We find the plan to be acceptable with modifications and hereby issue this letter of Approval with Modifications.The Modifications Required for Approval are listed on the attached page.This plan approval shall expire three (3) years following the date of approval, if no land- disturbing activity has been undertaken, as is required by Title 15A NCAC 4B .0129. As of April 1, 2019, all new construction activities are required to complete and submit an electronic Notice of Intent (eNOl) form requesting a Certificate of Coverage (COG) under the NCG010000 Construction General Permit. After the form is reviewed and found to be complete, you will receive a link with payment instructions for the $100 annual permit fee. After the fee is processed, you will receive the COC via email. As the Financially Responsible Party shown on the FRO form submitted for this project,you MUST obtain the COC prior to commencement of any land disturbing activity. The eNOI form may be accessed at deq.nc.gov/NCG01. Please direct questions about the eNOI form to the Stormwater Program staff in the Raleigh central office. Also, this letter gives the notice required by G.S. 113A-61.1(a) of our right of periodic inspection to insure compliance with the approved plan. North Carolina's Sedimentation Pollution Control Program is performance-oriented, requiring protection of existing natural resources and adjoining properties. If, following the commencement of this project, it is determined that the erosion and sedimentation control plan is inadequate to meet the requirements of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statute 113A-51 through 66),this office may require revisions to the plan and implementation of the revisions to ensure compliance with the Act. Acceptance and approval of this plan is conditioned upon your compliance with Federal and State water quality laws, regulations, and rules. Please be advised that a rule to protect and maintain existing buffers along watercourses in the Tar-Pamlico River Basin became effective on January 01, 2000. The Tar-Pamlico River Riparian Area Protection and Maintenance Rule (15A NCAC 2B .0734) applies to the 50-foot wide zone directly adjacent to surface waters (intermittent streams,perennial streams,lakes, ponds, and estuaries) in the Tar-Pamlico River Basin. Dominion is in the process of rebuilding an existing overhead electric transmission line, Line 105, which extends approximately 8.0 miles from structure 105/87 to Parmele Substation in Pitt County (Location Map, enclosed). The original Erosion and Sediment Control Plan proposed 43.81 acres of land disturbance and was approved on December 2, 2022 (Pitt-2023-021). Upon issuance of the original plan approval, the project was registered for coverage under the Construction General Permit(NCG01) and construction commenced. Since that time, Dominion has identified several needs that warrant a revision to the approved plans. The first change was the removal of a construction entrance and access route and addition of a workpad, for which our coordination with NCDEQ determined that no modification was needed. Dominion has now identified the need to add mat access around an existing cemetery near Price Road/Route 1430 in Pitt County. The proposed matting would provide access for forestry crews to remove danger trees without disrupting the cemetery plat(Sheet 20 Area B). The new total land disturbance area is 43.19 acres. As this is below the initial approved 43.81 acres, no additional fee is included.
