Dear Mr. Ross,
Division of Water Resources’ Central and Regional staff have reviewed the application package
received on May 30, 2024. However, the Division requires additional information before completing our
review. Please address the items on the attached pages no later than the close of business on September 18,
2024.
Please be aware that the Applicant is responsible for meeting all requirements set forth in North
Carolina rules and regulations. The Applicant is also responsible for any oversights that occur during the
review of the subject application package. The Division may return the application as incomplete pursuant
to 15A NCAC 02T .0107(e)(2) if any omissions are made when responding to the outstanding items in
Sections A through N or the Applicant fails to provide the additional information on or before the above-
requested date.
Please reference the subject application number when providing the requested information. The
Applicant shall sign, seal, and date (where applicable) all revised and/or additional documentation and
submit an electronic response to my attention via the Non-Discharge online portal.

A. Overall:
1. Pursuant to 15A NCAC 02T .0606(a), the Applicant shall maintain for drip irrigation sites: (1) a
minimum 50 foot setback to each property line and (2) a minimum 100 foot setback to each
habitable residence under separate ownership. Pursuant to 15A NCAC 02T .0606(b), the Applicant
shall maintain for treatment and storage units: (1) a minimum 50 foot setback to each property line
and (2) a minimum 100 foot setback to each habitable residence under separate ownership.
Currently, Pea Ridge Developers, LLC, owns the parent Parcel No. 0018070 that Chatham County
will subdivide for Firefly Overlook. Based on the Chatham County GIS and the submitted
application package, Lot 24 SFR (Future Parcel No. 0096761) will not meet the setback
requirements listed above for the adjacent Lot 23 (Future Parcel No. 0096760) when the Applicant
sells the properties to the future homeowners.
While setback waivers are not required at this time, the Division strongly recommends that the
Applicant obtain all setback waivers pursuant to 15A NCAC 02T .0606(c) in their name based on
the proposed subdivision layout to avoid inconvenience for future homeowners. Otherwise, the
Division will issue this permit for construction only until we receive all recorded setback waivers.

G. Soil Evaluation:
1. Ms. Dorothy Robson of the Raleigh Regional Office (RRO) conducted a site visit on June 17, 2024,
reviewed the submitted application package, and provided the following comments:
a. The soil borings provided for the proposed facility do not match t he soils located at the site.
Ms. Robson encountered partially weathered bedrock (PWR) refusal between 10 to 14 inches
with no substantial clay layer observed, as denoted in the soil borings. Please include on the
soil boring logs where the Applicant encountered PWR and update to match the soils/PWR
observed at the site.
b. Does the Applicant need to add fill due to the depth of PWR? Please explain why the proposed
drip irrigation areas do not require fill.
H. Engineering Plans:

a. Please remove the stray property line at the top left corner of the Lot 23 drip irrigation site.
b. Please remove the smaller text box cut off above the Lot 23 drip irrigation site for clarity.
