The purpose of this visit was to ensure compliance with the subject NPDES facility. During the inspection, the presence and cooperation of John Abbott, Operator in Responsible Charge (ORC), was greatly appreciated. The plant has a Discharging 100% Domestic <1MGD permit. This NPDES compliance evaluation inspection consisted of the following:  Review of the NPDES permit.  Review of the owner/facility information.  Review of March 2021 – March 2024 monitoring data.  Review of March 2021 – March 2024 compliance history.  On-site inspection of the treatment systems; and  On-site inspection of discharge outfall Docusign Envelope ID: 05D2B548-531D-4F66-8C1B-775EE9568B36 Page 2 of 3 Hibernia Recreation Area Compliance Inspection 2024 2 Findings during the pre-inspection file review were: 1. Through NPDES permit NC0089583, Hibernia Recreation Area. is authorized to discharge treated wastewater to a unnamed tributary to Nutbrush Creek/Kerr Lake classified B waters in the Neuse River Basin. The current NPDES permit expired on March 31st, 2022. An application for renewal of this permit does not appear to have been submitted. 2. For the review period July 20219 – July 2024, three (3) violations were found for Ammonia level exceedances. Two (2) civil penalties have been issued for these violations. 3. In speaking with John Abbot prior to the inspection, he indicated that the permitted treatment system is no longer being used and that a subsurface system was installed to take its place. He also indicated that he was in the process of trying to get this permit rescinded. 4. The system according to the permit consists of a septic tank, sand filter, pump tank, tablet chlorination with PVC flow baffle, dosing chamber, and dichlorination sleeves. 5. Annual permit fees for the period ending 3/31/2025, and due 4/14/2024 have not been paid and are overdue. Findings during the inspection: 6. There has been no flow documented on all eDMR submission since January 2022. This is when new subsurface system was completed. 7. John Abbot indicated that the septic tank was crushed in place and backfilled with dirt. He also indicated that all wastewater flow is going to the new subsurface system. 8. The sand filter, pump tank, tablet chlorination tubes, tablet dichlorination tubes, and outfall are still in place. The ORC indicated that he would be acting soon to permanently cap the outfall pipe. 9. The outfall pipe has not been removed or permanently capped at the time of the inspection. The right of way to the outfall was well maintained. No evidence of solids or flow visible. Within 30-days receipt of this letter, please submit a written response to this office indicating the actions you will take or have taken to comply with or resolve the issues noted below. 1. Annual Permit Fee: a. Annual permit fees for the period ending 3/31/2025, and due 4/14/2024 have not been paid and are overdue. The associated permit invoice is attached to this report. Due to the permitted treatment system being disconnected and no longer in use by the facility, the permittee indicated they would like to take action to rescind the permit. In order to rescind an NPDES permit, the outfall pipe needs to either be removed or permanently capped. Also, the facility owner (or authorized representative) should send a letter including the permit number, name and address of the facility, and reason for the rescission request to the NPDES Permitting and Compliance Program.
