Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum
of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9,
1994 (or as subsequently amended).
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within
thirty (30) days following receipt of this letter. This request must be in the form of a written
petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the
Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714).
Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division
may require modification or revocation and reissuance of the permit. This permit does not affect
the legal requirements to obtain other permits which may be required by the Division of Water
Quality or permits required by the Division of Land Resources, the Coastal Area Management Act
or any other Federal or Local governmental permit that may be required.

forth in Parts I, II, III and IV hereof.
This permit shall become effective September 1, 2006
This permit and authorization to discharge shall expire at midnight on December 31, 2007.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked, and as of this issuance, any previously issued permit bearing this number is no longer effective.
Therefore, the exclusive authority to operate and discharge from this facility arises under the permit
conditions, requirements, terms, and provisions described herein.
Captain Neill's Seafood Inc.
is hereby authorized:
1. to continue to discharge wastewater from an oyster processing facility through Outfalls 001, 002
and 003 located at Captain Neill's Seafood Inc., 3715 Soundside Road, Columbia, NC in Tyrell
County; and
2. to discharge from said facility into an unnamed tributary to Albemarle Sound (see attached map), a
waterbody classified SB waters within the Pasquotank River Basin.

A. (L) EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS
During the period beginning on the permit effective date and lasting until expiration, the Permittee is authorized
to discharge oyster processing wastewaters from Outfall 001. Such discharges shall be limited and monitored by
the Permittee as specified below.

EFFLUENT LMTATIONS AND MONITORING REQUIREMENTS —
SPECIAL CONDITIONS
A. (2.) SPECIAL OPERATING CONDITIONS
Best Management Practice (BMP) Requirements:
a. Effluent shall not contain floating solids. Foam shall not be visible in other than trace
amounts.
b. Permittee shall instruct employees in cleanup practices and provide resources to implement,
at a minimum, such practices that reduce wastewater volume and wastewater constituents,
as follows:
i. Employees shall perform dry cleanup prior to washing
down the facility;
ii. Permittee shall instruct personnel to stop water flow
through idle equipment;
iii. All process and washdown equipment shall be fitted with
high .pressure/low volume nozzles;
iv. All on -demand water delivery hoses shall be fitted with
automatic shut-off nozzles to limit water use.

Summary
This is an existing oyster packing facility that has been in operation without a permit. Oysters are
shucked and packed. Process wastewaters generated consists of 1667 gpd from the washing
operations and 700 gpd from packing operations. There is no treatment of the process wastewaters.
The washwaters are discharge through three outfalls to a channel that drains to the Albemarle Sound.
The three outfalls discharge basically the same type of wastewaters, process and packing blended
together. Total production is 360 pounds per day. Effluent guidelines do not apply to this particular
facility since their production is below 1000 pounds per day. There are no reported water quality
issues in the Albemarle Sound in this subbasin.
EFFLUENT LIMITS DEVELOPMENT
Monitoring is proposed for Flow, Total Suspended Solids, and Oil and Grease based on BPJ and
similar permits for oyster packing operations. A limit was included for pH based on the water quality
standard for saltwaters. BMPs designed for fish packing facilities are included in the permit.

Dear Ms. Rodriquez:
This is regarding the NPDES Permit for Capt. Neill's Seafood, Inc. in Columbia, North
Carolina. I have enclosed three maps. One is a close up of the plant. One is a map where
you can see the vicinity of the Albermarle Sound. The other is a map of Columbia, I labeled
the roads so that you can have a better idea of where the plant is located. I sent another copy
of the first map that I drew because it shows the outfalls. This plant has been in operation for
25 years with the same outfalls. It has been a fish house and a fish filleting plant. During the
times it operated it used the same outfalls. That emptied into the ditch behind the plant and
then into the Albermarle Sound from there. The wastewater that empties from the plant is
only tap water. The plant cannot be hooked up to a sewer line because it does not run by the
plant. The closest sewer line is about 6 miles away in town. We cannot do drip irrigation
because we only own a small property. If there are any more questions or more information
