Hi Zach, Below is from the engineer for the project regarding the fish. I am still working on the NEPA document update. Regarding the fish, the plan is to kill all of them off with Rotenone and then dispose of them. Yes it may take more than a day and a lot more truckloads than they originally may have thought, but they will be doing population sampling to get a reasonable estimate of the biomass. The dead fish will not remain in the lake long enough to get stinky, it will be the empty lake bottom later that will smell really bad. All fishing take restrictions have been removed to help pull down that population number as well. Note - No fish will migrate out of the pond as we are lowering except a possible few that are literally sucked into the drain valve when the flow velocity is beyond their swimming speed, so we will take the lake down as quickly as possible while remaining within the safe limits. I would say you can certainly respond to the items that you can now, and I can add them to my review files. 1. Do you have a timeline for the NEPA review/document? I will need to discuss with my Central Office regarding next steps pending the status of the document. 2. 1 received comments back from the NC WRC. Please also provide further information on the comments/concerns in your response for our files: "Re -locating fish is usually not approved because of the transport of disease and parasites, etc, and it would technically be viewed as a stocking and require a permit from us (which we would likely not approve). I've seen some people bury the fish if they are dredging. I would recommend dewatering as slow as possible, maybe slower than they currently have outlined, to allow some to naturally emigrate out of the system or get scooped up by birds. I do think it might take them more than a day to harvest dead fish and more than a few boats, but I guess that is up to them to decide the logistics. It will be a lot of fish. They may need to do more than one round of treatment or have a method on hand to remove fish after the full dewatering. So as you can see, there are no real good options, but I do think this method will work, it will just be stinky! If you have any questions, please let me know. Hi John, I have completed my review of the Repair NIH Dam Inlets and Outlets 111 TW Alexander Dr Protect Application (DWR# 20240314) and I need additional information to continue. Please provide a response to the below items within 30 days. Please be advised that this application will be considered incomplete and on hold until a response is received. Buffer Impacts: 1. While shoreline stabilization buffer impacts fall under the table of uses as allowable, the most recently submitted PCN has impact quantities listed as 0 square feet. ■ Please update the buffer impact table (Section 6b-6g) to reflect the buffer totals for Shoreline Stabilization: XX SF temporary & XX SF permanent. Please also indicate for the type of stabilization (wall vs riprap vs vegetation). Your project also proposes the need for access through the buffer area to perform the necessary work for stabilization. Typically, this activity can fit under temporary roads in the table of uses [15A NCAC 02B .0267 (9)]. Please indicate the total square footage proposed for access disturbance. ■ For amounts below 2500 SF, it is considered exempt, and does not require authorization as part of the letter. ■ For amounts greater than 2500 SF, it is considered allowable, and I will need to include these impacts as part of the letter. Wetland Impacts: 1. Permanent impact totals to wetlands are described in your PCN as 0.447 acres. You also indicate in Section E2 that mitigation is required and will be completed via payment to the in -lieu fee program. I am unable to find a Statement of Availability (SOA) in the provided documents. Please provide an SOA for the 0.447 acres of wetland mitigation required by DWR. NC Wildlife Comments: Please be advised that I have reached out for comment from the NC WRC regarding the proposed plan for Rotenone use and fish disposal. I will pass along any comments or concerns they may have once received. • NEPA —Environmental Document: Section G.I. of the submitted PCN indicates that the project is utilizing public finds or public land. It also indicates that the project requires preparation of an environmental document and that the document review has not been finalized by the State Clearing House. ■ Per the limitations outlined in 15A NCAC 01C .01071 " (a) If an environmental document is required under NCEPA, DEQ shall not undertake an action until the environmental document for that action is final" and "(b) If DEQ is considering a proposed action for which an environmental document is to be or is being prepared under NCEPA, DEQ shall promptly notify the applicant that DEQ cannot take final action until the environmental document is completed and available for use as a decision -making tool.
