Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). This final permit includes no major changes from the draft permit sent to you on December 21, 2004. Please make special notice that this permit includes an effluent limit for Total Residual Chlorine, but this limit will not become effective until October 1, 2006 (18 months following the effective date of the permit). If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. Possible toxic impacts to surface waters: Past DWQ studies have shown WTP effluents to exhibit toxic characteristics. Spray Irrigation: Insufficient area to handle waste flow. b. Connect to regional sewer system: The applicant utilizes a nearby Charlotte - Mecklenburg Utilities (CMU) sewer line as a "backup" to the stream discharge. The WWTP serving the adjacent sewer line has limited capacity, therefore, a discharge to the sewer line is only used when the permittee is cleaning clarifier weirs and troughs when effluent quality would most likely exceed permit limitations. Such being the case, if the WTP is capable of complying with the effluent limitations set forth by the Division, and a total discharge to the sewer line may result in overloading and possibly operational disruption at the WWTP, then a continued discharge to surface waters is the most viable option. C. Subsurface: Insufficient area for the amount of wastewater that is generated. PART IV - EVALUATION AND RECOMMENDATIONS The applicant, CMU, is requesting the renewal of the subject permit to discharge wastewater (filter backwash water) from a WTP located in Mecklenburg County. The WTP was built with an initial treatment capability of 18.0 MGD with an ultimate design flow of 108 MGD (current treatment capability is 25.3 MGD). There have been no changes to the W WT system which serves this WTP since the permit was originally issued nor are any proposed in this renewal. Pending receipt and approval of the draft permit, it is recommended that the permit be renewed as requested. During higher production rates at the facility solids maybe removed during this time as well. The solids are removed from the facility by tanker truck and then land applied. The solids are removed under contract by Synagrow, Corporation. The Utility department has a contract with them for all of the solids handling for both water treatment and wastewater treatment.
