KELLY II – TOWN MANAGER TOWN OF OAK ISLAND 4601 EAST OAK ISLAND DRIVE OAK ISLAND, NORTH CAROLINA 28465-5211 Subject: Application No. WQ0031857 Additional Information Request #1 Oak Island Satellite WRF Reclaimed Water Generation, Bulk Distribution, Conjunctive Utilization, and High-Rate Infiltration System Brunswick County Dear Mr. Kelly, Division of Water Resources’ Central and Regional staff have reviewed the application package received on January 24, 2024. However, the Division requires additional information before completing our review. Please address the items on the attached pages no later than the close of business on May 6, 2024. Please be aware that the Applicant is responsible for meeting all requirements set forth in North Carolina rules and regulations. The Applicant is also responsible for any oversights that occur during the review of the subject application package. The Division may return the application as incomplete pursuant to 15A NCAC 02T .0107(e)(2) if any omissions are made when responding to the outstanding items in Sections A through O or the Applicant fails to provide the additional information on or before the above- requested date. Please reference the subject application number when providing the requested information. The Applicant shall sign, seal, and date (where applicable) all revised and/or additional documentation and submit an electronic response to my attention via the Non-Discharge online portal. Kelly April 5, 2024 Page 2 of 4 A. Overall: 1. Mr. Bryan K. Lievre from the Wilmington Regional Office (WiRO) reviewed the submitted application package and provided the following comments: a. Mr. Michael J. Meilinger and Mr. Tyler G. Benson from the WiRO performed a Compliance Inspection on September 7, 2023. During this inspection, Mr. Meilinger and Mr. Benson noted that were many broken diffuser heads leaving both aeration trains inoperable. The ORC confirmed with Mr. Lievre via a telephone call on February 20, 2024, that the Permittee has not yet completed the repairs. Please verify that the Town will make the needed repairs to the diffuser heads of both treatment trains and provide a timeline to complete this. [15A NCAC 02T .0108(b)(1)(A), 02U .0108] b. The Division has not received groundwater quality monitoring reports (Form GW-59) for this facility since November 2017. Please provide the required monitoring reports from November 2017 to the present. [15A NCAC 02T .0105(m), 02T .0108(c), 02U .0108, 02U .0105] 2. Please provide the latitude and longitude of the reclaimed water bulk distribution station located at Middleton Park (Oak Island Recreation Fields). The Division will include this information in the Facility Description of the renewed permit. B. Application (Form: RWS-R 02-21): 1. Section V (Operator in Responsible Charge [ORC] Information) – The specified Back-up ORC (BUORC), Kyle S. Brown (Certification No. 1010056), does not match the Division’s current records. The Division’s records show Sunny Wright (Certification No. 28813) as the current BUORC. Please complete the attached ORC Designation Form and submit it to the Water Pollution Control System Operators Certification Commission (WPCSOCC) via certadmin@ncdenr.gov. If applicable, please also complete the form located here to remove Kyle S. Brown (Certification No. 1010056) as a BUORC from Permit No. WQ0031857. No response is required. This will not affect this permit’s renewal process. C. Attachment A – Site Map: 1. No comment. D. Attachment B – Signature Authority Delegation: 1. No comment. E. Attachment C – Flow Reduction: 1. Attachment F – Demonstration of Future Wastewater Treatment Capacities: 1. No comment. I. Attachment G – Easement, Encroachment, and Lease Agreements: 1. Condition II.17 of the Final Permit issued on August 16, 2017, requires the Permittee to execute and file with the Brunswick County Register of Deeds (RoD) an easement running with the land for any land within the compliance boundary of the high -rate infiltration basins that the Permittee does not own. The Reclaimed Quality Effluent Water Agreement (the “Agreement”) included with the Final Permit issued on August 16, 2017, that discusses the terms between the Town of Oak Island and Leisure Investments of N.C., Inc. was not filed with the Brunswick County RoD nor does it meet the requirements of 15A NCAC 02L .0107(k). Leisure Investments of N.C., Inc. has also sold the property in question (Parcel No. 249DB003) to Oak Island Golf and Country Club, Inc. Please either: a. Provide an executed easement document filed with the Brunswick County RoD that meets the requirements of 15A NCAC 02L .0107(k) and, if necessary, revise the Agreement for the new owner. b. Revise the Agreement to meet the requirements of 15A NCAC 02L .0107(k) and act as an easement running with the land, file the Agreement with the Brunswick County RoD, and, if necessary, revise the Agreement for the new owner. Per Attachment G of Form: RWS-R 02-21, please also provide any other easement, encroachment, and lease agreements associated with this facility. J. Attachment H – Affiliations: 1. No comment. K.
