The Division of Energy, Mineral and Land Resources received and accepted a State Stormwater Management
Permit Application for the subject project on August 24, 2023, and requested additional information on
November 15, 2023, and May 21, 2024. A review of the file and delivery logs indicates that, as of this date,the
information requested on November 15, 2023, and May 21, 2024, has not been received in this Office or been
satisfactorily addressed within the stipulated timeframe. Per the requirements of Title 15A NCAC 02H
.1042(3)(a)(ii)of the Stormwater Management Rules,this Office is hereby returning the subject application as
incomplete.The application fee has been forfeited and a new fee will need to be provided if you choose to
resubmit this application in the future.

the Standard permitting process can take up to 90 calendar days to complete. You can see where this project stands in
the review queue by emailing Jim Farkas (He has an autoreply set up that has the review queue on it). Please upload all
documents that you mailed into our office through the link provided below. Be sure to choose the Central Office as the
Primary Contact office.

CONSTRUCTION FILE UPLOAD"TO ADD ADDITIONAL FILE TYPES TO THE SUBMISSION. Merely changing the file type

The Deed Restriction is only binding once recorded with the register of Deeds and our rules stipulate that the deed
restrictions be recorded prior to a CO being issued (15A NCAC 02H .1003(7)). In theory, it could be recorded before
construction begins, but this is not required.
If at some point in the future, it is decided that the project will not be constructed, you can always decide not to record
the deed restrictions and rescind your permit(more info on this page: https://www.deg.nc.gov/about/divisions/energy-
mi neral-and-land-resources/stormwater/stormwater-program/post-construction-program).

The client is under the impression that the Deed Restriction form may be binding if the project is not constructed. I
informed him that it is only binding if the project is constructed. If any approved plans are not utilized, then the Deed
Restriction will never be recorded or enforced. Do you agree?
We are waiting for the client's attorney(who was on vacation for two to three weeks)to return and confirm this.
I don't have a signed Deed Restriction form. I should hopefully get it this week.
I did correct everything else and would be willing to send those to you.

Thanks for the feedback.
I used a website to convert decimal coordinates which I obtained from Google Maps. Apparently, it didn't convert
well. I double checked these values in Google Map:

Regarding the Density Calculation in Section IV, 8:
When the total (sf) of impervious surface area is divided by the total project area (and multiply it by 100%), it
does not yield in 20.75%.

These are required for administrative completeness, we will record the SW permit number on our end once it is

Section IV, 8: The BUA%for the entire site was correct. I'm not sure why you reported it as wrong. I've also attached
our project BUA chart.
Please confirm the updated Section IV, 10 chart is correct. For the "% Impervious Area** (total)" (circled in red in the
image below), I reported the BUA in the SCM drainage area/the SCM drainage area. I added the offsite area to the off-
site BUA value. Please confirm the chart and Section IV,8 are correct.

You also requested the Deed restriction. I was under the impression that would be submitted later. I wasn't assigned a
State Stormwater Management Permit Number that I know of. Are you able to let me know if this project has been
assigned one yet?

Good Afternoon,
We received your application for a new post-construction stormwater permit on 7/27/23. At this time, the submission is
not administratively complete and cannot be accepted for review in its current condition. Please provide the following
submittal items within 30 calendar days (by close of business on 8/26/23) so that we may accept the project and begin
the review process, otherwise, the project will be returned as administratively incomplete.
• 2x hard copies of the Application with the following corrections made (These items are required per 15A NCAC
02H .1042(2)(a) and per Section VI, 1 of the Application):
• Section 1, 4-The coordinates listed on the Application do not match the physical address provided.
Please revise the coordinates.This is required per 15A NCAC 02H .1042(2)(d).
• Section 11, 2—Please specify the type of project relevant to this application and its density.This item is
required per 15A NCAC 02H .1042(2)(a)(iv). NOTE: On the application, it is indicated as Low Density, but
on the O&M, EZ, and Plans, it is noted to be high density. Please either revise the application or revise
the other forms so that they are consistent.
• Section 11, 4a—Please indicate the applicable other permits that are required for this project. It appears
a Erosion and Sediment Control permit will be required for this project.
• Section 11, 5—This project does appear to be located within 5 miles of a commercial airport. Please refer
to this map (https://www.ncdot.gov/divisions/aviation/Pages/nc-airports.aspx). Please provide the
airport information (name & location).

• Section IV, 8—The percent impervious area for the project area does not appear to be calculated
correctly. Project density calculation information can be found in 15A NCAC 02H .1003(1).
• Section IV, 10& 11—Per 15A NCAC 02H .1003(3)(b) any off-site drainage area not bypassed around an
SCM must be accounted for at its full build-out potential.This can be accomplished by having the
property owners enter into a legal agreement limiting the amount of BUA and drainage area that can be
directed from the off-site area to the SCM or by accounting for the off-site area as 100% BUA(its full
build-out potential). Please either bypass the off-site component of the drainage area around the SCM
or account for the off-site portion of the drainage area at its full build-out potential.
• 2x hard copies (one original) of the deed restriction document(This item is required per 15A NCAC 02H .1003(7),
15A NCAC 02H .1042(2)(k), and Sections VI, 2 &VII). More information can be found on our

NOTE:This is an administrative completeness review, not a detailed engineering review, there may be other issues that
may be brough up during the engineering review.
If these items are received within the stipulated timeframe, we can accept the project and begin the review process.
Once accepted, reviews under the standard permitting process can take up to 90 calendar days per statute (one of our
two reviewer positions is currently vacant).
