Subject: Nationwide 23 and 33 Permit Applications
Replacement of Bridge No. 143 over the North
Toe River, TIP Project No. B-2848
Dear Mr. Lund:
After review of the referenced permit application, the Division,of Water Quality (DWQ) finds that the
impact analysis is incomplete. The NC Department of Transportation (DOT) has failed to detail the
permanent impacts of the proposed bridge bents to be located in the North Toe River. DWQ cannot issue
a 401Water Quality Certification based on the current application due to DOT's failure to demonstrate
minimization of impacts in accordance with 15A NCAC 2H .0506(g).
