hope you both are doing well. I'm reaching out because we have been helping with a project for which
401 /404 permits were issued recently, but (after they were issued) a 3rd-party reviewer on behalf of the
City of Huntersville identified that additional velocity -reducing measures were needed to meet local
requirements for the permitted road crossing.
Subsequent discussions were had with USACE during which several options were explored to achieve
the required velocity -reduction in a way that was the least impactful to the stream. Options such as
stepping down the stream, altering the grade, and the use of Gabion Baskets within the stream channel
were all eliminated as they either did not meet the required reductions or were more impactful to the
stream channel and/or aquatic habitat.
Ultimately, it was determined that a small plunge pool below the culverted crossing and a small
expanded overflow bench would satisfy the velocity requirement while maintaining baseflow,
maintaining the existing stream width and grade, and minimizing the amount of impacts to the stream.
The Corps has issued a modification to the existing 404 based on these updated plans, which
require very minor additional permanent stream impacts (+/- 4 LF). I am writing to ask whether this
modification requires an updated 401 and/or is an acceptable modification with this email serving as a
courtesy notice.

-updated plans depicting the plunge pool configuration
-a depiction of how WEPG proposes to help oversee the construction of a natural overflow bench. This
bench would serve to catch overflow waters during high-water events and reduce velocities by allowing
the water to dissipate over an expanded vegetated bench
