Dear Mr. Surles:
On July 10, 2024, I, Melissa Joyner from the Fayetteville Regional Office of the Division of Energy,
Mineral and Land Resources (DEMLR), conducted a Compliance Evaluation Inspection at the Avery
Pond Subdivision Phase 1 and 2 Development off of Chalybeate Road, in Harnett County, North Carolina.
The purpose of the inspection was to ensure compliance with State Stormwater Management Permit
SW6150903 prior to the transfer of this permit to the Avery Pond Homeowner's Association. This permit
was originally issued on October 28, 2015 with an approved minor modification issued on October 15,
2018. A copy of the Compliance Inspection Report is enclosed for your review. As a result of the
inspection and subsequent file review, it has been determined that the facility is compliant with the
conditions of the subject permit and approved plans.

Inspection Summary:
This inspection was conducted to determine compliance with the State Stormwater Management Permit
SW6150903 prior to the transfer of this permit to the Avery Pond Homeowner's Association. This permit was
originally isued on October 28, 2015 with an approved minor modification on August 15, 2018. Vegetated
conveyance swales have been constructed and maintained in accordance with the low density permit and
approved plans. The associated built-upon area (BUA) appears to be constructed per the conditions of the
permit.
