Subject: Toby Creek Greenway
Dear Ms. Cook:
The Division of Water Quality (DWQ) received your application fora 401 Water Quality Certification for the subject
project on October 19, 2007. A site visit was conducted on November 28th, and the application has been reviewed. Based
on the site visit and review the following information/comments are needed by this office in order to complete our review:
a) The stream calls for at the impacts sites identified as S2, S3, and S4 were changed from intermittent (as
shown on the application) to perennial. Stream calls at impact site SS and S1 were unchanged.
b) Please remove the amount of "impact" within the culvert from the impact total at impact S5.
c) Please provide a clarification of the impacts above and below the culvert at impact site S5.
d) Please find enclosed photos of benches that can be constructed above and below the culvert to maintain the
base flow channel and prevent over widening of the stream channel.
e) Please submit an updated/corrected copy of page 8 (table of stream impacts) of the application.
Pursuant to 15A NCAC 2H .0507(h), please be advised that this project will be placed on hold. Failure to submit the
requested information by November 30, 2007 will result in the application being withdrawn from consideration. You may
reapply, but a new fee and application will be required. In addition, this office is requesting that the Army Corps of
Engineers withhold processing the 404 permit until the requested information is provided. If you have any questions,
