SAW-2020-00632, DWR Project No. 2020-1654v2 Madison County, North Carolina Dear Mr. Jones and Ms. Goss, A permit application requesting written authorization for impacts associated with the Mulberry Gap Farms project was submitted by ClearWater Environmental Consultants, an EnviroScience company (ClearWater), on behalf of Mulberry Farm — Madison LLC on January 27, 2022. The US Army Corps of Engineers (Corps) issued the requested 404 permit on February 15, 2023, and the NC Division of Water Resources (DWR) issued the requested 401 Water Quality Certification on September 22, 2022. On May 31, 2023, ClearWater submitted a permit modification to remove stream impact S1 (41 LF) for a traffic turnaround change, remove stream impacts S8-S9 (193 LF — 0.018 AC) due to site redesign, and to authorize stream enhancement for Thomas Branch. This permit modification was authorized by the Corps on August 16, 2023, and the DWR on July 18, 2023. Mulberry Farm and the project team have finalized detailed plans associated with a small reach of Thomas Branch to be relocated as well as two additional culvert crossings and a culvert replacement. These impacts are below the threshold for stream and wetland mitigation. The requested changes as are follows: Two additional culvert stream crossings are being requested and are shown as S36 (40 LF; 0.001 AC) and S37 (20 LF; 0.001 AC) on the attached plan sheet (L-1.13). The applicant had been planning on using the existing road, however, the utilities and cabin infrastructure are not compatible due to the constraints including width of the road and proximity to the stream. The locations of these proposed culverts were previously installed as temporary construction access culverts. As stated in the previous permit modification request, the applicant included stream impact S1 (41 LF) to facilitate a cul-de-sac turnaround for traffic. Further inspection by NCDOT determined that a T-turnaround was sufficient. As a result, the applicant is going to replace (maintenance) the existing 80 LF culvert with a new 80 LF culvert. Since the prior permit modification in May 2023, further inspections raised concerns about a small reach of Thomas Branch below this culvert and its proximity to the road. The existing channel was historically entrenched and straightened, and its current alignment is very close to the existing road (see Sheet L-1.13 and Headwaters Eng. Plan). By relocating the outlet and building an appropriately designed natural channel, the stream will be enhanced with wider vegetated buffers, wider bankfull width, and the existing road will be less likely to be washed out or fail in the future. This realignment will result in 130 LF of permanent stream impact to fill in the old channel (S38, 0.009 AC) and permanent wetland impact W13 (0.008 AC) for a small section of wetland that will intersect with the realigned stream channel.
