Dear Mr. Manning:
The Division of Energy, Mineral and Land Resources(DEMLR)has reviewed your submittal of the No Exposure
Certification for Exclusion from NPDES Stormwater Permitting form, received on May 10,2024. The Division is
unable to concur with your certification of no exposure.
Based on an inspection of your facility on July 31, 2024, Washington Regional Office staff found evidence of
sewage spills at various points at the facility as well as open-top dumpsters exposed to stormwater.Additionally,
inspectors noted sludge drying beds to be in use,which is an exposure issue.The Division cannot grant your
requested exemption from permit coverage when industrial activities or materials are exposed or have the
potential to be exposed. Please continue to operate under COC NCCH 10058. Information can be found at
