The Wilmington Regional Office received a complete Stormwater Management Permit Application for Jones Ford on June
29,2012. Staff review of the plans and specifications has determined that the project,as proposed,will comply with the
Stormwater Regulations set forth in Title 15A NCAC 2H.1000 and Session Law 2008-211. We are forwarding Permit No.
SW8 911207 dated July 7, 2012,for the construction,operation and maintenance of the BMP's and built-upon areas
associated with the subject project.
On August 5, 2009,the Governor signed Session Law 2009-406.This law impacts any development approval issued by
the Division of Water Quality under Article 21 of Chapter 143 of the General Statutes,which is current and valid at any
point between January 1,2008,and December 31,2010.The law extends the effective period of any stormwater permit
that was set to expire during this time frame up to three(3)years from its current expiration date. On August 2,2010,the
Governor signed Session Law 2010-177,which granted an extra year for an extension of up to four(4)years.
This permit shall be effective from the date of issuance until May 22,2016,which includes all the extensions,and shall be
subject to the conditions and limitations as specified therein. Please pay special attention to the conditions listed in this
permit regarding the Operation and Maintenance of the BMP(s),recordation of deed restrictions,certification of the BMP's,
procedures for changes of ownership,transferring the permit,and renewing the permit. Failure to establish an adequate
system for operation and maintenance of the stormwater management system,to record deed restrictions,to certify the
BMP's,to transfer the permit,or to renew the permit,will result in future compliance problems.
If any parts, requirements,or limitations contained in this permit are unacceptable,you have the right to request an
adjudicatory hearing by filing a written petition with the Office of Administrative Hearings(OAH). The written petition must
conform to Chapter 150B of the North Carolina General Statutes,and must be filed with the OAH within thirty(30)days of
receipt of this permit. You should contact the OAH with all questions regarding the filing fee(if a filing fee is required)

North Carolina as amended, and other applicable Laws, Rules, and Regulations

construction, operation and maintenance of a wet detention pond in compliance with the
provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules') and
the approved stormwater management plans and specifications and other supporting
data as attached and on file with and approved by the Division of Water Quality and
considered a part of this permit. A portion of the stormwater runoff from the site will be
routed to an offsite system operated and maintained by Odell Williamson under the
terms and conditions set forth in the latest version of Permit No. SW8 051042MOD.
This permit shall be effective from the date of issuance until May 22, 2016, and shall be
subject to the following specified conditions and limitations:
AREA SERVED BY AN ON-SITE WET DETENTION POND
I. DESIGN STANDARDS (Wet Detention Pond)
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.6 on page 3 of this permit. The stormwater
control has been designed to handle the runoff from 129,076 square feet of
impervious area.
3. The tract will be limited to the amount of built-upon area indicated on page 3 of
this permit, and per approved plans.
4. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.

5. The runoff from all built-upon area within the permitted drainage area of this
project must be directed into the permitted stormwater control system.

II. SCHEDULE OF COMPLIANCE (Wet Detention Pond)
1. The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built-upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.

3. The permittee shall at all time provide the operation and maintenance necessary
to assure the permitted stormwater system functions at optimum efficiency. The
approved Operation and Maintenance Plan must be followed in its entirety and
maintenance must occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
c. Mowing and re-vegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow
spreader, catch basins and piping.
g. Access to the outlet structure must be available at all times.
4. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.
5. The facilities shall be constructed as shown on the approved plans. This permit
shall become void unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specifications, and other
supporting data.
6. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification. A
modification may be required for those deviations.
7. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
8. Access to the stormwater facilities shall be maintained via appropriate
easements at all times.
9. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built-upon area, details, etc.
b. Project name change.
c. Transfer of ownership.
d. Redesign or addition to the approved amount of built-upon area or to the
drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project
area. The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
10. The permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction.

11. A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction.
12. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
III. GENERAL CONDITIONS (Wet Detention Pond)
1. This permit is not transferable except after notice to and approval by the Director.
In the event of a change of ownership, or a name change, the permittee must
submit a formal permit transfer request to the Division of Water Quality,
accompanied by a completed name/ownership change form, documentation from
the parties involved, and other supporting materials as may be appropriate. The
approval of this request will be considered on its merits and may or may not be
approved. The permittee is responsible for compliance with all permit conditions
until such time as the Division approves the transfer request.
2. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and re-issuance or
termination does not stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
8. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.

IV. DESIGN STANDARDS (Offsite)
1. This permit is effective only with respect to the nature and volume of
stormwater described in the application and other supporting data.

2. The runoff associated with this project has been approved to be discharged into
a stormwater management system permitted under SW8 051042MOD, as
described in Section IV.7 on page 6 of this permit.
3. The built-upon area allotted to this development by Stormwater Management
Permit No. SW8 051042MOD, is 20,859 square feet. This project proposes
15,670 square feet. The amount available for future development is 5,189
square feet.
4. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
5. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
6. The runoff from the permitted built-upon area must be directed into the
permitted stormwater system.

V. SCHEDULE OF COMPLIANCE (Offsite)
1. The offsite stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built-upon surface associated with this project.
2. During construction, erosion shall be kept to a minimum and any eroded areas
of the system will be repaired immediately.
3. The permittee is responsible for keeping the stormwater collection system on
the lot clear of debris, and keeping the site stabilized in accordance with the
requirements of the NC Erosion and Sediment Control Design Manual.
4. Odell Williamson, shall, at all times, provide the operation and maintenance
necessary to assure the permitted stormwater management system functions at
optimum efficiency. The approved Operation and Maintenance Plan must be
followed in its entirety and maintenance must occur at the scheduled intervals
including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
c. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch
basins and piping.
g. Access to the outlet structure must be available at all times.
5. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
c. Transfer of ownership.
d. Redesign or addition to the maximum approved amount of built-upon area.
e. Further subdivision, acquisition or selling of the project area. The project
area is defined as all property owned by the permittee, for which
Sedimentation and Erosion Control Plan approval or a CAMA Major permit
was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
6. The Director may determine that other revisions to the project should require a
modification to the permit.
7. A plan revision with layout and grading plans must be submitted to and
approved by the Division prior to the construction of any future development
areas on the lot.
8. Odell Williamson, must keep records of maintenance activities and make them
available upon request to authorized personnel of DWQ. The records will
indicate the date, activity, name of person performing the work and what
actions were taken.

9. This permit shall be voided unless the facilities are constructed in accordance
with the conditions of this permit, the approved plans and specifications, and
other supporting data.
10. Odell Williamson, is responsible for providing, prior to issuance of a Certificate
of Occupancy, and prior to operation of the permitted stormwater management
facility, a certification from an appropriate designer for the system installed,
certifying that the permitted facility has been installed in accordance with
Stormwater Permit No. SW8 051042MOD, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification.
11. A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction.
12. This lot is limited to the amount of built-upon area indicated in the supporting
calculations and per the approved plans. The project must have a built-upon
area less than or equal to the amount permitted under Stormwater Permit No.
SW8 051042MOD. A total built-upon area in excess of the maximum amount
allowed by SW8 051042MOD will require a modification to the overall Permit.
13. Odell Williamson, must record any deed restrictions as required by their permit,
and they must verify that the proposed built-upon area does not exceed the
allowable built-upon area. Once the lot transfer is complete, the built-upon area
may not be revised without approval from the permittee, and responsibility for
meeting the built-upon area limit is transferred to the individual property owner.
14. The drainage features shown as a part of the stormwater management system
on the approved plan shall not be filled in, altered, or piped by any party without
first submitting a revision to the permit and receiving approval from the Division.
15. The Director may notify the permittee when the permitted site does not meet
one or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.

responsible for compliance with all terms and conditions of this permit until such
time as the Director approves the permit transfer.

subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.

runoff drains to the system.

Thank you for the assistance you have provided to our firm regarding the subject permit modification. In
response to your March 6,2012 comments,we offer the following:

1. Our site meeting last week allowed you to verify that the stormwater runoff currently collected in this
catch basin will drain overland and be collected in the stormwater pond.
2. Enclosed are copies of the Wet Detention Basin(Stormwater Pond) Calculations for both the previous
2008 permit modification and for the current permit modification request. These calculation sheets
show that the runoff from the small amount of additional BUA that will be directed to the stormwater
pond due to the removal of this catch basin would only require an additional amount of stormwater
storage of 0.01' (i.e.the pond outlet orifice raised by 0.01'). We respectfully request that the orifice be
allowed to remain"as-is"since the additional required stormwater pond storage is so small.
3. The requested basic dimensions for the additional drainage area being redirected to the stormwater
pond have been labeled on the enclosed revised plan sheet.
In regards to the six items observed during recent site inspections and file review,please coordinate those
items directly with Mr. Gene Marshburn as we have no involvement in those issues.
Enclosed are two copies each of the revised plan sheet and revised stormwater calculations.

Dear Mr. Marshburn:
On April 4, 2012, Chris Baker of the Wilmington Regional Office inspected Jones Ford in
Brunswick County to determine the status of compliance with Stormwater Management Permit
Number SW8 911207 issued 1992 and being modified several times, the last being April 25,
2008. DWQ file review and site inspection revealed that the site is not in compliance with the
terms and conditions of this permit. Please find a copy of the completed form entitled
"Compliance Inspection Report" attached to this letter, which summarizes the findings of the
recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. Failure to Maintain the Stormwater System.
Per Section Il. SCHEDULE OF COMPLIANCE of the permit, the Permittee shall provide the
operation and maintenance necessary to assure the permitted stormwater system functions
at optimum efficiency. Per inspection it was observed that:
1) A number of large trees have grown along the pond dike along the back side of
the stormwater pond
2) The outlet structure is inaccessible due to overgrown trees and shrubs.
3) Several trees have fallen into the swormwater pond.
4) Sediment accumulation in the pond has exceeded maximum allowable buildup.
5) A pipe has been installed in the pond dike on the backside of the pond near US
17 and bypassed the pond outlet structure.
As also stated in the permit, the approved Operation and Maintenance Plan must be
followed in its entirety and maintenance must occur at the scheduled intervals, including,
but not limited to:
• Routine monthly inspections;
• Sediment Removal;
• Mowing and re-vegetation of side slopes;
• Immediate repair of eroded areas;
• Maintenance of side slopes in accordance with the approved plans and
specifications;
• Debris removal and unclogging of the outlet structure, orifice device and catch
basins and piping;

2. Failure to certify the stormwater system.
An administrative review of the file revealed that this Office has not received the Designer's
Certification.
Per Section 11.8 SCHEDULE OF COMPLIANCE of the Permit, upon completion of
construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this
permitted facility, a certification must be received from an appropriate designer for the
system installed certifying that the permitted facility has been installed in accordance with
this permit, the approved plans and specifications, and other supporting documentation.
Any deviations from the approved plans and specifications must be noted on the
Certification
Please inform this Office in writing on or before June 26, 2012, of the specific actions that will be
undertaken and the time frame that will be required to correct the deficiencies. Failure to provide
the requested information, or to respond to this letter by the due date, may initiate enforcement
action including the assessment of civil penalties of up to $25,000 per day. If a written plan of
action is not submitted to this office by June 26, 2012 then DWQ staff will re-inspect the site and
issue a Notice of Violation if the listed deficiencies have not been addressed.

The Wilmington Regional Office received a Stormwater Management Permit Application for
Jones Ford on December 23, 2011. A preliminary review of that information has determined
that the application is not complete. Comments were sent out on March 6, 2012 however the
comments and inspection report (preformed March 2, 2012 and followed up on April 4, 2012)
were returned via "Return to Sender" due to an incorrect address. The following information is
needed to continue the stormwater review:
1. If the existing catch basin nearest US 17 is to be abandoned the contours provided indicate
that the stormwater runoff currently collected in this catch basin will drain offsite without
collection and treatment. Please show how the stormwater runoff will flow overland and be
collected in the stormwater pond.
2. The cover letter submitted with the permit modification states "There is sufficient capacity in
the Jones Ford pond to accept the additional runoff'. The sufficient capacity must be
demonstrated by submitting the stormwater pond supplemental form, please submit.
3. Please provide basic dimensions for the additional drainage area being redirected to the
Jones Ford stormwater pond.
4. Please correct the address provided on the application.
5. Prior to the approval of the stormwater permit modification the deficiencies to the permitted
stormwater pond must be corrected. Please refer to the"Notice of Deficiencies" letter and
the inspection report enclosed for the issues with the stormwater pond that must be
addressed.
The requested information should be received by this Office prior to June 26, 2012. If you need
additional time to submit the information, please mail or fax your request for a time extension to
the Division at the address and fax number at the bottom of this letter. The request must
indicate the date by which you expect to submit the required information.
Please include the appropriate documentation as checked above with your permit renewal
request and processing fee. Please reference the State assigned permit number on all
correspondence. Any original documents that need to be revised are enclosed. All original
documents must be returned or new originals must be provided. Copies are not acceptable.

On March 2, 2012, Chris Baker of the Wilmington Regional Office of the Division of Water
Quality (DWQ) reviewed a stormwater permit request and inspected Jones Ford in Brunswick
County to determine compliance with Stormwater Management Permit Number SW8 911207
issued on April 25, 2008. THE stormwater permit review and site inspection revealed
deficiencies in the permit modification application/plans and inspection observations revealed
that the site is not compliant with the terms and conditions of the current permit. Please find a
copy of the completed form entitled "Compliance Inspection Report"attached to this letter.
Additional information requests for the stormwater permit modification application are as follows:
1. If the existing catch basin nearest US 17 is to be abandoned the contours provided indicate
that the stormwater runoff currently collected in this catch basin will drain offsite without
collection and treatment. Please show how the stormwater runoff will flow overland and be
collected in the stormwater pond.
2. The cover letter submitted with the permit modification states "There is sufficient capacity in

The following items were observed during the inspection and file review and must be corrected
in order to bring the pond into compliance:
1. Designer's Certification. This office has not received a Designer's Certification for the
Stormwater Management System associated with your facility. Systems that are certified on
or after the date of this letter will need to have the original signature of the certifying person.
See form attached.
2. The sedimentation buildup in the bottom of the pond exceeds the allowable buildup of one
(1)foot. The excess sedimentation must be removed and the bottom of the pond design
elevation must be restored.

3. Several downed trees have fallen into the pond. Please remove the trees from the pond.
4. Remove excess vegetation in the proximity of the outlet structure so as to allow access and
inspection.
5. Numerous trees have grown up along the dike side of the stormwater pond. Only turf type
vegetation is allowed on pond slopes. Please remove the tree overgrowth and establish turf
vegetation on the dike side of the pond.
6. An outlet pipe was observed in the dike section of the pond near US 17 allowing stormwater
to bypass the outlet structure. The pipe must be removed and the dike repaired to the
original design elevation.
The requested information should be received by this Office prior to April 7, 2012. If you need
additional time to submit the information, please mail or fax your request for a time extension to
the Division at the address and fax number at the bottom of this letter. The request must

indicated catch basin will be abandoned and the pipe plugged to prevent water from the upstream catch
basin from entering. The associated runoff will be allowed to follow the natural drainage course and enter
the existing stormwater treatment pond located on the west side of the Jones Ford property. As discussed
in your office,the purpose for abandoning the catch basin is to prevent water from over topping the catch
basin during heavy rain events. The rim of the catch basin is below the overflow elevation of the Coastal
Horizons stormwater treatment pond. There is sufficient capacity in the Jones Ford pond to accept the
additional runoff.

Dear Mr.Marshbum:
The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW8 911207 to Baden Investments
for a High Density project onMay 22,2002,with a modification issued on April 25,2008.This permit expires on May 22,2012.
Per 15A NCAC 2H.1003(h) (the stormwater rules),applications for permit renewals shall be submitted 180 days prior to the
expiration of a permit and must be accompanied by a processing fee,which is currently set at$505.00. If this is still an active
project please complete and submit the enclosed renewal application prior to November 22,2011. If this project has not been
constructed and a permit is no longer needed, please submit a request to have the permit rescinded. If you have sold the project
please provide the name, mailing address and phone number of the person or entity that is now responsible for this permit.
Enclosed is a form for change of ownership,which should be completed and submitted if the property has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted stormwater treatment system,
a certification of completion be submitted to the Division from an appropriate designer for the type of system installed.This is to
certify that the permitted facility has been installed in accordance with the permit,the approved plans,specifications and
supporting documentation. If you have not already provided a Designer's Certification to our office, please include a copy with
your permit renewal request and processing fee.A copy of the certification form is enclosed for your convenience.
You should be aware that failure to provide the Designer's Certification and the operation of a stormwater treatment facility
without a valid permit,are violations of NC General Statute 143-215.1 and may result in appropriate enforcement action
including the assessment of civil penalties of up to$10,000 per day.
