Dear Mr. Meilinger:
Thank you for coordinating with our office regarding comments related to the Atlantic RV
Resort project. I have reviewed the comments forwarded to me and have the below responses
and/or revisions detailed per each comment.
1. Please submit a verified wetland delineation completed by the United States Army Corps
of Engineers for the entire site.
a. Mr. Chadwick initially completed unauthorized work on Tract I and the
USACE approved the completion of the remediation, at which time they
advised to place wetlands flags per the attached survey by Jimmy Powers in
2010 that was approved as a delineation map. Davey Resource Group
applied for a PJD on Tract II in July of 2023. Tom Charles issued a
Delineation Concurrence Email in August of 2023, as attached, to be used for
permitting purposes instead of a delineation map.
2. Please submit a cross section for culvert 8, which is planned to be reinstalled in the
corner of the basin. The cross section must include the wetland impact 7.
a. Cross section attached on CAMA Sheet 6. Culvert inverts revised on Grading
Plan, as attached.
3. Please provide wetland shading impacts for the Proposed 47 LF walkway leading to the
pier.
a. Wetlands shading square footage noted on Site Plan and Pier Profile.
4. Please provide a credit reservation letter.
a. Credit reservation letter for 1 acre of mitigation in Bachelors Delight
Mitigation Bank attached as provided by Davey Resource Group.

Dear Chris Chadwick:
Pursuant to a submitted credit request on your behalf, Bachelors Delight Mitigation Bank (BDMB) is
providing confirmation of acceptance to supply riparian wetland credits for impacts associated with the
Atlantic RV Resort project in Carteret County, North Carolina. This acceptance is conditional upon receipt
of payment as outlined below. Please refer to the table below depicting the type and quantity of credits
requested and reserved for your project.

Based upon receipt of the project credit request transmitted on July 22, 2024, BDMB will reserve 1_0
Riparian Wetland Credits for a period of up to 90 days from the date of this letter. Note that requests to
reserve credits beyond 90 days will require a deposit. Please contact us if you need a reservation to extend
beyond the 90-day period.
Upon request for receipt of credit transfer, BDMB will issue an invoice in the amount of $76,838.45.
Upon receipt of payment, BDMB will provide an executed Transfer of Credit Certificate. Note that all
payments must be made with certified funds. It is the applicant's responsibility to ensure that the credit
types and amounts requested are consistent with the compensatory mitigation requirements of the
permit(s) issued. BDMB and/or its agents are not responsible for determining the applicant's mitigation

Hey guys,
Tom Charles has issued a"Delineation Concurrence Email"(DCL)for this site(see below).It can be relied upon the same as a PJD.We did
not request this type of authorization,but some regulators are doing this as a way to expedite review,and it is basically the same thing as a
PJ D.
Ron-do you feel comfortable with using this for your needs?I will send a clean copy separate of this email.It should work fine for
obtaining all other permits you may need.The one thing that is not correct on the map is the AEC on the northern side of the property.We
will need to delineate Normal High Water(NHW)along the north side of the existing marina.The 575-AEC will be measured landward
(south)of this line and the AEC will extend into this property.We were planning on performing this work prior to the meeting with the
Corps and DCM,but now that the Corps has issued this DCL,we will need to flag it prior to the meeting with DCM.John in our office is
reaching out to DCM to schedule a site visit to review the coastal and NHW lines.We will keep you posted as to the scheduled meeting

review was conducted on 8/17/2023 using information obtained from the consultant (John
Perry- Davey resource group)and from Corps produced QL2 Lidar Maps.

We have reviewed the information provided by you concerning the aquatic resources, and by
copy of this e-mail, are confirming that the aquatic resources delineation has been verified by
the Corps to be sufficiently accurate and reliable for permitting actions and the determination of
compensatory mitigation requirements. The boundaries of these aquatic resources are shown
on Preliminary Resource Boundary Sketch, 375 Morris Marina Rd Carteret County, NC, Map
Date: April 2023, DRGNCW23.142.
Regulatory Guidance Letter (RGL) 16-01

for Jurisdictional Determinations (JD) and states "The Corps generally does not issue a JD of any
type where no JD has been requested". At this time, we are only verifying the delineation. This
delineation may be relied upon for use in the permit evaluation process, including determining
compensatory mitigation. This delineation verification is not an Approved Jurisdictional
Determination (AJD) and is not an appealable action under the Regulatory Program
Administrative Appeal Process (33 CFR Part 331). However, you may request an AJD, which is an
appealable action. If you wish to receive a Preliminary Jurisdictional Determination (PJD), or an
Approved Jurisdictional Determination (AJD) please respond accordingly, otherwise nothing
further is required and we will not provide any additional documentation.
