Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. EFFLUENT LIMITS AND MONITORING REQUIREMENTS — FINAL During the period beginning on May 1, 2008, and lasting until April 30, 2013, the permittee is authorized to discharge from outfall 001. For instantaneous flow measurement, the duration of the discharge shall be reported in addition to the total flow. 2. Fluoride should be monitored if the permittee fluoridates at the facility. 3. Zinc shall be monitored if the permittee uses any zinc -based additive in the water treatment process. 4. For a given wastewater sample, TN=TKN+NO3N+NO2N, where TN is Total Nitrogen, TKN is Total Kjeldahl Nitrogen, and NO3N and NO2N are Nitrate and Nitrite Nitrogen, respectively. 5. TN Load is the mass quantity of Total Nitrogen discharged in a given period of time. See Special Condition A. (2.), Calculation of TN Loads. 6. Total Residual Chlorine limit and monitoring requirement apply only if chlorine is used in the treatment -process. There shall be no discharge of floating solids or visible foam in other than trace amounts. All samples collected shall be from representative discharge events. r Permit NCO087998 A. (2.) CALCULATION OF TOTAL NITROGEN LOADS a. The permittee shall calculate monthly and annual TN Loads as follows: L Monthly TN Load (lbs/month) = TN x TMF x 8.34 Where: TN = average TN concentration (mg/L) of the composite samples collected during the month TMF = Total Monthly Flow of wastewater discharged during the month (MG/month) 8.34 = conversion factor, from (mg/L x MG) to pounds H. Annual TN Load (lbs/year) = Sum of the 12 Monthly TN Loads for the calendar year b. The permittee shall report monthly Total Nitrogen results (mg/L and lbs/month) in the discharge monitoring report for that month and shall report each year's annual results (lbs/year) in the December report for that year. The "greensand" characterization is meant to capture a variety of filter systems that do not use a brine recharge. Manuel After review of this draft permit there are a few discrepancies that I have noted. ✓ • The draft permit indicates the filters as being greensand; however they are sand, 'd o, "E • garnet and anthracite. The raw water inorganic chemical analysis (attached) shows the pH at 7.7 mg/l, there is nothing in this process that would change the pH of the water where it • P!i �J� ¢czv,a ✓ would be t6.0 or >9-0, therefore I am requesting that the pH not be a requirement as the other NPDES permits don't require this. This seems to be an added expense that we shouldn't have to incur. • On the August 27, 2004 permit Fluoride was listed with a footnote M. Fluoride �r��c kd rap <ne2� should be monitored if the Permittee fluoridates its finished water / product." which we do not. The new draft permit footnote states "2. Fluoride should be monitored if the permittee uses chlorine at the facility." We do not treat any type of fluoride; however we do treat Sodium Hypochlorite for disinfection. The raw water inorganic chemical analysis (attached) shows the fluoride well below the MCL; therefore I am requesting that the fluoride be removed from the permit as this is just an added expense that we shouldn't have S%AtS /• to incur. Total Zinc can be removed from the permit at we do not add zinc -based additives in the water treatment process. • Total Suspended Solids (TSS) - would it be possible to sample this on a monthly 5%yS basis with everything else or is there a specific reason this is sampled 2/monthly. • _?6 Total Residual Chlorine (TRC) — would it be possible to sample this on a monthly cy basis with everything else or is there a specific reason this is sampled 2/monthly.
