I actually just got off the phone with my Client(Bill Treweek) a few minutes ago. He has an attorney working on the NCSOS documents and thinks it will be corrected either today or tomorrow. He even mentioned that they may get on of the other members to sign the form. At any rate, I think we should request a one week extension to make sure this is handled in the time frame. I will let you know the minute it has been corrected.That allows us some time to get a different Member signature if it comes down to that. My recommendation was to have it corrected on NCSOS because that info should be right anyway and you can process the forms as submitted. Let me know if you need anything else from me! After additional deed research,it turns out that the existing cul-de-sac is not part of the property being developed for the Highlands, Section II. Castlebury(or its developer) owns the cul-de-sac. I showed it as being part of this project because that is how it was given to me initially. Mr.Treweek has confirmed that he does not own the cul-de-sac.So,the only way I see to handle this is to remove the cul-de-sac property from the project limits and recalculate the areas. This will not change my Lot BUA's because I allowed for future and I can take it out of there. It will affect the areas minimally anyway. Let me know if you have a problem with this approach.This is a little different than we discussed, but appears to be the correct way to handle it. I apologize for any confusion. We have had to sort out a mess that someone else made,which I am sure you are familiar with. I still plan to go by NCDENR and look at the Castlebury files today because I need to see them anyway. I also realize that there may be permitting issues in adjacent subdivision(s)which my Client is not involved in. My Client does, however, know how to get in contact with the Castlebury developer if that will help. As of now, I intend to have everything re-submitted before the initial deadline. An adjacent subdivision, Kingsbridge II, Sections 1 through 4, 4A, 5 & 6 is in various stages of construction and permitting. The original phase of The Highlands at Queens Creek is permitted under Stormwater Permit No. SW8 070803 and Sedimentation/Erosion Control Permit ONSLO-2008- 051. It is also adjacent to the proposed project. The Highlands at Queens Creek, Section II will consist of a total of 46 residential lots. This project is located adjacent to Inverness Drive which is approximately 1.5 miles north/northwest of the intersection of Queens Haven Road (SR 1576) and Queens Creek Road (SR 1509). The total property area within Section II is approximately 68.27 acres. Since the project lies in close proximity to Queens Creek, the built-upon area will be limited to 12%. As previously mentioned, this will be a low density project that utilizes grass swales to accommodate stormwater runoff. Roadside swales will collect runoff from streets, drives and other impervious areas. Runoff will flow to lot line swales, where it will be effectively infiltrated. A 50 foot vegetative buffer is provided between the non-direct discharge areas and surface waters. There is a substantial amount of wetlands at this site. However, no wetlands will be disturbed. A 50 foot buffer is provided between any development and surface waters. The project drains to Queens Creek (SA/HQW), which is part of the White Oak River Basin. It is anticipated that a total of approximately 24 acres will be disturbed during construction. This includes land disturbance for all streets, houses, yards, drive, septic areas and utilities. Erosion and sedimentation control measures will consist of skimmer basins, silt fence and vegetative filters. Water service will be provided for each lot by ONWASA. Wasterwater disposal will be treated in either an on-site septic system, off-site larger septic system or at a nearby private treatment plant. However, Neighbor Home and Realty, Inc is not registered with the NC SOS. The application and supporting documentation indicate that Neighborhood Homes & Realty, Inc is a member. Please confirm the member of Northern Investors Group, LLC. This can be done by correcting the documentation filed with the NC SOS, by providing additional official documentation from the LLC, or one of the other members of Northern Investors Group, LLC listed with the NC SOS can sign the paperwork. 3. Due to the relatively minor nature of these comments, the express additional information review fee has been waived. 4. Kingsbridge SW8 890414—Plan Revision My notes had indicated this would be submitted to the Express program. Kyle had it prepared to add to the current application in house. This revision cannot be combined with the application in house due to the fact that the current application in house has already been reviewed once and the requested additional information has been submitted. A separate plan revision will need to be submitted. In order to submit a plan revision to following items will be needed: • A plan revision form with the original signature of the current permittee (the HOA) • A cover letter describing the revisions • Two copies of the plans The plan revision may be mailed in to the regular program for free or an express submittal may be scheduled ($500 fee). Kingsbridge—the 2 new phases The following items were noted during the Express submittal meeting and need to be addressed prior to acceptance into the Express program: • Remove the overlap in project areas between the two Kingsbridge permits. The road improvements on the lot ROB within the SW8 890414 permit was also included in this project area. • The NHW/MHW line needs to be confirmed by DCM • The 50' buffer from the NHW/MHW needs to be delineated for those lots within this section of the subdivision. • The coastal wetlands need to be confirmed by DCM • Add items or conditions to the O&M agreement specific to the operation and maintenance of the proposed energy dissipater device. Once the representative with DCM is contacted and a better timeline is provided for the confirmation of the NMH/MHW and the coastal wetlands, Kyle will need to contact us to schedule a new submittal date to mail in or drop off the project. Highlands Phase II—the new phase The following items were noted during the Express submittal meeting and need to be addressed prior to acceptance into the Express program: • Remove the overlap in project areas between the two Highland permits. I don't imagine it should be that complicated once you sit down to look at it. You know the total amount of BUA. You can identify where runoff from the BUA is going so you know how much is directed to a swale or pipe. You should be able to quantify the vegetated areas to see if they match the disconnected requirements. If it does get too cumbersome,you certainly have the second option of providing effective infiltration using one of the 3 options listed in the guidance.
