Please request revisions from Timmons for the crossing between the pond and wetland with the following in mind: -This is not a buffered basin -There is an existing road crossing I believe. This road should be on the plans and noted as existing. If the applicant plans to improve (widen the existing road) the existing footprint should be removed from the proposed impacts. -The applicant can’t work within the mitigation conservation easement but there is a small amount of wetland outside the easement on the downstream side that might be impacted and should be quantified. Additionally, during our meeting tomorrow I’ll verify the aquatic resource boundaries. Pending any changes we might make tomorrow I need a few more items for the JD: The delineation figures (a-g) you sent today show impacts not consistent with the Timmons plans. Either remove the proposed impacts from the delineation or revise them to be consistent. I’ve attached your PJD form with the aquatic resources listed. Please put them in the attached spreadsheet for upload into our system. Thanks Adam. Page 7 of 7 carries the signature of Samuel Adam Carter. In order for Samuel Adam Carter to sign, the application package requires an agent authorization letter from the applicant. A sample agent authorization has been attached to this email for your convenience. [15A NCAC 02H .0502(a)(11)] See attached 2. A complete review of the project cannot be conducted until the U.S. Army Corps of Engineers has verified all stream and wetland locations for the impacts are detailed in the PCN table. If the U.S. Army Corps of Engineers requests a response to any comments received as a result of the Public Notice, please provide the Division with a copy of your response to the USACE. Please provide an impact map, enumerate all wetlands, and stream impacts including fill slopes/ dissipater pads/ other… on the site plan and clearly label impacts (Wetland/ Stream Impact 1, etc.). You stated in the PCN application that the project consisted of a road widening; however, on the wetland impact table, impact W11 consists of 0.022 acres of fill for a home foundation. This impact triggers the requirement for mitigation to be paid. We have minimized and avoided impacts to the North of the project area. Only two impacts proposed. One at the pond for road crossing and one impact at the cul_da_sac. See current site plan and profile. 7. Please provide more details regarding avoidance and minimization of wetland impact W11 (Home Foundation) for this project. [15A NCAC 02H .0506]. Please eliminate the 0.022 acres if fill for the home foundation or provide additional information as to why it is necessary for this project. Developer is no longer pursuing impact for individual lots. See attached current site plan and profile.
