Yes, rip is definitely required to abate erosion and scouring at 16% slope or greater.

Attached is a document C-1. There is a “Pond Low Flow Outfall Oriface/Pipe” detail plan on this sheet (middle right). The is also a
“Typical House Driveway Cross-Section” (bottom middle) and “Rip Rap Ditch (16% Grades or Better)” (bottom right). The rip rap is only
being used on slopes that are 16% or greater.
Larry,
Will you please confirm that rip rap will only be used in areas that are 16% or greater slope – see Joey’s #2 below? Is rip rap a
requirement for ditches with slopes 16% or greater? Is it your experience that rip rap is needed to prevent erosion on slopes 16% or
greater?
Rosemary/Derrick,
Please see item #1 below. What is the timeline for you all to construct your house? This needs to be completed before March 2026
when your permit approvals will expire. Are you able to meet this timeline? You should be grandfathered until March 2027 to get the
work completed so if March 2026 does not work will having another year be helpful?

Ms. Robertson,
On May 8, 2024, the Division of Water Resources (Division) received your application requesting an after-the-fact 401 Water Quality
Certification from the Division for the subject project. The Division has determined that your application is incomplete and cannot be
processed. The application is on-hold until all of the following information is received:
1. The Division requires that projects avoid and minimize impacts to streams to only those necessary for the project. As
discussed during our April 5, 2024, site visit, please provide a timeline for the proposed additional residence to justify impact
S6 for 80 feet of culvert impacts. [15A NCAC 02H .0506(b)(1)]
2. As discussed during our April 5, 2024, site visit, the stormwater management plan does not meet the requirements for low
density projects. Per the definition of low density projects found in 15A NCAC 02H .1003(2), stormwater that cannot be
released as dispersed flow shall be transported by vegetated conveyances. A minimal amount of non-vegetated conveyances
for erosion protection or piping for driveways or culverts under a road shall be allowed when it cannot be avoided. The Paving,
Grading & Drainage Plan (Sheet C-1) shows stormwater transported through rip rap lined swales. Please change plans to

vegetated swales or provide an explanation of why rip rap swales are required for erosion protection, including an explanation
of why the amount of rip rap cannot be reduced. Alternatively, a complete Stormwater Management Plan can be provided for
review demonstrating that the project will not cause a degradation of water quality in the receiving stream. [15A NCAC 02H
.0506(b)(3)]
3. The application states that low flow orifices will be installed within each pond. Please provide plans for this activity so that
potential impacts to water quality may be reviewed. [15A NCAC 02H .0502(a)(9)]
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the proper co nsideration
of the application. Please provide your response by August 2, 2024. If all of the requested information is not received, the Division will
be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the
Division for approval, including a complete application package and appropriate fee.
