
relation to Zach's RFAI Q1.
#3 (1): Response: S&EC did not complete the wetland/stream delineation for this project. The field data was provided to
us and the project engineer. Per the project engineer, the survey conducted by eohler showed the stream start point as
shown below. We would like the Division to please consider meeting at the site to field verify this buffer start point. I do
see your name on the buffer determination letter, do you recall stream start point? Apologies for the delay in questions.
• [Impact area 2] 1 was the staff member who performed the site visit with Spangler Environmental and made
the call that the feature is considered subject throughout the property boundary. There is no need to verify
a start point for Feature A, as it begins at the property boundary. With this information in mind, are all
temporary and permanent buffer impacts included in the updated impact table, for impact area 2?

Thank you for the Divisions review and comments on the subject project and thank you for the extensions previously
granted. Please see our responses to the Divisions comments below in red.
1. The buffer determination letter provided as part of the application appears to be missing the USGS Topo Map
page, possibly due to an upload error. Please provide a copy of the missing page for our application file.
Response: S&EC did not do the delineation work or attend the buffer determination site visit for this project, it
was completed by a different consulting firm. I did lookup the letter on the Divisions Laserfiche site, and the
buffer letter for this project did not include a USGS map, this seems to be the letter provided by the Division and

2. Impact 1 Road Crossing
1. The proposed culvert placement appears mis-aligned with the existing stream channel on the upstream
side and placed in a relatively sinuous section of the stream. Road crossings should be designed to cross
the stream at a perpendicular angle on a relatively straight section to minimize impacts to the extent
possible. Please revise plans such that the culvert better aligns with the stream channel or provide a
detailed justification for why the crossing cannot be relocated or modified.
Response: The culvert has been realigned, see updated Impact map set and PCN.
The retaining walls appear to be installed along the edge of the 50-foot riparian buffer but there are no
impacts proposed to Zone 2, either temporary or permanent, for installation of certain sections of the
wall. Please provide clarification on how the wall will be installed without impacting the riparian buffer
or provide updated plans that include any additional impact totals necessary for the installation of the
full retaining wall.
Response: Additional Zone 2 riparian buffer impacts have been added to the impact map, see updated
Impact map set and PCN.
3. Impact 2 Road Crossing
1. Stream A (SA) that is proposed to be impacted was determined to be subject to the Neuse Riparian
Buffer Rules throughout the project boundary. The current impact maps appear to show a start location
of the stream channel and temporary coffer dam on the upstream side of the culvert. Please provide
clarification on this discrepancy.

2. The culvert placement at this road crossing is proposed as 127.99 LF of 24" RCP @ 7.67% grade buried at
1 foot. We have found that burying steep -sloped pipes creates instability, exacerbates erosion, and can
impede aquatic passage. For structures less than 72" in diameter/width, and topographic constraints
indicate culvert slopes of greater than 2.5%, culvert burial is not required, provided that all alternative
options for flattening the slope have been investigated and aquatic life movement/connectivity has
been provided when possible (e.g. rock ladders, cross -vanes, sills, baffles etc.). Please redesign the
culvert to incorporate alternative options as referenced above to ensure up and downstream stability
and aquatic passage. If alternative options are not feasible, please provide an explanation and redesign
the culvert to be placed at -grade.
Response: Per the project engineer, culvert burial has been removed. Flattening the slope would require
extensive grading and additional riparian buffer impacts. The project engineer is minimizing the riparian
buffer impacts to the maximum extent practicable. The engineer is willing to add measures to the
culvert to assist with aquatic life passage, if needed. We would like the Division to please consider adding
a condition to the anticipated approval letter so that this can be field evaluated by the contractor and
added as necessary.
3. The proposed LOD line shows a stark grade/fill line with no associated retaining wall on the upstream
side of the crossing. Please provide detailed documentation and clarification for how this grading
proposal will be accomplished without resulting in additional impacts to buffers from fill/grading and/or
instability or provide revised site plans and impact tables that clearly depict buffer impacts in these areas
and any mitigation information that may be required if impacts exceed the mitigation threshold.

Yes, as mentioned during our phone conversation, DWR will allow an extension for the engineer to provide a
response to Zach's RFAI, dated 7/19/2024. A full and complete response will need to be submitted to me no later
than October 11, 2024.
If all of the requested information is not received by October 11, 2024, the Division will be unable to approve the
application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the
Division for approval, including a complete application package and the appropriate fee.

It was good to talk with you today. Per your request, I wanted to follow up with you on the authorization of an
additional extension until October 11, 2024.
As discussed, Shenandoah has their own "in house" engineer and that engineer left in June (I think that was the
timeframe). Theythen hired another engineer, and that engineer left a fewweeks in. So nowthey have hired
another new engineer that is building a team and trying to catch up on all of the backlog of work. That said, we do
not have enough information to respond to the Division with a thorough response today and I don't feel
comfortable responding to only a portion of Zach's questions. Please confirm if the Division will allow an
extension until October 11, 2024 to respond to the RFAI dated 7/19/2024.

Shenandoah just recently hired someone to replace Andy Mills (project manager) and the Curtis Gautier (in house
engineer) and I have scheduled a meeting with them next week to discuss the RFAI. That being said, I do not think

I have reviewed the Southerland Mills Project (DWR#20240705) application and I require clarification on the items
below before I can finish my review:

The culvert placement at this road crossing is proposed as 127.99 LF of 24" RCP @ 7.67% grade buried at
1 foot. We have found that burying steep -sloped pipes creates instability, exacerbates erosion, and can
impede aquatic passage. For structures less than 72" in diameter/width, and topographic constraints
indicate culvert slopes of greater than 2.5%, culvert burial is not required, provided that all alternative
options for flattening the slope have been investigated and aquatic life movement/connectivity has
been provided when possible (e.g. rock ladders, cross -vanes, sills, baffles etc.). Please redesign the
culvert to incorporate alternative options as referenced above to ensure up and downstream stability
and aquatic passage. If alternative options are not feasible, please provide an explanation and redesign
the culvert to be placed at -grade.
The proposed LOD line shows a stark grade/fill line with no associated retaining wall on the upstream
side of the crossing. Please provide detailed documentation and clarification for how this grading
proposal will be accomplished without resulting in additional impacts to buffers from fill/grading and/or
instability or provide revised site plans and impact tables that clearly depict buffer impacts in these areas
and any mitigation information that may be required if impacts exceed the mitigation threshold.

Please note that upon review of the above -noted information, additional requests for information could be necessary to
complete the Division's review.
If all of the requested information is not received within 30 calendar days of receipt of this letter, the Division will be
unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate
reapplication to the Division for approval, including a complete application package and the appropriate fee.
