The proposed Neuse Landings project consists of a single parcel (PIN: 8-216-7004) located at 370 Washington Post Road, New Bern, Craven County (Lat: 35.147182°N;-77.103793°W). NWP 18 PCN Submittal our People. Your Success- The project is in the Neuse River basin (HUC: 03020202) and onsite waters drain to Bachelor Creek. The Water Quality Classification for Bachelor Creek is: Class C; SW,NSW and the Stream Index Number is: 27-98. Proposed Project The purpose of the proposed project is to construct a multi -family residential development (apartments) and associated infrastructure to meet the existing and growing demand for residential rental housing in New Bern and Craven County. The project consists of the construction of the following: • 12 multi -family apartment buildings • Surface parking • 10 parking garages • Clubhouse • Pool house and pool • Construction of infrastructure (roads, utilities, stormwater management, etc.) The proposed design will result in two permanent wetland impacts: an impact to Wetland B for site grading and an impact to Wetland A for an offsite drainage bypass outfall. Additionally, the portion of Wetland B which would not be directly impacted by grading has been assessed as an indirect secondary impact due to the small size (0.004 ac) of the remnant wetland and lack of connection to downstream waters. An additional permanent impact is proposed for SCM grading on Ditch 3 (jurisdictional ditch) from the ditch origin to Wetland A. The offsite stormwater drainage bypass will collect offsite drainage from west of the project and convey it through the site and into Wetland A. No impacts are proposed for lots, amenities or utilities. Protect History WR conducted a delineation of the project site in August 2023 and the site was field verified by the USACE on February 14, 2024. WR submitted a Jurisdictional Determination Request, and an emailed concurrence letter was received from the USACE on February 21, 2024 (SAW-2023-01824). See attached concurrence letter and Approved Delineation exhibit. There are no depicted streams within or adjacent to the project site on the USGS or Craven County Soil Survey, and therefore a formal NCDWR Riparian Buffer Determination was not requested or necessary. On August 23, 2023, WR submitted a SHPO request review for the site. SHPO determined that they were aware of no historic resources which would be affected by the project and have no comment on the project as proposed. A copy of the SHPO letter is attached. Proposed Impacts The proposed project will require the following impacts: • 0.025 ac of permanent wetland impacts • 0.009 ac of temporary wetland impacts Page 2 of 5 Neuse Landings New Bern, Craven Co. A permanent wetland impact of 0.017 acres (Impact W1) is proposed to Wetland B to accommodate site grading, the internal access road and construction of parking areas. Additionally, the portion of Wetland B which would not be directly impacted by grading has been assessed as an indirect secondary impact due to the small size (0.004 ac) of the remnant wetland and lack of connection to downstream waters, resulting in 0.004 acres of secondary impacts (Impact W2). The installation of a rip rap dissipator from an offsite drainage bypass pipe to Wetland A will result in 0.008 acre of permanent wetland impact (Impact W4). Please note that Ditch 3 continues through Wetland A, but was considered part of Wetland A. The riprap is necessary in order to dissipate flow and velocity of the stormwater flowing down the slope and into the ditch within Wetland A to prevent erosion of the slope. 0.009 acres of temporary wetland impact (Impact W3) is also proposed for site access to install this outfall. To meet stormwater requirements, two constructed wetland SCMs are proposed along the entirety of the northeastern side of the development. In order to accommodate SCM 1, it is necessary to impact jurisdictional Ditch 3. SCM 1 will impact jurisdictional Ditch 3 from its origin to its terminus at Wetland A (Impact S1). Impact S1 proposes 162 linear feet (0.03 ac) of jurisdictional ditch impact. SCM 1 will outfall at Wetland A to provide a source of hydrology in absence of the existing ditch. Apart from one temporary impact, access will take place from the uplands. Upon completion of construction, all temporarily impacted wetlands will be restored to natural grade and seeded with a wetland seed mix to provide temporary stabilization until natural revegetation permanently stabilizes these areas. Avoidance and Minimization Prior to site plan design, the applicant requested that a detailed delineation be conducted so that impacts to wetlands and "waters" could be minimized. Proposed permanent impacts for construction of the subdivision and infrastructure have been minimized to only those necessary for site grading for construction of parking an internal access road, construction of the offsite drainage bypass outfall, and construction of SCM 1. There are no impacts proposed for construction of buildings, amenities or utilities. A peripheral internal access road is proposed to circle the site to provide access to the planned multi -family buildings which will be located, with one exception, in the center of the peripheral road. The road is planned to connect to an existing road stub from Hwy 43/Washington Post Road to the west. A second existing stub road is located at the southwest corner of the site where the loop road will make a second connection to allow for two access points to the proposed development. To provide connectivity to the existing stub road for the loop road, it is necessary to partially impact Wetland B for site grading to construct the internal access road. Due to the amount of grading needed and the requirement to connect to an existing stud road it was not possible to avoid Wetland B. It is not possible to create more curve in the road to avoid the wetland due to line -of -sight requirements and a site design that allows the buildings to be located inside the perimeter of the loop road. Due to topography and site drainage, SCMs are proposed to be located on the northeast side of the planned development, which are the lowest in elevation and allow the gravity stormwater Page 3 of 5 Neuse Landings 40 WithefsRavenel New Bern, Craven Co. .. An offsite drainage bypass pipe will outfall to Wetland A resulting in an impact of 0.008 acres. This impact was minimized as much as possible while maintaining the necessary amount of riprap dissipation needed to prevent erosion as stormwater flows over the slope to the low point in the wetlands. The site was designed around Wetland A to the greatest extent practical and jurisdictional ditches 1 and 2 completely avoiding impacts. Ditch 3, however, spans the southeastern corner of the site where SCMs are proposed to be located making avoidance impractical. Hydrology will be maintained to Wetland Athrough SCM 1 outfall, and the offsite drainage bypass outfall mentioned previously. Upon completion of construction, all temporarily impacted areas will be restored to pre - construction conditions and grades, and temporarily stabilized. Access during construction will occur within the uplands except for temporary wetland impact areas W3. Additionally, sediment and erosion control measures will be installed prior to construction. Mitigation The proposed project will result in 0.025 acres of permanent wetland impacts and 0.03 acres of permanent ditch impacts. Because permanent wetland impacts don't exceed the mitigation threshold of 0.1 acres and ditch impacts don't require mitigation, the applicant does not propose mitigation. Stormwater Management Plan The Stormwater Management Plan consists of two constructed wetland SCM's. All engineered SCMs have been designed as a primary SCM per the North Carolina Stormwater Control Measure Credit Document and sized to capture runoff from the first 1.5-inch of rainfall from the corresponding drainage areas to fulfill the minimum of 85% total suspended solids (TSS) removal requirement of the City's "Stormwater Management Manual." The proposed SCMs have been designed to safely pass the 100-year design storm event via the primary and emergency spillways. In addition, the SCMs maintain a freeboard of at least 0.8 ft during a 100-year design storm event. There are no Special Flood Hazard Areas (SFHAs) located on the subject site per the Federal Emergency Management Agency (FEMA) Flood Insurance Rate Maps (FIRM) 3720556100K dated June 19, 2020. The current request is for 0.025 ac of permanent wetland impacts, 0.009 ac of temporary wetland impacts, 0.004 ac of secondary wetland impacts, and 0.03 ac of permanent jurisdictional ditch impacts. We have reviewed the information provided by you concerning the aquatic resources, and by copy of this e- mail, are confirming that the aquatic resources delineation has been verified by the Corps to be a sufficiently accurate and reliable representation of the location and extent of aquatic resources within the identified review area. A query of the NCNHP database indicates that there are records for rare species, important natural communities, natural areas, and/or conservation/managed areas within the proposed project boundary. These results are presented in the attached 'Documented Occurrences' tables and map. The attached 'Potential Occurrences' table summarizes rare species and natural communities that have been documented within a one -mile radius of the property boundary. The proximity of these records suggests that these natural heritage elements may potentially be present in the project area if suitable habitat exists. Tables of natural areas and conservation/managed areas within a one -mile radius of the project area, if any, are also included in this report. If a Federally -listed species is documented within the project area or indicated within a one -mile radius of the project area, the NCNHP recommends contacting the US Fish and Wildlife Service (USFWS) for guidance. For example, if in week 12 there were 20 survey events and the Spotted Towhee was found in 5 of them, the probability of presence of the Spotted Towhee in week 12 is 0.25. 2. To properly present the pattern of presence across the year, the relative probability of presence is calculated. This is the probability of presence divided by the maximum probability of presence across all weeks. For example, imagine the probability of presence in week 20 for the Spotted Towhee is 0.05, and that the probability of presence at week 12 (0.25) is the maximum of any week of the year. The relative probability of presence on week 12 is 0.25/0.25 = 1; at week 20 it is 0.05/0.25 = 0.2. 3. If a bird on your migratory bird species list has a breeding season associated with it, if that bird does occur in your project area, there may be nests present at some point within the timeframe specified. If "Breeds elsewhere" is indicated, then the bird likely does not breed in your project area. What are the levels of concern for migratory birds? Migratory birds delivered through IPaC fall into the following distinct categories of concern: 1. "BCC Rangewide" birds are Birds of Conservation Concern (BCC) that are of concern throughout their range anywhere within the USA (including Hawaii, the Pacific Islands, Puerto Rico, and the Virgin Islands); 2.
