If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. Upstream = at least 50 feet upstream of the discharge. Downstream = at least 500 feet from the discharge. Stream samples shall be collected three times per week during the months of June, July, August, and September and weekly during the remainder of the year. 2. The monthly average effluent BOD and Total Suspended Solids concentrations shall not exceed 15% of the respective influent value (85% removal). 3. The daily average dissolved oxygen concentration as measured in the effluent shall not be less than 5.0 mg/L. 4. Monitoring requirement and limit applies only if chlorine is added for disinfection. 5. Chronic Toxicity (Ceriedaphnia) limit at 14 % with testing in January, April, July, and October (see Special Condition A. (2)). 6. The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units. There shall be no discharge of floating solids or visible foam in other than trace amounts. Permit NCO088366 A. (2) CHRONIC TOXICITY PERMIT LIMIT (Quarterly) The effluent discharge 'shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 14%. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of January, April, July, and October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The .chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Additionally, DWQ Form AT-3 (original) is to be sent to the following address: Attention: NC DENR / DWQ / Environmental Sciences Section 1621 Mail Service Center Raleigh, North Carolina 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited above. - - - - -- - Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. Permit NCO088366 A. (3) PERMIT RE -OPENER: SUPPLEMENTARY NUTRIENT MONITORING Pursuant to N.C. General Statutes Section 143-215.1 and the implementing rules found in Title 15A of the North Carolina Administrative Code, Subchapter 02H, specifically,15A NCAC 02H.0112(b)(1) and 02H.0114(a), and Part II, Sections B.12. and B.13. of this Permit, the Director of DWQ may reopen this permit to require supplemental nutrient monitoring of the discharge. The additional monitoring will be to support water quality modeling efforts within the Cape Fear River Basin, and shall be consistent with a monitoring plan developed jointly by the Division and affected stakeholders. Permit NCO088366 A. (4) EFFLUENT POLLUTANT SCAN The permittee shall perform an annual Effluent Pollutant Scan for all parameters listed in the table below (in accordance with 40 CFR Part 136). The annual effluent pollutant scan samples shall represent seasonal (summer, winter, fall, spring) variations over the 5-year permit cycle. The area is served by septic tanks and by an existing treatment plant, Cooper's Ranch, permitted to discharge 0.4 MGD to Jumping Run Creek. The proposed plant will be located near Spring Lake, discharging to the Little River. The Cooper's Ranch WWTP will be taken off line and the wastewater will be treated at the new facility. Failing septic systems in the area will be also eliminated. The new plant will serve existing residents and accommodate expected growth in the area until the year 2025. Harnett County is in negotiations with Fort Bragg to purchase the water and sewer utilities from Fort Bragg. When the agreement is finalized Harnett County plans to connect the Fort Bragg system to the new South Harnett Regional WWTP. The proposed treatment system will be a tertiary system consisting of Sequencing Batch Reactor, equalization, tertiary filters, UV disinfection and sludge lime stabilization. SEPA/EAA An Environmental Assessment was prepared and a FONSI was issued for the proposed project on September 19, 2006. An Engineering Alternatives Analysis was included in the EA. The following alternatives were evaluated: 1. Expansion of Cooper's Ranch WWTP — There is no area available for expansion at the site. The Division does not recommend an expansion into Jumping Run Creek due to concerns with water quality. 2. New WWTP on the Little River — A QUAL2K model was completed to evaluate this alternative. The model results show that the proposed discharge will not affect water quality in this portion of the Little River. This plant would be a regional system and eliminate the discharge to Jumping Run Creek from the Cooper's Ranch WWTP. 3. Land Application — A study of soils in the area concluded that the available soils are not suitable to accommodate spray application for the proposed 5 MGD. Approximately 2,700 acres would be required for a 5 MGD discharge. 4. Connection to a regional system — The Spring Lake WWTP is the closest treatment system. This plant has a capacity of 1.5 MGD and cannot accommodate the proposed flow. The Division has determined that the proposed expansion is necessary to accommodate social and economic growth in the area and that it will not result in contravention of surface water quality standards or loss of designated uses in the receiving stream. Fact Sheet - Harnett County NC0088366 Page I Water Quality Model Marziano & Minier, P.A., consultants for Harnett County, used a QUAL2K model to evaluate the proposed discharge. QUAI 9K is a one dimensional, steady state, river and stream water quality model to predict DO in the stream. Four scenarios were modeled: 1. No discharges 2. Existing discharges - Dilton MHP at 0.015 MGD, Fort Bragg at 8 MGD and Spring Lake at 1.5 MGD. This is a base run of actual conditions in the river. 3. Existing discharges and Harnett County at 5 MGD with limits of 5 mg/L BOD and 1 mg/L ammonia. 4. Spring Lake at the existing location and Harnett County at 15 MGD with limits of 5 mg/L BOD and 1 mg/L ammonia. This scenario assumed that Fort Bragg would connect to the Harnett County treatment plant. This scenario considered future expansion of the proposed plant to accommodate the flow from Fort Bragg. The proposed scenario is number 3, although Fort Bragg and Harnett County are in negotiations to consolidate water and sewer utilities and scenario 4 may be implemented in the future. The model results indicate that the DO in the stream will be above 5 mg/L for both scenarios 3 and 4. Basinwide Plan/303(d) The Little River is listed as impaired on the 303(d) list for aquatic life because pH was below the standard in 68 % of the samples. The low pH may be from natural sources. The Division will continue to monitor the Little River to determine if the low pH levels, are natural or related to drought conditions. A TMDL will be developed within 8-12 years of listing. Proposed Limits Proposed limits for the South Harnett Regional W WTP are based on Division's permitting guidelines and permitting strategies for new discharges into the Cape Fear River Basin. For new dischargers above 1 MGD the Division implements BOD monthly average limits of 5 mg/L for the summer and 10 mg/L for the winter. Ammonia limits are 1 mg/L for the summer and 2 mg/L for the winter. Comments from the United States Fish and Wildlife Service may be forthcoming. Per the attached memorandum from Melba McGee, agency concerns must be satisfied in order for the Division of Water Quality (Division) to submit the EA and a Finding of No Significant Impact (FONSI) to the State's Environmental Clearinghouse for final review. The agency reviewers need to be contacted directly to resolve their concerns. Several of the comments pertaining to direct impacts seem to reference portions of the project already considered in the United States Department of Agricultural FONSI received by Harnett County. Please provide me with copies of all written correspondence generated whilst responding to and resolving the agency concerns. In addition, address the following Division of Water Quality comments: 1. Provide a map depicting the project's service area. Identify developed areas and those like to be built out in the future. 2. Page 63: Provide additional detail about the dimensional requirements of the Conservation District. Are these buffer protection regulations? What are the "Other major creeks" referred to? 3. The underlined paragraph on page 65 seems contradictory to the project's purpose described on page eight. How specifically has the project been designed to serve only existing development while allowing for modest growth? Describe in detail the USDA requirements that the project serve only existing development. Is a five million gallon per day plant necessary to meet the needs of existing development or could a smaller facility suffice? What is the amount of current development to be served by the project? How much new development (modest growth potential) is expected? What does the USDA define as modest growth? 4. Include a figure depicting environmental features described in Section 7.0. 5. In Table 6.1, the column identified as Wellons Reserve appears to be the permitted flow for the Cooper's Ranch treatment plant. The East NPDES Unit offers the following comments on the EA: • The Modeling Unit has evaluated the Qual2K model for the proposed discharge to the little River. The model results show that the dissolved oxygen in the stream is maintained above the water quality standard of 5 mg/L. Based on the model results a BODs monthly average limit of 5 mg/L and 1 mg/L monthly average for ammonia will protect water quality in the little River. • Please provide a map showing the service area tributary to the proposed WWTP. Identify existing developed areas and future developments as described in the EA. • In Table 6.1 the column identified as Wellons Reserve appears to be the Cooper's Ranch WWTP permitted flow. Although the permitted flow for the Cooper's Ranch WWTP is 0.4 MGD and the discharge will be eliminated, the permitted flow is not transferred to another permit when a discharge is eliminated. The service area population for the Cooper's Ranch WWTP was listed as 2200 in the 2005 renewal application. The table should list the flow projections for this area based on population or the population from the Cooper's Ranch area could be added to the base population and the column for Wellon's Reserve eliminated. • The copy of Chapter 14 (Subbasin 03-06-14) of the Cape Fear River Basin Plan included in the appendix is from the 2000 Basin Plan. A new plan was published in 2005. Please update this information. • Harnett County intends to connect Fort Bragg to the proposed W WTP. The permitted flow for Fort Bragg is 8.0 MGD.
