1 have enclosed a set of plans, a PCN application for NWP # 14, and a vicinity map relative to the
proposed bridge replacement project on SR 3442 Waters Cove Road, Buncombe County, NC.
We p�ropose to replace the existing 13' timber bridge with a double pipe arch (2@ 81" x 59") with
low flow arch and sills. SGeam slope at the site is 2.5%. Culvert installation will result in
permanent impact to 45 linear feet of Bill Moore Creek; Floodplain bench construction will
permanently impact an additional 83 linear feet. Temporary impacts to 148 feet of the stream are
necessaiy for dewatering/diversion. The stream is approximately 7 feet wide with predominately
gravel and cobble substrate. Bill Moore Creek is classified as Class C.
Existing channel morphology will be maintained upstream and downstream of the culvert.
Riparian vegetation will be reestablished along disturbed areas associated with the project.
Stormwater will be diverted through grass-lined ditches or vegetated buffers prior to entering
streams.
This project may impact potentially suitable no�thern long-eared bat (Myolrs seplentr�io�talis)
(NLEB) sununer roosting habitat via bridge removal. Therefore, a may affect, not likely to
adversely affect is requested for the NLEB. No U�ee clearing will be performed for the project.
The existing bridge is constructed of timber. The crown to bed measurement (distance from travel
surface to streambed) is 6 feet. Clearance between the bottom of the bridge and lhe stream
surface is approximately 3 feet. A swvey of the bridge did not reveal any evidence of usage by
ba[s.
For the proposed action, NCDOT has committed to the conservation measures listed below:

I) No alterations of a known hibernaculum's entrance or interior environment if it impairs
an essential behavioral pattern, including sheltering Northern long-eared bats (Janua�y 1
through December 31);
2) No tree removal within a 0.25 mile radius of a known hibernacula (Janua�y 1 through
December 31); and
3) No cutting or destroying a known, occupied maternity roost tree, or any other trees within
a I50-foot radius from the known, occupied maternity tree during the period from June I
through and including July 31.
NCDOT has detennined that the proposed action does not require separate consultation on the
grounds that the proposed action is consistent with the final Section 4(d) rule, codified at 50
C.F.R. § 17.40(0) and effective ['eb�va�y 16, 2016. Section 7 responsibilities are therefore
considered fulfilled.
No effect on the remaining Buncombe County list of federally protected species (threatened or
endangered) or designated critical habitat will occur. Andrew Henderson of US Fish and Wildlife
Service is copied on the application for review.
As a pairt of the 401 Certification process, the project was processed through the DOT
Programmatic Agreement for Minor Project as required by Section 106 of the National
Historic Preseivation Act of 1966 and GS 121-12(a). No Historic Resources will be affected.
By copy of this letter, we request Marla Chambers, North Carolina Wildlife Resow•ces
Commission Western Region Coordinator, to eonunent directly to the Corps concerning the
permit request.
E3y copy of this letter, we are asking the Area Roadside Field Operations Engineer, to comment
on the above project Bill Moore Creek is classified as Class C. "1'he project will not require a
trout buffer variance.
By copy of this letter, I am forwarding one electronic copy of the application package to

1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the permit applicant or other affected party
who requested this preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
"pre-construction notification" (PCN), or requests verification for a non-reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization
based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option to request an approved
JD before accepting the terms and conditions of the permit authorization, and

General Project Narrative: This project involves the replacement of Bridge No. 100571 over Bill Moore Creek on SR 3442 (Waters Cove Road) in Buncombe County, NC with a 2@81 "x59" Aluminized
(Description of Minimization of Water CSPA. This bridge replacement and the associated roadway improvements have been designed in a manner that minimizes the increase in impervious surface area. Sills will be
