This project has been assigned the file number SAW-2023-01325 and is known as NIH Discovery Lake and Dam Restoration Project. This file number should be referenced in all correspondence concerning this project. A review of the information provided indicates that the proposed work would include the rehabilitation to current safety standards of the dam authorized by NWP-3, and construction of lake shoreline protection in the form of riprap, stone walls, and vegetation authorized under NWP-13. Specifically, the work would involve the Permanent (loss of WOTUS) discharge of fill material into 0.447-acre wetlands and 0.344-acre open water for the purpose of shoreline stabilization; and the temporary discharge of fill material into 0.201-acre wetlands and 0.12-acre open water for vegetated shorelines and construction access. The —500-acre project area is illustrated on the enclosed Permit Set, eight sheets, dated (sealed) September 5, 2023. The project site is located off the east side of TW Alexander Drive on Environmental Parkway on the campus of the National Institute of Environmental Health Sciences and the USEPA approximately one mile east of Apex Highway 55 in Research Triangle Park, Durham County, at Latitude 35.882800 and Longitude -78.875950, 111 TW Alexander Drive. We have determined that the proposed work is authorized by NWP-3 for dam maintenance and NWP-13 for lake shoreline stabilization pursuant to authorities under CESAW-RG-R (SAW-2023-01325 NWP-3 & NWP-13 VERIFICATION) August 12, 2024 Section 404 of the Clean Water Act (33 U.S.0 § 1344). The proposed work must be accomplished in strict accordance with the general permit conditions, any regional conditions, the special conditions listed in this letter, the application materials, and the enclosed plans. If the extent of the project area and/or nature of the authorized impacts to waters are modified, a revised PCN must be submitted to this office for written approval before work is initiated. Any violation of permit conditions or deviation from your submitted plans may subject the permittee to enforcement action. This verification is valid until March 14, 2026, unless prior to this date the subject NWP is suspended, revoked, or modified such that the activity no longer complies with the terms and conditions of this NWP. If you commence or are under contract to commence this activity before the date that the relevant NWP is modified or revoked, you will have 12 months from the date of the modification or revocation of the NWP to complete the activity under the present terms and conditions of this NWP. Project Specific Special Conditions: 1. Please note that future impacts and/or phases and related activities associated with Corps Action ID: SAW-2023-01325, may be considered part of a single and complete project; these impacts may be considered cumulative with impacts authorized during earlier phases with respect to compensatory mitigation and Nationwide Permit thresholds. Current cumulative impacts to waters of the US for the Discovery Lake single and complete project include a total loss of 0.447-acre wetlands and 0.344-acre open water of total potential waters of the US. 2. Suitable habitat for tricolored bat (Perimyotis subflavus) may be present at the site. On September 14, 2022, the USFWS published a proposal in the Federal Register to list the tricolored bat as endangered under the Endangered Species Act (ESA). The permittee understands and agrees that all work associated with the clearing and removal of trees and removal, or modification of culverts must be completed prior to the effective date of the final listing in the Federal Register. Work associated with the aforementioned activities not completed by that time must cease and the permittee must contact the Corps' (Attn: Julia Tillery, (919) 440-1951 or Julia.A.Tillery@usace.army.mil) to determine if additional coordination with the USFWS is required under Section 7 of the ESA prior to continuing work. 3. In order to compensate for impacts associated with this permit, mitigation shall be provided in accordance with the provisions outlined on the most recent version of the attached Compensatory Mitigation Responsibility Transfer Form. The requirements of this form, including any special conditions listed on this form, are hereby incorporated as special conditions of this permit authorization. 4. Following construction, temporary wetland impacts must be restored to natural grades and seeded with regionally appropriate wetland plants.
