(bulk terminal) facility is a bulk handler of materials for export and handles unloading, storage, and loading of solid and liquid phosphate fertilizer. Solid material is handled in partially enclosed conveyors and stored in enclosed storage buildings prior to loading for shipment, and liquid material is pumped to five above ground storage tanks prior to shipment. Potash containing material has recently been shipped from this facility. Per information provided 2/l/2024, PCS does not have any current plans to develop any of the leased area. The land to the north of the Fertilizer A-Frame is not leased by PCS and is owned by the NC Port. It could drain to outfall 100 or 200. Current products onsite include: • Feed Grade Monocalcium Phosphate: Feed phosphates are inorganic salts of phosphoric acid that are extracted from phosphate rock. • Diammonium Phosphate (DAP) 18-46-0: DAP fertilizer is source of phosphorus (P) and nitrogen (N) for plant nutrition. • Monoammonium Phosphate (MAP) 11-52-0: MAP is a widely used source of P and N. • Muriate of Potash (Granular): Other names are Potassium Chloride or Potash; a source potassium and chloride for plant production. • Phosphoric Acid 54%P205: Commonly called Merchant Grade Acid(MGA); liquid product used to produce fertilizer and other industrial products. • DUSTROL: Dust control agent added to products during conveyance to mitigate dust. • Diesel Fuel: Fuel used for front-end loader and other mobile/portable equipment. Page 1 of 8 Nutrien also stated stormwater that is outside the catchment area sheet flows to adjacent areas. Stormwater that is collected in the storage tank containment area is checked for contamination by measuring the pH. Uncontaminated storm water can be directed to the storm water collection system and discharged or pumped to a grassed area and allowed to infiltrate. Contaminated storm water is evaluated for recovery. During the renewal process,Nutrien proposed to add a French drain that covers some of the perimeter around the trailer office at the port. The French drain will connect to a catch basin and then gravity feed to an existing storm drain on their leased property. Nutrien requested that Outfall 200 be removed as a representative sample of the discharge is not possible due to physical conditions (seawater will be present in the drop inlet resulting in a nonrepresentative sample of the discharge). Outfall SW200 will remain in the permit as sampling can be taken upstream of the inlet, or other measures can be taken to capture a sample. Outfall SW001 has been granted ROS for SW002 per the February 2024 inspection report. Per a phone call w/Nutrien representatives 4/29/2024, the outfall 200 pipe is basically in the water and hard to sample and outfall 100 has comingling from Meherrin discharge and an old laydown area and port traffic going to Meherrin building. A new building is going in on north side of plot and outfall 200 has runoff from their building as well as the new building (Nutrien doesn't know for sure what the new building is). Nutrien stated no industrial exposure coming from nutrients from them in outfall 200. There was a sewage lift station added next to the building from an extended sewer pipe in outfall 200 area which Nutrien is concerned about being maintained properly by the Port. Nutrien indicated they are going to request removal of outfall 200, and DEMLR WiRO inspector was going to write a report to Port Authority telling them they need to request adding outfall 200 to their permit. Both permits (the Port modification and Nutrien's renewal)will be processed together. Outfall SW 100: Drainage area consists of phosphate storage buildings and conveyor belts. Outfall is influenced by activities occurring on the adjacent property (North Carolina Port of Morehead City). Additional outfalls: Outfall SW200: Drainage area consists of a phosphate storage building. Outfall is influenced by activities occurring on the adjacent property (North Carolina Port of Morehead City). Per the Port of Morehead City (NCS000173) fact sheet, the drainage area consists of dumpster and piles of scrap wood, stone base, and metal debris. This outfall is being transferred to permit NCS000173. Why Industrial Sites with Stormwater are Subject to a Permit: Federal NPDES regulations define stormwater discharge associated with industrial activity in 40 CFR §122.26 (b)(14) as: "the discharge from any conveyance that is used for collecting and conveying storm water and that is directly related to manufacturing,processing or raw materials storage areas at an industrial plant. The term does not include discharges from facilities or activities excluded from the NPDES program under this part 122. For the categories of industries identified in this section, the term includes, but is not limited to, storm water [sic] discharges from industrial plant yards; immediate access roads and rail lines used or traveled by carriers of raw materials, manufactured products, waste material, or byproducts used or created by Page 2 of 8 the facility; material handling sites; refuse sites; sites used for the application or disposal of process waste waters (as defined at part 401 of this chapter); sites used for the storage and maintenance of material handling equipment; sites used for residual treatment, storage, or disposal; shipping and receiving areas; manufacturing buildings; storage areas (including tank farms) for raw materials, and intermediate and final products; and areas where industrial activity has taken place in the past and significant materials remain and are exposed to storm water. For the purposes of this paragraph, material handling activities include storage, loading and unloading, transportation, or conveyance of any raw material, intermediate product, final product, byproduct or waste product. The term excludes areas located on plant lands separate from the plant's industrial activities, such as office buildings and accompanying parking lots as long as the drainage from the excluded areas is not mixed with storm water [sic] drained from the above described areas." Section 2. Monitoring Information and Compliance History: • September 2018 to November 2023, benchmarks exceeded for: o SW001: TSS 3x, total phosphorus 15x, total nitrogen 5x, COD 9x o No benchmark for ammonia nitrogen in previous permit, but historical data has exceedances of new benchmarks o No monitoring data provided for SW002 as permittee states in renewal application they were previously granted ROS • Per letter dated 5131/2022, facility was granted ROS for SW001 to represent SW002 • Per letter dated 5/31/2022, Tier 2 status was granted relief for SW001 (previously in Tier 2 status) for TSS, COD, and total phosphorus o Facility to return to Tier 1 status until the permit expired • Per an email from DEMLR WiRO (dated 1/22/2024): The state is currently constructing next to PCS, maybe affecting drainage. They also had questions concerning states access that may drive up sampling numbers. • Per the February 2024 inspection report: o No problems except for the commingling of NCSP stormwater with Nutrien stormwater; with the use of the adjacent property, cannot say who is who in the pollution queue. o Line 100 is being impacted by a new guard house and entrance to E&SC plan CARTE- 2023-003 Fertilizer Storage Warehouse in the SW corner of the Nutrien building. There is a sewer connection adjacent to a yard inlet. The future design of the E&SC site plans on an infiltration basin with an overflow structure connecting to line. o Line 200 is being impacted by the Carte-2023-003 during construction. The proposal does have stormwater collection around the new building directed to the western side infiltration pond, but again, the overflow will go to line 100. o The new warehouse will be sharing access road that has Nutrien inlets. This is already an issue with the new gravel storage yard and the fish meal storage building. Evidence of fertilizer product is present around the fish meal building. Nutrien has notified this office of truck traffic going across their permitted areas in the past with concerns of spillage. o Discussed recombining permits with the port, but that has implications further than stormwater issues. o Currently, tier two relief is in place. o Representative outfall status for line 100 to be represented by line 200 can carry over into new permit. • Per the 2018 inspection report: Page 3 of 8 o SDO1 between the bridge and the railway bridge is affected by the conveyor belts. The belts are sprayed with a food grade lignen sulfonate, a common dust control BMP. No process affects SD02. • Per the September 2023 inspection report for the Port of Morehead City (NCS000173): o The fish meal warehouse is being utilized by the port, not Nutrien. Nutrien has complained about the transport between the fish meal warehouse and the southern port area, across Nutrien lease property. This area needs to be evaluated for additional sampling locations. Threatened/Endangered Species: There are numerous threatened and endangered species in the nearby vicinity of the discharge outfalls. See the attached report from the NC Department of Natural and Cultural Resources. Section 3. Proposed Monitoring for Stormwater Discharges: The Division considered potential pollutants from past and present industrial activities and data was submitted for September 2018 to November 2023. Quantitative sampling included pH, TSS, total phosphorus, total nitrogen, TKN, nitrate-nitrite, ammonia nitrogen, COD, and fluoride. Parameters are based on potential pollutants in the drainage area, sampling results, and in some cases, dependent upon future activities (e.g., ash removal through the drainage area). Below is a table of the proposed monitoring for each outfall at the PCS Phosphate, Inc. site. Stormwater benchmarks are numerical action levels for stormwater monitoring. Benchmarks are not effluent limits, and benchmark exceedances are not permit violations. Benchmarks provide facilities a tool for assessing the significance of pollutants in stormwater discharges and the effectiveness of best management practices (BMPs). Benchmark concentrations are intended as guidelines for the facility's development and implementation of the Stormwater Pollution Prevention Plan (SWPPP). Benchmark exceedances require the permittee to increase monitoring, increase management actions, increase record keeping, and/or install stormwater BMPs in a tiered program. The permit establishes a tiered approach to specify actions the permittee must take in response to analytical results above benchmark concentrations. The tiered structure of the permit provides the permittee and DEMLR wide flexibility to address issues that may arise with one or more parameters and/or outfalls. Metals benchmarks are calculated to mimic acute water quality standards and with the guidance of DWR. NC DWR follows established federal procedures for calculating acute standards when developing the benchmarks. Just like the acute standards, metals benchmarks normally reflect one half of the calculated Final Acute Value (the "1/2 FAV"). In most cases, translation into total recoverable values is based on an assumed hardness of 25 mg/L and a total suspended solids (TSS) concentration of 10 mg/L. Acute standards protect aquatic life from negative impacts of short-term exposure to higher levels of Page 5 of 8 chemicals where the discharge enters a waterbody. The Stormwater Permitting Program applies this approach because of the ephemeral nature of rainfall events. The Division may evaluate results to determine if a smaller suite of parameters for some outfalls is adequate to characterize potential pollution or BMP effectiveness. For example, one or more metals or other parameters may serve as an adequate tracer for the presence of ash pollution during disturbance or ash removal in specific drainage areas at this site. For parameters that do not have a stormwater benchmark, the Division may develop a benchmark value if appropriate toxicity data become available or if rising trends in concentrations suggest a persistent source. The Division's maintains that implementation of Best Management Practices (BMPs) and traditional stormwater management practices that control the source of pollutants meets the definition of Best Available Technology (BAT) and Best Conventional Pollutant Control Technology(BCT). The permit conditions are not numeric effluent limitations but are designed to be flexible requirements for implementing site-specific plans to minimize and control pollutants in stormwater discharges associated with the industrial activity. Title 40 Code of Federal Regulations (CFR) §122.44(k)(2) authorizes the use of BMPs in lieu of numeric effluent limitations in NPDES permits when the agency finds numeric effluent limitations to be infeasible. The agency may also impose BMP requirements which are "reasonably necessary" to carry out the purposes of the Act under the authority of 40 CFR 122.44(k)(3). The conditions proposed in this draft permit are included under the authority of both of these regulatory provisions. In essence, the pollution prevention and BMP requirements operate as limitations on effluent discharges that reflect the application of BAT/BCT. Flexibility in Tier Responses: Tier Two actions provide an opportunity for the permittee to propose an alternative monitoring plan for approval by the Region: • Alternatively, in lieu of steps 2 and 3, the permittee may, after two consecutive exceedances, exercise the option of contacting the DEMLR Regional Engineer as provided below in Tier Three. The Regional Engineer may direct the response actions on the part of the permittee as provided in Tier Three, including reduced or additional sampling parameters or frequency. • If pursuing the alternative above after two consecutive exceedances, the permittee may propose an alternative monitoring plan for approval by the Regional Engineer. Page 6 of 8 The permit therefore allows the permittee to petition the Regional Office for monitoring changes sooner than Tier Three (upon any four benchmark exceedances) and gives guidance on one option to take. For example, the permittee may request that mercury only be monitored semi-annually under the tiers, or that only parameters over the benchmark be monitored more frequently. In this way, changes to the monitoring scheme for any outfall could be handled outside of a permit modification. Other Proposed Requirements: • It is standard for Stormwater Pollution Prevention Plan(SWPPP)requirements to include an annual certification that stormwater outfalls have been evaluated for the presence of non- stormwater discharges, and if any are identified, how those discharges are permitted or otherwise authorized. • Requirement to submit a request for permit modification if the facility identifies or creates any new outfalls, removes outfalls, or alters any drainage area that changes potential pollutants. • The Division expects the permittee to apply best professional judgment and consider the safety of its personnel in fulfilling sampling obligations under the permit. • Federal regulations require electronic submittal of all discharge monitoring reports (DMRs). If a state does not establish a system to receive such submittals, then permittees must submit DMRs electronically to the EPA. • Quarterly QualitativeNisual Monitoring to assure regular observation of outfalls throughout year. Section 4. The modifications should better asses the more marine conditions and aid in the monitoring of the discharge, thereby providing a better understanding of potential impacts to receiving waters and wildlife resources, including threatened and endangered species present in the area. Outfall 200 on the west side of the property drains roof drainage from phosphate storage building and Hwy 70 drainage.The north side of the 200 line will now receive drainage from the proposed lease area B (per application map)that has been developed by NC State Ports. NCSP has constructed a fertilizer warehouse (CARTE-2023-003)that has a stormwater system that is designed to catch SW from their site.The 1 infiltration basin has an overflow pipe leading to Line 200 (unclear on both plans).The entrance has been rehabilitated with a new guard gate. Grading was not shown on the erosion control plan for the access road and drainage is unclear if road storm runoff will go to the old system or new system from the plans.Access to the rear entrance of the Nutrien warehouse has been cutoff from the guard gate and an additional fencing near midway on the Nutrien warehouse. Nutrien is inquiring if they can remove Line 200 from thier permit due to comingling of stormwater from other sources (NCSP). There may also be issues of comingling on the northern most warehouse owned by NCSP (fishmeal warehouse). On the west side of the fishmeal warehouse is a pipe that may lead to Nutrien systems. Additional comingling may be on the east side of the fish meal warehouse with line 100. Last summer, significant truck traffic accesses the fishmeal warehouse through the Nutrien road, often spilling fertilizer. Nutrien has complained that this has affected thier testing. A conversation should be furthered to evaluate what Nutrien can or needs to do regarding the permitting. This office contends that we want permitting that is accurate to the conditions onsite, if multiple sources of contamination exist. did not review the NCSP Morehead City permit. Right now all Nutrien wants to address is the 200 Line. I said they should resubmit the application removing the outfall, but that cannot happen if the NCSP does not accept the outfall. Nutrien does have sensitivity to not having a permit, releasing all the permit to NCSP. Danny Winstead could write a book about the history of the site and how we got to two permits. It's made of two constituents common in the fertilizer industry and contains the most phosphorus of any common solid fertilizer. o Muriate of Potash(Granular): Other names for this product are Potassium Chloride or Potash. This product is a source of potassium and chloride for plant production. o Phosphoric Acid 54% P2O5: Commonly called Merchant Grade Acid or MGA this is a liquid product used to produce fertilizer and other industrial products. o DUSTROL: Dust control agent added to products during conveyance to mitigate dust. o Diesel Fuel: Fuel used for front-end loaders and other mobile/portable equipment. • Description of how stormwater from the storage tank containment area is handled; o Stormwater that is collected in the storage tank containment area is checked for contamination by measuring the pH. Uncontaminated storm water can be directed to the storm water collection system and discharged or pumped to a grassed area and allowed to infiltrate. Contaminated stormwater is evaluated for recovery. • Description of how stormwater is handled that comes into contact with the storage tanks and overhead conveyor(on the east side of the site)not in any identified drainage area; o Stormwater that is outside the catchment area sheet flows to adjacent areas. There should not be contact with product, as all loading and conveyance of product takes place under roofs and covers. • Description of activities that will occur in the proposed lease areas and when these activities are anticipated to begin; o PCS does not have any current plans to develop any of our leased area. The land to the North of the Fertilizer A-Frame is not leased by PCS and is owned by the NC Port. Uncontaminated storm water can be directed to the storm water collection system and discharged or pumped to a grassed area and allowed to infiltrate. A current Site Map from the Stormwater Pollution Prevention Plan. The location of industrial activities (including storage of materials, disposal areas,process areas and loading and unloading areas), drainage structures, drainage areas for each outfall, building locations and impervious surfaces should be clearly noted. 2. A summary of Analytical Monitoring results during the term of the existing permit (if your permit required analytical sampling). Do not submit individual lab reports. The summary can consist of a table including such items as outfall number, parameters sampled, lab results, date sampled, and storm event data. G� 3. A summary of the Visual Monitoring results. Do not submit individual monitoring reports. The summary can consist of table including such items as outfall number, parameters surveyed, observations, and date monitoring conducted. 4. A summary of the Best Management Practices utilized at the permitted facility. Summary should consist of a short narrative description of each BMP's in place at the facility.
