Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit This pemrit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
This final permit includes no major changes from the draft permit send to you on October 24, 2007.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of
this letter. This request must be in the fort of a written petition, conforming to Chapter 150B of the North Carolina
General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North
Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit This permit does not affect the legal requirements to obtain
other permits which may be required by the Division of Water Quality or permits required by the Division of Land
Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be
required.

is hereby authorized to discharge wastewater from a facility located at
Captain Neill's Seafood
508 North Road Street
Columbia
Tyrrell County
to receiving waters designated as an unnamed tributary to Albemarle Sound in subbasin 03-01-53 of the
Pasquotank River Basin in accordance with effluent limitations, monitoring requirements, and other
conditions set forth in Parts I, II, III and IV hereof.
This permit shall become effective February 1, 2008.
This permit and authorization to discharge shall expire at midnight on December 31, 2012.

All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby revoked, and as of this
issuance, any previously issued permit bearing this number is no longer effective. Therefore, the exclusive authority to operate
and discharge from this facility arises under the permit conditions, requirements, terms, and provisions described herein.
Captain NeiUls Seafood, Inc. is hereby authorized to:
1. * Continue to operate and discharge wastewater from an oyster processing facility through Outfalls
001, 002 and 003 located at Captain Neill's Seafood (3715 Soundside Road; Columbia) in Tyrrell
County.
2. Discharge from said facility into an unnamed tributary to Albemarle Sound (see attached map), a
class SB water in subbasin 03-01-53 of the Pasquotank River Basin.

A. (I.) EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS
During the period beginning on the permit effective date and lasting until expiration, the Permittee is authorized
to discharge oyster processing wastewaters from Outfall 001, Outfall 002, Outfall 003. Except for Flow (See
Footnote 1) such discharges shall be limited and monitored by the Permittee Outfall 001 as specified below:

1. Flow shall be an Estimate of Total Flow = Estimated Outfall 001 + Estimated Outfall 002 + Estimated
Outfall 003. Outfall 001 shall be representative of Outfall 002 and Outfall 003.
Effluent shall not contain floating solids or foam visible in other than trace amounts.
This permit contains Special Operating Conditions [See Special Condition A. (2.)].
There shall be no discharge from this facility of fish offal such as oyster parts, crab parts, or fish parts.
There shall be at no time an oily film or sheen on the surface of the common channel water traceable to
the permitted discharge water or on the surface of the 3 permitted outfalls flows.
A. (2.) SPECIAL OPERATING CONDITIONS
Best Management Practice (BUT) Requirements:
a. Effluent shall not contain floating solids. Foam shall not be visible in other than trace amounts.
b. Permittee shall instruct employees in cleanup practices and provide resources to implement, at
a minimum, such practices that reduce wastewater volume and wastewater constituents, as
follows:
i. Employees shall perform dry cleanup prior to washing down the facility;
ii. Permittee shall instruct personnel to stop water flow through idle equipment;
iii. All process and washdown equipment shall be fitted with high pressure/low
volume nozzles;
iv. All on -demand water delivery hoses shall be fitted with automatic shut-off
nozzles to limit water use.

General:
Oyster Packing Facility, no changes since last permit issuance. Various sources of
untreated wash down water/process water direct through three outfall points to a
common channel that drains into Albemarle Sound. Estimated flow is less than 3,500
gpd. Maximum production is less than 1000 lbs/day and qualifies the discharge as
BMPBPJ permit. Existing permit Limits defined for pH. Water class is SB. Narrative
Special Conditions included.
Review of DMR data did not warranty any monitoring changes.
Concerns:
Oil and Grease, currently monitoring only. Need to reinforce "no oily film or sheen"
should be visible in outfall or in common channel traceable to the Oil or Grease being
discharged.
pH Limits, currently in permit.
Total Flow Estimate not inclusive of all three outfalls.

1. Continue all monitoring parameters, limits, and Special Conditions as in existing
permit.
2. Edit requirements to state "no oily film or sheen" should be visible in outfall or in
common channel as a result of Oil or Grease in outfalls.
3. Define Total flow = flow outfa1100I + flow outfa11002 + flow outfa11003
Rational For Changes:
Need to reinforce no observable Oil or Grease contamination is allowed to occur. All
previous monitoring requirements and limits to continue.
Flow estimate should represent total of all flows.
