Atlas Environmental completed a stream and wetland delineation on July 9-11, 2024. An approved jurisdictional determination will be submitted with the NWP 29. Atlas assessed the presence of seven streams, twelve wetlands, and nine ponds within Phase 1 of the site. Two of the streams were observed as non -jurisdictional along with four wetlands and seven impoundments. The approved jurisdictional determination request is attached. The project's purpose is for the construction of a residential development consisting of 7 phases. Phase 2 is scheduled to commence in 2026. The Phase 1 development will require four permanent unavoidable impacts to Waters of the United States and one temporary impact. Three permanent impacts of fill will occur to three non -jurisdictional ponds for lots. One road crossing is needed for Phase 1 where all jurisdictional impacts occur. An existing 18" RCP culvert will be removed and replaced with a larger 72" culvert. The culvert will be placed at stream bed elevation with a slope of 1.94%. Impact S1 consists of 40 linear feet (-0.002 acre) of intermittent stream impact of CH C. Impact S2 consists of 4 linear feet (-0.001 acres) of perennial stream permanent impact of CH C. Impact S2's linear footage is small due to the previous impact of the culvert. A temporary stream impact (Impact S3, 36 LF (0.002 acres)) will occur during installation of the new culvert for construction access and for restoration of the stream where the previous culvert was located. The stream will be restored to its previous condition before the culvert was installed. Impact WL 1 (WL C 1100, —0.009 acres) and Impact WL 2 (WL C 1200, —0.001 acres) are both being filled for the construction of the road. No mitigation will be required for this project as stream impacts are less than 0.02 acre and wetland impacts are less than 0.10 acres. The site has been designed and engineered to avoid and minimize impacts to the greatest extent possible. All jurisdictional ponds are being avoided and preserved. There is a no FEMA floodplain on site. A different environmental consultant consulted State Historic Preservation Office (SHPO) and received a no affect letter on January 17, 2024 and assigned ER-23-2783 as the their project number. This is for the entirety of the site. Atlas submitted a report of findings to the United States Fish and Wildlife Service (FWS) on July 26, 2024. Sharon Amity Road #411 Charlotte, North Carolina 28211 1 704-512-1206 (o) / 828-712-9205 (m) www.atlasenvi.com I Offices in Asheville and Charlotte 2 1 Introduction Emily Powell of KH Carolinas Homes LLC has requested Atlas Environmental, Inc. to perform a site assessment for Federally listed Endangered, Threatened, and Candidate species that could potentially occur on the subject property and recommend a determination of effects. .1 Site Location and Description The subject site is located at 12070 Bethel Church Road, Locust, North Carolina 28097 and is comprised of 10 full and 1 partial Stanly County parcels (Parcel ID: 558603037868,558603044056,557604943737,557604827518,558603023332, 557604828727,557602863292,558603032576,557604910852,557604817397, 557604715582 (partial)) totaling approximately 507.7 acres. The project site is within the Locust 1-24,000 Quadrangle. The project site is located on the North and South sides of Bethel Church Road (SR 1200), West of the intersection with Coley Store Road and East of N Central Avenue (SR 1206), approximately 2.4 driving miles Northeast of the city center of the City of Locust, North Carolina The tracts on the Northern side of Bethel Church Road slope to the North toward an unnamed tributary of Stony Run. The tracts on the Southern side of Bethel Church Road slope to the South toward an unnamed tributary of Island Creek. The topographic relief of the project site is approximately 50 feet with an approximate maximum elevation of 690 feet and minimum elevation of 640 feet. The project site consists of residential home sites and active agricultural fields with small, forested areas interspersed throughout. An electric utility line runs along Bethel Church Road on the Northern portion of the property. The surrounding area consists of rural density residential homesites, agricultural fields, and small, forested areas. 1.2 Project Purpose The purpose of the proposed project is for the construction of a residential development. The project site will require mechanized land clearing to remove existing vegetation and grading to prepare the ground surface for construction. The development also may require the construction of stormwater treatment, ingress and egress roadways, utilities, and additional associate infrastructure. A U.S. Army Corp of Engineers (USACE) Nationwide Permit 29 or Individual Permit may be required for unavoidable impacts to aquatic resources. A preliminary site plan has not been provided. 1.3 Project History Site evaluations for Federally listed Endangered, Threatened, and Candidate species were previously conducted on the proposed project site in October 2022 and November 2023. The October 2022 report did not note the presence of suitable habitat for any Federally listed species with the potential to occur within the vicinity of the proposed project site. Specifically, all potential habitats for Schweinitz's Sunflower (i.e., along roadsides, fencerows, woods edges) were examined during the optimal survey window and the species was not observed, and on -site streams do not have the habitat characteristics required to support populations of Atlantic Pigtoe and Carolina Heelsplitter. The November 2023 report also did not note the presence of suitable habitat for any Federally listed species with the potential to occur within the vicinity of the ATLAS Environmental, Inc. 338 S. Specifically, the soil series that supports Schweinitz's Sunflower populations do not exist with the proposed project site, and the species was not observed during a period when above -ground parts were still visible in a reference population. 1.4 Endangered Species Act The Endangered Species Act of 1973, as amended (ESA), provides a program for the conservation of Endangered and Threatened plants and animals and the habitats in which they are found. The lead Federal agencies for implementing the ESA are the U.S. Fish and Wildlife Service (USFWS) and the National Marine Fisheries Service (NMFS). Before a species can receive the protection provided by the ESA, it must first be added to the Federal lists of Endangered and Threatened wildlife and plants. A species is added to this list when the respective Federal agency determines that it has met a definition of Endangered or Threatened under the ESA. Species may also be removed from the list (i.e., "delisted") when they no longer require ESA protection, or have a change in status (i.e., "reclassified"), for example from Endangered or Threatened. Under the ESA, a species must be listed if it is endangered or threatened because of any of the following 5 factors: 1. present or threatened destruction, modification, or curtailment of its habitat or range; 2. over -utilization of the species for commercial, recreational, scientific, or educational purposes; 3. disease or predation; 4. inadequacy of existing regulatory mechanisms; and, 5. other natural or manmade factors affecting its continued existence. Additionally, the USFWS and NMFS periodically publish a Notice of Review or Notice of Reclassification in the Federal Register that presents an updated list of plant and animal taxa which are regarded as Candidate or species proposed for possible addition to the Lists of Endangered and Threatened Wildlife and Plants. An Endangered species is a taxon "in danger of extinction throughout all or a significant portion of its range" (ESA, Section 3). A Threatened species is a taxon "likely to become an Endangered species within the foreseeable future throughout all or a significant portion of its range" (ESA, Section 3). Candidate species are "taxa for which the Service has on file enough substantial information on biological vulnerability and threat(s) to support proposals to list them as Endangered or Threatened. Proposed rules have not yet been issued because this action is precluded at present by other listing activity. Development and publication of proposed rules on these taxa are anticipated. The Service encourages State and other Federal agencies as well as other affected parties to give consideration to these taxa in environmental planning." (Federal Register, February 28, 1996). Taxa formerly considered as `Category 1' are now considered as `Candidate'. A Federal Species of Concern (FSC) is a species under consideration for listing, for which there is insufficient information to support listing at that time. FSCs may or may not be listed in the future, and many of these species were formerly recognized as "C2" Candidate species. ATLAS Environmental, Inc. 338 S. Sharon Amity Road #411 Charlotte, North Carolina 28211 1 704-512-1206 (o) / 828-712-9205 (m) www.atlasenvi.com I Offices in Asheville and Charlotte 4 2 Methods 2.1 Action Area A site assessment for Federally listed Endangered, Threatened, and Candidate Species includes a thorough search of historical and recent records for potential and known occurrences of species on and in the vicinity of the proposed project site. According to regulation (50 CFR § 402.02), Action Area is defined as all areas to be affected directly or indirectly by the Federal action and not merely the immediate area involved in the action. Initially, we assess a one -mile zone around the property boundaries as the Action Area to ensure we include species that occur nearby, but not necessarily on, the proposed project site. The Action Area is initially defined this way because species may be affected (positively or negatively) by the project that exists in a nearby geographic area. For example, certain aquatic species may appear on the species list because a project could cause downstream effects, such as sedimentation, on the species. The Action Area also may vary depending on the activities associated with the proposed project (e.g., construction, operational, or maintenance activities) and its potential direct and indirect effect on the species identified in the vicinity. For example, operational impacts associated with lighting or noise could affect species that occur away from the project site. In most cases, the Action Area contracts to an area no less than the proposed project boundary but remains species dependent. In some situations, the Action Area may be reduced to an area less than the project boundaries if the proposed action has adequately avoided the potential for any direct or indirect effects. If applicable, the species dependent Action Area is further defined in the individual species account below. 2.2 Information, Planning and Conservation System A record search of the USFWS website is conducted to determine what species are known or believed to occur within the County of the proposed project. The USFWS's Information, Planning, and Conservation System (IPaC) mapping tool also is used to generate a list of Endangered, Threatened, and Candidate species, and/or designated Critical Habitat. Species on the IPaC list include species that may be affected by your project and could include species that exist in another geographic area. 2.3 North Carolina Natural Heritage Program The North Carolina Department of Environment and Natural Resources (NCDENR), North Carolina Natural Heritage Program (NCNHP) GIS database is searched to determine what species or rare natural communities (element occurrences) are known to occur within a one -mile radius of the approximate center of the project site. A list of the Endangered, Threatened, and rare species and communities known to occur within the quadrangle(s) of the proposed project site is generated for the field search. This list indicates what species have been reported as occurring in the State, each county, and within each quadrangle. This is not a complete listing of what exists as no comprehensive survey of the state has ever been conducted. The list also provides the last date of observation and accuracy of the observation. Natural and Managed areas, such as parks, open space, and greenways, known to occur within a one -mile radius of the approximate center of the project site also are documented. 2.4 Field Assessment A site assessment also includes a pedestrian survey of the proposed project site by ATLAS Environmental, Inc. 338 S. Sharon Amity Road #411 Charlotte, North Carolina 28211 1 704-512-1206 (o) / 828-712-9205 (m) www.atlasenvi.com I Offices in Asheville and Charlotte botanists and biologists with specialized experience in the identification of Endangered, Threatened, and Candidate species. Atlas Environmental staff identify potentially suitable habitat for Federally listed species within the project review area based on the species' known and preferred habitat requirements reported in the IPaC and NCNHP reviews. The project review area is then traversed to evaluate all potentially suitable habitat areas for the presence of Federally listed Endangered, Threatened, and Candidate species. 3 Results 3.1 Information, Planning and Conservation System A search of the USFWS's IPaC website (www.ecos.fws.gov/ipac) identified Federally listed Endangered, Threatened, and Candidate species that could occur within the proposed project review area or be impacted downstream (Appendix A). These species include: 1) Tricolored Bat (Perimyotis subf/avus), a Proposed Endangered mammal; 2) Atlantic Pigtoe (Fusconaia masoni), a Threatened clam; 3) Carolina Heelsplitter (Lasmigona decorata), an Endangered clam; 4) Monarch Butterfly (Danaus p/exippus), a Candidate butterfly; and 5) Schweinitz's Sunflower (Helianthus schweinitzii), an Endangered flowering plant. No Critical Habitat has been designated for any species within the Action Area. 3.2 North Carolina Natural Heritage Program A search of the NCNHP website (www.ncnhp.org/web/nhp/database-search) identified no element occurrences of Federally listed Endangered or Threatened species documented within the project area (Appendix B). No element occurrences of Federally listed Endangered or Threatened species were documented within a one -mile radius of the project area. No element occurrences of rare species and species or habitats of conservation concern were documented within the project area. Two element occurrences of rare species and species or habitats of conservation concern were documented within a one -mile radius of the project area (Carolina Darter (Etheostoma collis), EO ID 17822, State listed Special Concern, Last Observation Date 2016-40-27; and Xeric Hardpan Forest (Acidic Hardpan Subtype), EO ID 11247, Last Observation Date 2010). No Natural Area was documented within the project area. One Natural Area was documented within a one -mile radius of the project area (Locust Barrens). No Managed Area was documented within the project area. One Managed Area was documented within a one -mile radius of the project area (City of Locust — Locust Community Park, owned by City of Locust). 3.3 Field Assessment The field assessment of the project review area was completed on July 9-11, 2024. 3.4 Species of Interest The species identified through the IPaC and NCNHP review have the potential to exist within the project review area or be potentially impacted by the proposed project. Each of these species are described below, including the typical features, suitable habitat requirements, and other related observations by Atlas Environmental. ATLAS Environmental, Inc. 338 S. Sharon Amity Road #411 Charlotte, North Carolina 28211 1 704-512-1206 (o) / 828-712-9205 (m) www.atlasenvi.com I Offices in Asheville and Charlotte 3.4.1 Tricolored Bat (Perimyotis subf/avus) The Tricolored Bat is a species of microbat native to Eastern North America. It was formerly known as the Eastern Pipistrelle, based on the incorrect belief that it was closely related to European Pipistrellus species. Its common name derives from the coloration of the hairs on its back, which have three distinct color bands: dark gray at the base, buffy (yellowish brown) in the middle, and brown or reddish brown at the tip. It is the smallest bat species in the Eastern and Midwestern US, with individuals weighing 0.16-0.28 oz. The Tricolored Bat is a seasonal breeder, with copulation (mating) occurring in the fall before hibernation. Ovulation does not occur until the spring, however, and females store the males' sperm in their uteruses through the winter. Gestation length is about forty-four days, with females giving birth in June or July. The litter size is typically two individuals. As newborns, the combined mass of twin pups can be as great as 58% of the mother's postpartum mass. At birth, the young lack fur and their eyes are closed. The mother leaves the offspring behind at the roost while she forages at night. Offspring develop rapidly, beginning to fly at three weeks old. By four weeks old, they are foraging for themselves. Young do not reach sexual maturity in their first fall; they do not breed until their second fall. Individuals can live 15 years in the wild; juveniles have higher mortality rates than adults, and females have higher mortality rates than males. During the summer, the Tricolored Bat will roost in tree foliage or buildings, with females alone or in maternity colonies of up to thirty individuals. Trees used for this purpose include oak, maple, the eastern cottonwood, and American tulip tree. Males are solitary and do not form colonies. In the winter, the Tricolored Bat hibernates in mines, caves, or other human structures. A study of a mine in Nebraska found that in the summer, the mine was mostly occupied by males, ranging from zero to forty-three individuals. Bats were in a state of torpor from November to April. More bats used the mine as a roost in the winter than in the summer. In another abandoned mine in Indiana, researchers found that the Tricolored Bat roosts solitarily during hibernation most of the time. The Tricolored Bat is insectivorous, consuming small prey such as mosquitoes, beetles, ants, moths, and cicadas. It forages with slow, erratic flight in areas near water or forest edges. It is one of the first bat species to begin foraging each night. It navigates and searches for prey via echolocation. The Tricolored Bat's natural predators include the northern leopard frog, birds of prey, raccoons, snakes, skunks, and prairie voles. Feral cats will also catch and kill them as they leave their hibernacula. There also are records of it being attacked by the Hoary Bat. The Tricolored Bat is common throughout eastern North America, with the southern extent of its range in Central America and the northern extent in southern Canada. Its range has expanded since the 1980s, with westward expansion reaching Colorado, New Mexico, South Dakota, and Wyoming. Additionally, its range started to include the Great Lakes Basin. The Tricolored Bat has experienced severe population decline because of the fungal disease White -nose syndrome, which arrived in the US in 2006, with losses of 70% and ATLAS Environmental, Inc. 338 S. The disease kills bats by colonizing their skin during the winter, causing them to arouse from torpor and burn through their limited fat reserves. Though its population experienced dramatic reduction, subsequent studies have found that their numbers may be stabilizing. The Tricolored Bat was proposed for listing as Endangered under the ESA on September 13, 2022. Proposed Endangered (PE) species are not protected by the take prohibitions of Section 9 (Prohibited Acts) of the ESA until the rule to list is finalized. Under Section 7(a)(4) of the ESA, federal agencies must confer with the Service if their action will jeopardize the continued existence of a proposed species. 3.4.2 Atlantic Pigtoe (Fusconaia masoni) The Atlantic Pigtoe is a small freshwater mussel with a sub -rhomboidal shaped shell. Although larger specimens exist, the Atlantic Pigtoe rarely exceeds two inches in length. The species is dependent on clean, moderate -flowing water with high dissolved oxygen content in creek and riverine environments. Historically, the most abundant populations existed in creeks and rivers with excellent water quality, and where stream flows were sufficient to maintain clean, silt -free substrates. The species is associated with gravel and coarse sand substrates at the downstream edge of riffles (shallow water with rapid currents running over gravel or rocks), and less commonly occurs in cobble, silt, or sand detritus mixtures. Because the species prefers more pristine conditions, it typically occurs in headwaters of rural watersheds. The Atlantic Pigtoe is presumed to be an omnivore. Adults primarily filter feed on a wide variety of microscopic particulate matter suspended in the water column, including phytoplankton, zooplankton, bacteria, detritus, and dissolved organic matter, although juveniles tend to pedal feed in the sediment. Like most freshwater mussels, the Atlantic Pigtoe has a unique life cycle that relies on fish hosts for successful reproduction. Following release from the female mussel, sticky packets of floating glochidia (larvae) attach to the gills and scales of host minnows. The larvae stay attached to the host fish until they complete metamorphosis, when they release from the fish and fall to the substrate. The Atlantic Pigtoe has been documented in all major river basins in the Atlantic coastal drainages from the James River Basin in Virginia south to the Altamaha River Basin in Georgia, and from the foothills of the Appalachian Mountains to the Coastal Plain. However, abundance and distribution of the species has declined, with the species currently occupying approximately 40 percent of its historical range. Most of the remaining populations are small and fragmented, only occupying a fraction of reaches that were historically occupied. Recent surveys (2005 to 2019) found Atlantic Pigtoe remain in seven populations in Virginia and North Carolina; however, only three populations have multiple documented occurrences within the past 16 years. This decrease in abundance and distribution has resulted in isolated contemporary populations. Evidence suggests that the range reduction of the species corresponds to habitat degradation resulting from the cumulative impacts of land use change and associated watershed -level effects on water quality, water quantity, habitat connectivity, and instream habitat suitability. The conversion of low intensity land use to high intensity uses continues to increase and compromise freshwater habitats. Impoundments and/or alteration of the rivers for navigation significantly alter the habitat for this species. A recent study determined that the glochidia of Atlantic Pigtoe are extremely sensitive to pollution. The Atlantic Pigtoe was Federally listed as Threatened wherever found on December 16, 2021. Critical Habitat has been designated for the Atlantic Pigtoe in 17 units in North Carolina and Virginia: (1) Craig Creek (Botetourt County, VA); (2) Mill Creek (Bath County, VA); (3) Sappony Creek (Dinwiddle County, VA); (4) Nottoway River Subbasin (Nottoway, Lunenburg, Brunswick, Dinwiddie, Greensville, and Sussex Counties, VA); (5) Meherrin River (Brunswick County, VA); (6) Dan River (Rockingham County, NC and Pittsylvania County, VA); (7) Aarons Creek (Granville County, NC and Mecklenburg and Halifax Counties, VA); (8) Little Grassy Creek (Granville County, NC); (9) Upper/Middle Tar River Subbasin (Granville, Vance, Franklin, and Nash Counties, NC); (10) Sandy/Swift Creek (Warren, Franklin, and Nash Counties, NC); (11) Fishing Creek Subbasin (Warren, Halifax, Franklin, and Nash Counties, NC); (12) Lower Tar River (Edgecombe and Pitt Counties, NC); (13) Upper Neuse River Subbasin (Person, Durham, and Orange Counties, NC); (14) Middle Neuse River Subbasin (Wake, Johnston, and Wilson Counties, NC); (15) New Hope Creek (Orange Creek, NC), (16) Deep River Subbasin (Randolph County, NC); and (17) Little River (Randolph and Montgomery Counties, NC). 3.4.3 Carolina Heelsplitter (Lasmigona decorata) The Carolina Heelsplitter is a freshwater mussel that inhabits cool, slow -moving, small- to medium-sized streams and rivers. It has an ovate, trapezoid -shaped, unsculptured shell. The shell of the largest known specimen of the species measures 4.6 inches in length, 1.56 inches in width, and 2.7 inches in height. The shell's outer surface varies from greenish brown to dark brown in color, and shells from younger specimens have faint greenish brown or black rays. The nacre (inside surface) is often pearly white to bluish white, grading to orange around the umbo. However, in older specimens, the entire nacre may be a mottled pale orange. Because of its rarity, little is known of the Carolina Heelsplitter. Historically, the species was reported from small to large streams and rivers as well as ponds. The ponds referred to in historic records are believed to have been mill ponds on some of the smaller streams within the species' historic range. Presently, the species is known to occur in only small streams and rivers and is usually found in mud, muddy sand, or muddy gravel substrates along stable, well -shaded stream banks. However, in South Carolina, two live individuals were found near the center of the stream channel in a relatively silt -free substrate comprised primarily of a mixture of sand, gravel, and cobble. It is conceivable that this is the preferred habitat type for the species and that in other areas degradation of the gravelly substrates has restricted the species to less suitable habitats. The stability of stream banks appears to be important to the species. ATLAS Environmental, Inc. 338 S. The specific food habits of the species are not well known, but other freshwater mussels have been documented to feed on detritus, diatoms, phytoplankton, and zooplankton. The reproductive cycle of the Carolina Heelsplitter is likely similar to that of other native freshwater mussels. Males release sperm into the water column; the sperm are then taken in by the females through their siphons during feeding and respiration. The females retain the fertilized eggs in their gills until the larvae (glochidia) fully develop. The mussel glochidia are released into the water, and within a few days they must attach to the appropriate species of fish, which are then parasitized for a short time while the glochidia develop into juvenile mussels. They then detach from their fish host and sink to the stream bottom where they continue to develop, provided they land in a suitable substrate with the correct water conditions. Prior to 1987 the Carolina Heelsplitter had not been found since the mid-19th century. Historically, this species was distributed in the Catawba and Pee Dee River systems in North Carolina and the Pee Dee and Savannah River systems and possibly the Saluda River system in South Carolina. The species is extant in short reaches of the following streams: Goose and Waxhaw creeks in North Carolina; Lynches River, Flat Creek, Turkey Creek, Mountain Creek, Beaverdam Creek, Gills Creek, and Cuffytown Creek in South Carolina. More recently, occurrences were identified in South Carolina in the Lynches River (Pee Dee River basin), Lancaster and Chesterfield Cos.; and two populations from tributaries to the Savannah River in the Abbeville District and one in the Catawba River basin. Only six or seven relatively small populations remain in three river systems from what was a much broader area of occupancy. Threats and causes for decline of the Carolina Heelsplitter include siltation due to poorly implemented agricultural, forestry, and development activities; golf course construction; road construction and maintenance; runoff and discharge of municipal, industrial, and agricultural pollutants; habitat alteration due to impoundments, dredging, and channel alteration; and deterioration of water quality resulting from siltation and other pollutants. Urban sprawl from the Augusta -Aiken and Charlotte metropolitan areas threatens all extant populations. Exotic mollusk species, such as the Asian Clam (Corbicula f/uminea), also may negatively impact the Carolina Heelsplitter as the invasive species becomes established where the Carolina Heelsplitter occurs. The Carolina Heelsplitter was Federally listed as Endangered wherever found on June 30, 1993. Critical Habitat has been designated for the Carolina Heelsplitter in 6 units in North Carolina and South Carolina: (1) Goose Creek and Duck Creek (Pee Dee River System), Union County, NC; (2) Waxhaw Creek (Catawba River System), Union County, NC; (3) Gills Creek (Catawba River System), Lancaster County, SC; (4) Flat Creek and Lynches River (Pee Dee River System), Lancaster and Kershaw Counties, SC; (5) Mountain and Beaver Dam Creeks (Savannah River System, Edgefield County, SC, and Turkey Creek (Savannah River System, Edgefield and McCormick Counties, SC; (6) Cuffytown Creek (Savannah River System), Greenwood and McCormick Counties, SC. 3.4.4 Monarch Butterfly (Danaus plexippus) Adult monarch butterflies are large and conspicuous, with bright orange wings with a ATLAS Environmental, Inc. 338 S. The black border has a double row of white spots, present on the upper side of the wings. Adult monarchs are sexually dimorphic, with males having narrower wing venation and scent patches. The bright coloring of a monarch serves as a warning to predators that eating them can be toxic. During the breeding season, monarchs lay their eggs on their obligate milkweed host plant (primarily Asclepias spp.), and larvae emerge after 2 to 5 days. Larvae develop through five larval instars (intervals between molts) over a period of 9 to 18 days, feeding on milkweed and sequestering toxic chemicals as a defense against predators. The larva then pupates into a chrysalis before emerging 6 to 14 days later as an adult butterfly. There are multiple generations of monarchs produced during the breeding season, with most adult butterflies living 2 to 5 weeks; overwintering adults enter reproductive diapause (suspended reproduction) and live 6 to 9 months. In many regions where monarchs are present, monarchs breed year-round. Individual monarchs in temperate climates, such as eastern and western North America, undergo long-distance migration, and live for an extended period. In the fall, in both eastern and western North America, monarchs begin migrating to their respective overwintering sites. This migration can take monarchs distances of over 2000 miles and last for over two months. In early spring (February -March), surviving monarchs break diapause and mate at the overwintering sites before dispersing. The same individuals that undertook the initial southward migration begin flying back through the breeding grounds and their offspring start the cycle of generational migration over again. The monarch butterfly is a Candidate species and not yet listed or proposed for listing. There generally are no ESA protections or Section 7 (Interagency Cooperation) requirements for Candidate species, but the USFWS encourages any opportunity to conserve the species. 3.4.5 Schweinitz's Sunflower (Helianthus schweinitzii) Schweinitz's Sunflower is a perennial wildflower endemic to the Piedmont physiographic province of North Carolina and South Carolina. It is a member of the sunflower family (Asteraceae) and is one of the rarest species of sunflower in the United States. Schweinitz's Sunflower grows 6 to 7 feet in height (though it can be shorter if young or injured) and can occasionally reach heights of 16 feet. It has thickened roots that are used by the plant to store starch. The stem is purplish in color and usually solitary, branching only at or above mid -stem at 45-degree angles. The leaves are arranged in pairs on the lower parts of the stem but usually occur singly (or alternate) on the upper parts. Leaves are attached to the stem at right angles and the tips of the leaves tend to droop. The leaves are thick and stiff, with a rough upper surface. The upper leaf surfaces have broad spiny hairs that are directed toward the tip of soft white hairs cover the underside. The species flowers from late August until frost. Schweinitz's Sunflower generally is found growing in Xeric Hardpan Forests openings and along roadside rights -of -way, maintained power lines and other utility rights -of -way, edges of thickets and old pastures, clearings and edges of upland oak -pine -hickory woods and Piedmont longleaf pine forests, and other sunny or semi -sunny habitats ATLAS Environmental, Inc. 338 S. Schweinitz's Sunflower occurs in full to partial sun and is intolerant of full shade and excessive competition from other vegetation. Schweinitz's sunflower occurs in a variety of soil series, including Badin, Cecil, Cid, Enon, Gaston, Georgeville, Iredell, Mecklenburg, Misenheimer, Secrest, Tatum, Uwharrie, and Zion. It is found growing on shallow sandy soils with high gravel content; shallow, poor, clayey hardpans; or shallow rocky soils, especially those derived from mafic rocks. Schweinitz's Sunflower was Federally listed as Endangered on May 7, 1991. The USFWS recently completed a 5-Year Review of the species (dated December 2019) and found that no change in the listing status of the species was warranted. No Critical Habitat has been designated for Schweinitz's Sunflower. 4 Findings and Determinations The following findings and determinations are based on the review of available resources including IPaC and NCNHP websites, applicable regulatory guidelines, and the field assessment performed by Atlas Environmental. 4.1 Tricolored Bat The Action Area for Tricolored Bat is defined as the project site. According to the USFWS IPaC and NCNHP websites, the Tricolored Bat is known, or believed, to occur in the proposed project County. Because the Tricolored Bat is a Proposed Endangered species, the species is not protected by the take prohibitions of Section 9 (Prohibited Acts) of the ESA until the rule to list is finalized. Under Section 7(a)(4) of the ESA, federal agencies must confer with the USFWS if their action will jeopardize the continued existence of a proposed species. 4.2 Atlantic Pigtoe The Action Area for Atlantic Pigtoe is defined as the project site plus 100 meters upstream and 400 meters downstream of the project site along any perennial stream occurring on site. According to the USFWS IPaC and NCNHP websites, the Atlantic Pigtoe is known, or believed, to occur in the proposed project County, but there are no known occurrences of the species within the Action Area. Critical Habitat has been designated for the Atlantic Pigtoe, but not within, or in the vicinity of, the Action Area. In fact, the USFWS considers the Atlantic Pigtoe to be Presumed Extirpated in the management unit most closely associated with the proposed Action Area (i.e., Pee Dee: Goose/Lanes Management Unit). The closest Critical Habitat designated for the Atlantic Pigtoe to the proposed Action Area is in Randolph and Montgomery Counties in the following location: Unit 17: YR1 — Little River, Randolph and Montgomery Counties, North Carolina. (i) This unit consists of 40 river miles (64.4 river kilometers) of Little River from SR1114 downstream to Okeewemee Star Road, including the West Fork Little River from NC134 to the confluence with the Little River. The lower most point of the Little River reach of Unit 17 is more than 34 straight-line miles Northeast of the Action Area. ATLAS Environmental, Inc. 338 S. Atlas Environmental staff thoroughly traversed all areas within the Action Area. Aquatic resources in the form of perennial and intermittent streams, upland ponds, and wetlands were identified within the Action Area. The Atlantic Pigtoe is dependent on clean, moderate -flowing water with high dissolved oxygen content in creek and riverine environments with excellent water quality, and where stream flows are sufficient to maintain clean, silt -free substrates. The species is associated with gravel and coarse sand substrates at the downstream edge of riffles (shallow water with rapid currents running over gravel or rocks). The perennial streams within the Action Area consist of large cobble and rock, silty substrate, with very low flow, and continue this way upstream for more than 100 meters and downstream more than 400 meters before connecting to Island Creek. The perennial streams within the Action Area do not provide suitable habitat for Atlantic Pigtoe. Intermittent streams, ponds, and wetlands within the Action Area do not provide suitable habitat for Atlantic Pigtoe. Also, as noted above, the USFWS considers the Atlantic Pigtoe to be Presumed Extirpated in the Pee Dee: Goose/Lanes Management Unit. Therefore, we have determined that suitable habitat for the Atlantic Pigtoe does not exist within the Action Area. Nevertheless, mandated erosion and sediment control measures will be used to further avoid and minimize any potential impacts the proposed activities could have on aquatic resources downstream of the project site. As a result of our findings (reported herein) and the findings of two previous site evaluations in October 2022 and November 2023, we have proposed a "No Effect" determination for the Atlantic Pigtoe, and a "No Adverse Modification" determination to its designated Critical Habitat. 4.3 Carolina Heelsplitter According to the USFWS IPaC and NCNHP websites, the Carolina Heelsplitter is known, or believed, to occur in the proposed project County, but there are no known occurrences of the species within the Action Area. Critical Habitat has been designated for the Carolina Heelsplitter, but not within the Action Area. The closest Critical Habitat designated for the Carolina Heelsplitter to the proposed Action Area is in Union County in the following location: Unit 1. (i) Union County, NC —main stem of Goose Creek (Pee Dee River system) from the N.C. Highway 218 Bridge, downstream to its confluence with the Rocky River, and the main stem of Duck Creek, from the Mecklenburg/Union County line, downstream to its confluence with Goose Creek. The lower most point of the Goose Creek reach of Unit 1 is approximately 8.6 straight- line miles Southwest of the Action Area. Carolina Heelsplitter presence is evaluated, in part, based on the type and condition of aquatic resources within the Action Area. Atlas Environmental staff thoroughly traversed all areas within the Action Area. Aquatic resources in the form of perennial and intermittent streams, upland ponds, and wetlands were identified within the Action Area. The Carolina Heelsplitter is found in small streams and rivers usually in mud, muddy sand, or muddy gravel substrates along stable, well -shaded stream banks. The perennial streams within the Action Area consist of large cobble and rock, silty substrate, with very ATLAS Environmental, Inc. 338 S. Intermittent streams, ponds, and wetlands within the Action Area do not provide suitable habitat for Carolina Heelsplitter. Therefore, we have determined that suitable habitat for the Carolina Heelsplitter does not exist within the Action Area. Nevertheless, mandated erosion and sediment control measures will be used to further avoid and minimize any potential impacts the proposed activities could have on aquatic resources downstream of the project site. As a result of our findings (reported herein) and the findings of two previous site evaluations in October 2022 and November 2023, we have proposed a "No Effect" determination for the Carolina Heelsplitter and a "No Adverse Modification" determination to its designated Critical Habitat. 4.4 Monarch Butterfly The Action Area for Monarch Butterfly is defined as the project site. According to the USFWS IPaC and NCNHP websites, the Monarch butterfly is known, or believed, to occur in proposed project County. No occurrences of Monarch butterflies were observed within the Action Area. Because the Monarch butterfly is a Candidate species and not yet listed or proposed for listing, there generally are no ESA protections or Section 7 (Interagency Cooperation) requirements for Candidate species. 4.5 Schweinitz's Sunflower The Action Area for Schweinitz's Sunflower for this project is defined as the project site. According to the USFWS IPaC and NCNHP websites, Schweinitz's Sunflower is known, or believed, to occur in the proposed project County, but there are no known occurrences of the species within the Action Area. The optimal survey window for Schweinitz's Sunflower is late August through October. Atlas Environmental staff thoroughly traversed all areas within the project site. Schweinitz's Sunflower occurs in forest openings and along roadside rights -of -way, maintained power lines and other utility rights -of -way, edges of thickets and old pastures, clearings and edges of upland oak -pine -hickory woods, and other sunny or semi -sunny habitats where disturbances (e.g., mowing, clearing, grazing, blow downs, storms, frequent fire) help create open or partially open areas for sunlight within the project site. The Action Area consists of residential home sites and active agricultural fields with small, forested areas interspersed throughout. An electric utility line runs along Bethel Church Road on the Northern portion of the property. The residential homesites and associated lawns are maintained and mowed frequently, and do not provide suitable habitat for Schweinitz's Sunflower. The agricultural fields are actively planted in various crops and do not provide suitable habitat for Schweinitz's Sunflower. The forested areas do not provide suitable habitat for Schweinitz's Sunflower. Edge habitats between agricultural and forested areas are maintained as part of the agricultural crop, and do not provide suitable habitat for Schweinitz's Sunflower. The utility line corridor is well maintained and mowed and does not provide suitable habitat for Schweinitz's Sunflower. Roadside edges are mowed and maintained frequently, and do not provide suitable habitat for Schweinitz's Sunflower. No individual occurrences of Schweinitz's Sunflower were observed to exist within the Action Area during the site assessment. As a result of ATLAS Environmental, Inc. 338 S. No Federally listed Endangered or Threatened species were observed within the Action Area. No Federally listed species are expected to be adversely affected, or Critical Habitat adversely modified, by the proposed project. No other Federally listed Endangered or Threatened species or their habitats were observed within the Action Area. 5.2 Permitting If impacts to regulated waters or wetlands are required to develop the property, Condition 18 (Endangered Species) of Nationwide Permit (NWP) 29 is applicable as follows: (a) No activity is authorized under any NWP which is likely to directly or indirectly jeopardize the continued existence of a Threatened or Endangered species or a species proposed for such designation, as identified under the ESA, or which will directly or indirectly destroy or adversely modify the critical habitat of such species. No activity is authorized under any NWP which "may affect" a listed species or critical habitat, unless ESA Section 7 consultation addressing the effects of the proposed activity has been completed. Direct effects are the immediate effects on listed species and critical habitat ATLAS Environmental, Inc. 338 S. Indirect effects are those effects on listed species and critical habitat that are caused by the NWP activity and are later in time, but still are reasonably certain to occur. (b) Federal agencies should follow their own procedures for complying with the requirements of the ESA. If pre -construction notification is required for the proposed activity, the Federal permittee must provide the district engineer with the appropriate documentation to demonstrate compliance with those requirements. The district engineer will verify that the appropriate documentation has been submitted. If the appropriate documentation has not been submitted, additional ESA Section 7 consultation may be necessary for the activity and the respective Federal agency would be responsible for fulfilling its obligation under Section 7 of the ESA. (c) Non -Federal permittees must submit a pre -construction notification to the district engineer if any listed species or designated critical habitat might be affected or is in the vicinity of the activity, or if the activity is located in designated critical habitat, and shall not begin work on the activity until notified by the district engineer that the requirements of the ESA have been satisfied and that the activity is authorized. For activities that might affect Federally listed Endangered or Threatened species or designated critical habitat, the pre- construction notification must include the name(s) of the Endangered or Threatened species that might be affected by the proposed activity or that utilize the designated critical habitat that might be affected by the proposed activity. The district engineer will determine whether the proposed activity "may affect" or will have "no effect" to listed species and designated critical habitat and will notify the non -Federal applicant of the Corps' determination within 45 days of receipt of a complete pre -construction notification. In cases where the non -Federal applicant has identified listed species or critical habitat that might be affected or is in the vicinity of the activity, and has so notified the Corps, the applicant shall not begin work until the Corps has provided notification that the proposed activity will have "no effect" on listed species or critical habitat, or until ESA Section 7 consultation has been completed. If the non -Federal applicant has not heard back from the Corps within 45 days, the applicant must still wait for notification from the Corps. (d) As a result of formal or informal consultation with the FWS or NMFS the district engineer may add species -specific permit conditions to the NWPs. (e) Authorization of an activity by an NWP does not authorize the "take" of a Threatened or Endangered species as defined under the ESA. In the absence of separate authorization (e.g., an ESA Section 10 Permit, a Biological Opinion with "incidental take" provisions, etc.) from the FWS or the NMFS, the ESA prohibits any person subject to the jurisdiction of the United States to take a listed species, where "take" means to harass, harm, pursue, hunt, shoot, wound, kill, trap, capture, or collect, or to attempt to engage in any such conduct. The word "harm" in the definition of "take" means an act which actually kills or injures wildlife. Such an act may include significant habitat modification or degradation where it actually kills or injures wildlife by significantly impairing essential behavioral patterns, including breeding, feeding or sheltering. (f) If the non -Federal perm ittee has a valid ESA Section 10(a)(1)(B) incidental take permit with an approved Habitat Conservation Plan for a project or a group of projects that includes the proposed NWP activity, the non -Federal applicant should provide a copy of that ESA Section 10(a)(1)(B) permit with the PCN required by paragraph (c) of this general condition. The district engineer will coordinate with the agency that issued the ATLAS Environmental, Inc. 338 S. Sharon Amity Road #411 Charlotte, North Carolina 28211 1 704-512-1206 (o) / 828-712-9205 (m) www.atlasenvi.com I Offices in Asheville and Charlotte 16 ESA Section 10(a)(1)(B) permit to determine whether the proposed NWP activity and the associated incidental take were considered in the internal ESA Section 7 consultation conducted for the ESA Section 10(a)(1)(B) permit. If that coordination results in concurrence from the agency that the proposed NWP activity and the associated incidental take were considered in the internal ESA Section 7 consultation for the ESA Section 10(a)(1)(B) permit, the district engineer does not need to conduct a separate ESA Section 7 consultation for the proposed NWP activity. The district engineer will notify the non -Federal applicant within 45 days of receipt of a complete pre -construction notification whether the ESA Section 10(a)(1)(B) permit covers the proposed NWP activity or whether additional ESA Section 7 consultation is required. (g) Information on the location of Threatened and Endangered species and their critical habitat can be obtained directly from the offices of the USFWS and NMFS or their world wide web pages at http-//www.fws.gov/ or http-//www.fws.gov/ipac_and http-//www.nmfs.noaa.gov/pr/species/esa/ respectively. 5.3 Conclusion This concludes the subject project review and report of findings for Federally listed Endangered, Threatened, and Candidate species.
