In accordance with the application for a discharge permit received on December 29, 1995, the Division is
forwarding herewith the subject NPDES permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US
Environmental Protection Agency dated December 6,1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable
to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following
receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the
North Carolina General Statutes, and filed. with the Office of Administrative Hearings, Post Office Drawer
27447, Raleigh, North Carolina 27611-7447) Unless such demand is made, this decision shall be final and
binding.
Please take notice this permit is not transferable. Part 11, E.4. addresses the requirements to be followed
in case of change in ownership or control of this discharge.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.

SUPPLEMENT TO PERMIT COVER SHEET
Pender County Schools
is hereby authorized to:
1. Continue to operate a O.O1,V GD wastewater treatment facility consisting of a septic
tank and sand filter located at Penderlea School, P.O. Box 5, Burgaw, North
Carolina, Pender County (See Part III of this Permit), and
2. After receiving an Authorization to Construct from the Division, construct and
operate a facility capable of meeting the final effluent limitations specified in this
permit, and
3. Discharge from said treatment works at the location specified on the attached map
into Crooked Run which is classified Class C-Swamp waters in the Cape Fear
River Basin.

8. Topography: Flat farm land within this area. The existing
facility is located approximately 65 feet MSL which is not
considered to be within the 100 year flood zone.
9. Location of nearest dwelling: The closest house is located
approximately 1000 ft. East -Southeast of the facility
10. Receiving stream or affected surface waters: Crooked Run
tributary to Sills Creek in the Cape Fear River Basin.

PART II - DESCRIPTION OF DISCHARGE AND TREATMENT WORKS
Pertinent Information:
a. Volume of wastewater to be permitted:
The Short Form D indicates flows between 5000 and
9999 gpd. No other information was provided as
part of this submittal. The writer considers the
following information to be pertinent: Holt Hosiery
Mill (150 employees x 25 gal/employee, all domestic),
Penderlea School (550 kids & staff x 12 gal/person)
Average daily flow - 10,350 gpd
b. What is the current permitted capacity of the wastewater
treatment facility? Not permitted
c. Actual treatment capacity of the current facility?
Unknown
d. Date and construction activities allowed by previous
Authorizations to Construct issued in the previous two
years: None
e. Please provide a description of existing or substantially
constructed wastewater treatment facilities: Large
septic tank, sand filter (approx. 80ft. by 100 ft.) with
surface splash plates and underdrain collection system
that discharges to Crooked Run.
Please provide a description of proposed wastewater
treatment facilities: The Region did not receive
submittal information other than the Short Form D, P&E
acknowledgement letter, and John Bauer's cover letter.
Due to the size of the stream, a tertiary plant (capable
of producing 5 and 2 limits is needed. The Region would
recommend technology such as a septic tank, recirculating
sand filter, chlorine feed/dechlorination treatment
system or alternative disinfection method in order to
comply with the basinwide management plan.
g. Possible toxic impacts to surface waters: The existing
system may produce toxic concentrations of ammonia
nitrogen.
h. Pretreatment Program: Not a POTW
2. Residuals handling and utilization/disposal scheme:
There is no treatment system conceptualization presented for
the Region to evaluate.
3. Treatment plant classification: There is no treatment system
conceptualization presented for the Region to rate. This
action will be performed during the A to C evaluation.

PART III - OTHER PERTINENT INFORMATION
1. Is this facility being constructed with Construction Grant
Funds or are any public monies involved? Unknown
2. Special monitoring oar limitations (including toxicity)
requests: The facility should be monitored in accordance with
the facility rating for frequency. Monitored parameters should
included BOD5, TSS, N113-N, DO, fecal coliform bacteria,
chlorine residual, temperature, and conductivity.
3. Important SOC, JOC or Compliance Schedule dates: None
4. Alternative Analysis Evaluation: Has the facility evaluated
all of the non -discharge options available? Yes. Please
provide regional perspective for each option.evaluated.

The writer has enclose � a copy of the consultant's alternative
engineering analysis Please disregard the writer's
annotations. The Region concurs with the result that an NPDES
permitted system is far more economical than other
nondischarge options.
5. Other Special Items: None
PART IV - EVALUATION AND RECOMMENDATIONS
The Regional Office staff were responding to an animal
operations complaint in May 1993 when the treatment system was
noticed to be in need of attention. Additional investigations
disclosed that the system was not permitted. It has been in service
since the late 1930's. Logically, there is no need to rush this
project through now, but there is truly a need to permit a new
tertiary treatment plant capable of 5 and 2 limits in accordance
with Division policy for low flow streams. Crooked Run exhibits
zero 7Q10 and slight 30Q2 flow characteristics. The Region would
specifically recommend a septic tank, recirculation sand filter,
chlorine contact/feed treatment system.
It is recommended that NPDES Permit No. NC0085481 be prepared
and place at public notice. If no significant adverse public
comments are received, it is recommended that NPDES Permit No.
NC0085481 be issued to Pender County for the operation of the
treatment plant serving the Penderlea School and Holt Hosiery Mill
in accordance with the basinwide permitting strategy.
