Please find the responses to your letter dated August 21, 2024. Your original comments are followed by
the applicant's responses. Thank you for your continued assistance with this project.
1. On July 31, 2024, the US Army Corps of Engineers (USACE) requested additional information on
the project. Many of the items requested by the USACE are relevant to the Division's review,
therefore please copy the Division when you respond to the USDACE's request.

Previous Item #3 from the Division's May 13, 2024, Request for Additional Information (RAI)
stated: "The level of detail provided in the permit drawings is insufficient for the Division to
conduct a thorough review of the impacts. Please provide plan sheets that clearly indicate the
proposed -grading limits of all proposed activities. Overall impact maps are provided for
Recreational Trails and for Utilities. However, no overall impact plans clearly show proposed
roadway impact areas. Please provide overall impact maps that clearly show and identify all
proposed impacts." And previous Item #14 noted that it appeared development fill is proposed
within the project. The response provided on June 30, 2024, included updated plans and a
statement that conceptual "Iinework" has been modified to show no grading is proposed over
streams or wetlands except for road crossings, however the updated plans and utility drawings
provided on June 25, 2024, show areas of lot fill that are not accounted for within the application.
The images below show two examples of locations where lot fill impacts are shown but have not
been accounted for in the application. The Division identified similar locations of concerns at
W18, W19, P7. W33, the wetlands along T20, T34, W43 and W8. In addition, at some locations
within the project the plan sheets show conceptual "Iinework" up to the edge of a wetland feature
and it is unclear whether the Iinework incorporates proposed grading/fill limits and/or space for
necessary sediment and erosion control measures. (Pictures not included in this response)
Across all exhibits, areas that show Iinework up to the edge of a wetland feature but are not noted
as wetland impacts have disturbance limits inside the lot area. Grading outside of the lot will not
be required for development. The specific areas noted have been addressed as follows:
• Lot 35 on Owl's Trail is no longer part of the development, and no impacts will occur in
this location. See updated Exhibit 8. There was no impact proposed here in the original
submittal documents so there is no change to impact areas being requested.

• Lots located on stream below impact T3 have been removed and replaced with
stormwater BMP. See Exhibit 3B.
• W18: As noted above, grading in this location will be limited to within the lot boundaries.
See Exhibit 3E
• W19 (3F): Lot dimensions have been adjusted to remove the lot from the wetland
location. Grading will be limited to within the lot boundaries
• P7: P7 is a listed non jurisdictional area in the approved PJD
• W33: This will be an impact of 0.02 ac. It was shaded on the exhibit but was not noted in
the table of impacts. Has now been added to the table of impacts. See exhibit 3H
• Wetlands below T20: Concept plan has been adjusted to removed lots from wetland
areas. There will be no proposed impacts here. There were no proposed impacts here in
the original submittal, so the overall impact area requested has not changed. See Exhibit
3K
• T34: Impact on T34 is fully shown and listed in table. See Exhibit 3C
• W43: Concept plan has been adjusted to removed portions of lots that were located on
wetlands. Grading limits will be inside of lot locations. See Exhibit 3N
• W8: This wetland will be fully impacted. This is shown on the exhibit and listed in table.
See Exhibit 3C
3. Exhibit 5 is insufficient to clearly show what impacts are proposed. On plan sheet 3C, Impacts
T34, T34A and W2 are shown, however Exhibit 5 does not identify the extent and location of
these impacts. From Plan Sheet 3C it appears that impact T34 is for development fill.
The impacts noted on Exhibit 3C have been added to Exhibit 5. The impact at T34 is caused by
the fill associated with the roadway crossing, not general development fill.
Exhibit 6 shows that the inlet of the culverts are located within the wetland boundary and not
within the stream, however the area of riprap at the inlet is not identified as wetland impacts. The
Division believes that the proposed location of the culvert inlet will cause the stream to reroute
into the wetland to access the culvert and results in an additional indirect impact to the wetland.
Please realign the culvert inlet so that it is in line with the stream channel above the road and
update the plans and impact tables to include impacts to the stream in this location.
Culvert inlet has been relocated to line up with the existing stream.
The updated detail for utility crossings within wetlands shows a trench and stockpiles on either
side of the trench. The detail does not appear to provide sufficient area for equipment movement.
Please ensure that the detail provides sufficient direction for contractors when installing utilities
within wetland areas.
The typical detail for wetland crossings has been updated to show additional space for equipment
movement as well as notes for soil stockpiling and construction sequencing.
The typical utility stream crossing detail indicates sediment logs across the stream channel at
either side of the proposed trench. The Division is unaware that sediment logs are an approved
"dewatering" method. In addition, the detail does not indicate that water within the work area will
be pumped out through appropriate sediment control measures (typically a silt bag or into a
basin). Please ensure that this detail includes sufficient accurate information such that the project
will maintain compliance with a future 401 and state water quality standards.
Exhibit 11A has been updated with notes to provide proper dewatering
7. The Division previously requested a stream restoration detail for temporary stream impacts. The
issue has not adequately been addressed in the updated information provided on June 30, 2024.

As previously stated, "a note to restore the stream to original conditions on the typical utility
crossing detail is insufficient to ensure compliance with water quality standards." Please provide a
restoration detail that includes instructions and plan sheets for the contractor on how to restore
the channel to the appropriate width, depth, and side slopes and includes specific planting
instructions.
Exhibit 11A has been updated with additional notes related to restoration of channel depth, width,
and slopes as well as planting instructions.
In response to the Division's previous question #12 about the purpose of crossing T1, you have
stated that "The impact... is for a road crossing to access the upland area... ". To document that
maximum avoidance and minimization has been conducted for the entire project, please provide
explanation of what is proposed within this upland and why it is essential for the success of the
project. If the response is related to project viability, please provide specific financial information
to support the response.
Impact T1 has been removed. The concept plan has been adjusted and this crossing is no longer
needed for intended land use. See Exhibit 3A. This has removed 30 LF and 120 SF of stream
impact that was proposed in the original impact area.
In response to the Division's previous question #17 the response states that "the impact is for
road construction access to the area to the east". Please explain the purpose of this impact as the
area to the East does not appear to be part of the proposed project or part of an overall municipal
transportation plan.
This crossing is required to access PA-106, the area located on Exhibits 3N and 3P, from Teague
Lane. This is required by Town ordinance.
10. In response to the Division's previous question #19 it is stated that "SCMs will be located and
designed to keep watersheds and drainage paths intact to the maximum extent possible. In some
locations it may be unavoidable that smaller sub -watersheds drainage areas are adjusted by the
development..." This answer is insufficient to allow the Division to document that the project
meets criteria set forth in 15A NCAC 02H .0506(b), specifically that the project will not cause or
contribute to a violation of water quality standards from indirect impacts. The Division has
identified the following features/locations where it appears indirect impacts will occur below W1,
multiple small tributaries and wetland along T5 below impact T3, W31, T10/W12/W18 and
associated area, T11, T16. Indirect impacts to these features would cause a violation of water
quality standards unless they are sufficiently addressed through project redesign or incorporated
into the project impacts.
The overall conceptual stormwater management for the site has been adjusted to eliminate
indirect impacts to wetlands and stream. The following specific changes have been made:
• T5: SCM's will be installed upstream of the wetland and small tributaries below impact T3
to maintain flow to these locations. See Exhibit 3B.
• W31: Proposed SCM will be located near townhome portion of development and will
maintain flow to W31. See exhibit 3G
• T10: Proposed SCM will be in this area and will maintain flow to T10, W12, W13, W14,
W18. See exhibit 3E/3F
• T11: Flow from Teague Lane is proposed to be collected at this intersection and piped to
the area just upstream of T11. This will maintain flow to T11 and W15. See Exhibit 3F

T16: The current drainage to T16 is a small valley. The proposed lot layout follows these
natural ridges and valleys and will surface flow to T16 from backyards and greenspace
(Provide existing contours, overall site
plan). See Exhibit 3H and screen cap
below of existing drainage area.
The revisions noted in this document have, in total, created a reduction of 30 LF of stream (120 SF)
resulting from the elimination of Impact T1 on Exhibit 3A and .01 acres of open water impacts reduction
from adjustments to the Surface Water Impact on Exhibit 3C.

0 695 LF of perennial / high intermittent 2:1 mitigation proposed (1,390 LF)
0 40 LF of medium intermittent 1.5:1 mitigation proposed (105 LF)
