Please provide the following information within 30 days. Please note that the application will be on hold until a complete response is received: It appears that Lots 66, 58, 59, 51, 52, 36, 38, 39, and 29 contain significant stretches of stream or wetland (Lot 66). Are these lots planned to be developed? If so, please provide building envelopes for these lots on the site plans to demonstrate these lots are able to be developed without additional jurisdictional impacts. Please see attached plans with building envelopes for each lot. Lots 35-36 will need a stream crossing for access. That crossing would be sized for a shared single driveway. The crossing will utilize a bridge to avoid impacts or a traditional culvert that will be permitted. The applicant acknowledges that additional impacts, should they be necessary, are cumulative to the current proposed impacts. The remaining lots will be developed without impacts. There may be a few lots with septic fields across a stream, however, those would be installed utilizing bores under the streams to avoid any additional impacts. 2. Please be advised that deed notifications or other legal language that clearly indicates to future owners that there are jurisdictional features and/or riparian buffers and that some lots may not be buildable as planned, or at all, without impacts that may not be approved by the regulatory agencies will be a condition of the 401 Water Quality Certification. If you have questions or concerns regarding this matter, please contact me. The applicant acknowledges the need for a deed notification to inform perspective buyers of jurisdictional waters that could limit or constrain development of lots that contain streams and/or wetlands and require permits prior to any impacts to them.
