On behalf of the property owner, The Community Builders, we request an appeal of the buffer
determination performed by Ms. Lia Myott for the Goley Homes Re-development Site. Ms. Myott
reviewed the site on January 7, 2008, and determined feature "A" to be subject to the Neuse Buffer Rule
(see attached maps). S&EC was contacted afterward to review the determination and provide
recommendations regarding the buffer determination and provide stream buffer rules consultation. Upon
review of the site, we believe this feature sufficiently lacks the required indicators to merit further review
through the appeal process. Moreover, the client intends to pursue a Major Variance should the buffer
determination be upheld; so, we believe the appeal process should be exhausted before moving forward
with a variance request. If, during the course of the appeal, the stream buffer determination is upheld,
S&EC would like to take time during the site meeting to discuss buffer variance alternatives and possible
off-site mitigation options. In summary, we request a re-evaluation of Ms. Myott's analysis. Please
accept this letter as an official request. Your help in clarifying the status of the application of the Neuse
Buffer Rules to this feature is greatly appreciated.
