Scott,
Town staff and Labella staff met with Graham/Parish of DEQ to see what steps are needed to close out the NCG01
stormwater permit for this address. Graham reiterated that the permit must be closed out per the DEQ
requirements before it could be transferred to the current property owner, as he describes in his 8/22/24 email
below.
Another option would be for your group as the permit holder to complete the necessary stabilization to get a final
inspection approved and the permit closed.The needed punch list items have been identified by Steve in his last
inspection report, attached with supporting photos.The primary needs are removing the silt fence, overseeding
bare areas to establish vegetation, and removal of construction debris.

Good morning Scott,
If the Erosion Control Approval from the Town is for Empire as the Financially Responsible Party(FRP)you would
need to transfer the approval to the homeowner.The Town would need a new Financially Responsible Ownership
Form (FRO)and/or a new Erosion and Sediment Control Compliance Form.These would need to be signed and
notarized by the new FRP.The Town would then need to approve this transfer.You would remain the responsible
party until a new form has been approved.

For the NCG01 There is no formal"transfer"option currently in place. In order to "Transfer"the NCG01 permit,
essentially a new NCG01 must be obtained and then you can terminate the existing one.You would first need to
have the transfer of the ESC permit/plan approval completed.Then the new Financially Responsible Party would
then need to submit a new electronic Notice of Intent.You would then need to submit a notice of termination to
close your NCG01 out. Please note that you cannot terminate the current NCG01 until a new NCG01 has been
obtained for the project,there cannot be a lapse in coverage.
If you have any questions about the transfer process of the ESC portion please coordinate with the Town. If you or
the new homeowner has questions regarding the NCG01 process or the requirements that would need to be
fulfilled until the project is complete,feel free to direct them to Kieu Tran copied above and myself.
