Good afternoon Tommy,
This correspondence is in reference to the monitoring report and credit release request submitted for the KCI Yadkin 01
Umbrella Mitigation Bank, Hair Sheep Creek Mitigation Site, Action ID SAW-2018-00712. The purpose of this letter is to
transmit comments provided by the NC Interagency Review Team (NCIRT) during the review of the monitoring report
and to confirm the annual credit release. The review of the annual monitoring report followed procedures outlined in
Section 332.8(o)(9) of the Mitigation Rule. The comments listed below were provided by the NCIRT during this
process. While it is not necessary to provide a response to specific comments at this time, please be sure to address the
issues raised in future monitoring report submittals.
Andrew Friedman -Herring, DWR
1. The IRT comments from the MY2 monitoring report were not attached to this report. Please attach the previous
years comments in monitoring reports moving forward, as it helps streamline the review process for the IRT.
2. Wetland gauges 4, 6, and 7 appear to show water above the ground surface for 100% of the growing season
again. How does the vegetation appear to be doing in the wetland creation areas that are permanently
inundated? Is KCI anticipating proposing a different final plant community for these areas?
3. In the IRT comments on the MY2 report Casey Haywood requested that a rotating plot be placed in the wetland
creation area near wetland gauge 6 to assess the effect of constant inundation. It does not appear that a
rotating plot was placed in that area, and no discussion of the plant community was included in the Monitoring
Results section.
4. Random Plots 3 and 6 are located directly next to permanent monitoring plots. Please space out the rotating
plots to capture a more widespread sample of the site in future monitoring years.
5. In the IRT comments on the MY2 report Casey Haywood also requested that the acreage of invasive species
treatment be estimated or included in the site map. The MY3 report mentions that invasive species were
treated again on 5/31/2023 but does not estimate the area or represent it on the site map. How extensive was
the treatment area in MY3?
6. In addition to Plot R2 not meeting density success criteria, Plots R5 and VP7 appear to be failing the species
diversity criteria but are not highlighted or mentioned in the report. While not meeting species diversity criteria
will not always result in the need for an AMP, they still need to be acknowledged as success criteria.
7. This monitoring report was not uploaded to the DWR LaserFiche portal. Please make sure that all monitoring
reports are uploaded to the DWR portal in addition to RIBITS.

1. T1-1 flow gauge graph is missing data from January to February, did it malfunction?
2. The report proposed keeping an eye on the wetland areas to determine if scrub/shrub or emergent wetland
types might be better for the wetland areas. Please complete vegetation monitoring in MY4 for any plots
within wetland areas in anticipation of low planted stem survival and to better determine if a new
vegetation type will need to be proposed. It would be helpful to include height data/vigor in future reports
to better determine if continued survival is likely. During MY4 please survey at least 2 random vegetation
plots in the wetland areas near gauge 4, 6, and 7.
3. I concur with DWRs comments. Any comments on the MY2 report that were not addressed this year should
be addressed in MY4.
4. The bond submitted with the monitoring report has been reviewed and is approved. Please upload to RIBITS
and mail a hard copy.
Based on our review of the monitoring report and the results of the NCIRT review, we confirm that you have satisfied
requirements included in the approved banking instrument and mitigation plan for this site. Accordingly, with this
correspondence we confirm the release of credits as shown on the table below and on the attached credit release
schedule. The District leger on the Regulatory In -lieu Fee and Bank Information Tracking System has also been updated
to reflect this transaction.
