Bryant Road Subdivision, Harnett County
To Whom it May Concern,
This letter is written in response to the comments, issued February 11, 2024, regarding the proposed
subdivision in Erwin that is currently known as Bryant Road Subdivision. A reply or explanation for
each comment issued by the Engineer is provided below and follows the original format of your
memorandum.
1. Per the latest USGS topographic map, it appears that surface water is immediately adjacent
to the site and a portion may be on-site. Ensure that the surface water is excluded from the
project area, and that vegetated setbacks are clearly shown on the plans. A landscape
buffer is currently shown on the plans, but per 15A NCAC 02H.1042(2)(g)(iii), vegetated
setbacks from the surface water must be shown on plans. Per 15A NCAC 02H .1017 (10), at
least 30' is required. Note that vegetated setbacks must remain vegetated.
a. Ensure that the plans clearly denote the vegetated setbacks for Pond 2 and the
stream adjacent to the site that fall within the project area. Vegetated setbacks are
measured horizontally from the top of bank of each side of streams and must remain
vegetated 15A NCAC 02H .1003 (4). The minimum vegetated setback must be 30 ft.
The approximate location of pond 2 is now shown on the plans with a 30'undisturbed
vegetated setback. This pond is not located on our property greater than 350'from
any land disturbing activity.
2. Per the provided deed restrictions, the maximum amount of BUA allowed per lots is 596,000
SF. Per the Application, Section IV, 10, and the Supplement-EZ Drainage Areas Page, the
sum of the BUA on the lots is 43,500 SF + 413,000 SF + 194,750 SF = 651,250 SF. Deed
restrictions ensure that the development maintains a "built-upon" area consistent with the
design criteria used to size the stormwater control facility. The current deed restrictions
indicate that less BUA would be allowed per lot that may be planned to be built. Revise the
package, including the calculations, as necessary.
The deed restriction is correct and the Application, Supplement EZ Form, and Runoff
Map have been updated to reflect the correct data.

3. Confirm the project area. If the property area as outlined in CE-00 is accurate, the surface
water area shown on the USGS map within the project area will need to be accounted for in
the Supplement-EZ and Application. Note that the surface area of the surface water is the
area between the top of banks of the streams and normal pool of impounded structures. 15A
NCAC 02H.1003(4)(a), 15A NCAC 02H.1042(2)(g)(iii).
There are three existing ponds along the eastern property line. The two that are
furthest north are not on our property and are outside of the project area. The pond
that is on the Southeast corner of the site is originally on the property however this
pond will but cut on its own individual lot and will be given to the adjacent property. I
believe it to be outside of the project area, however the surface area of that pond is
listed on the Application Section IV.6. I did not see a specific line in the Supplement
EZ form to list this area, so it is noted at the bottom of the drainage areas page. None
of the existing ponds drain into our project area or our proposed Storm water control
measures.
4. Per the comment response document, there is a small off-site area directed to Wet Pond 2.
Update the Application, Supplement-EZ, and calculations to account for this off-site area at
full build-out potential (see previous comments for more details on this.) It does not appear
that the off-site area was accounted for as 100% BUA of an agreement reached limiting the
amount of BUA that can be built on the off-site area. It is recommended to divert off-site
area away from the SCM.
The offsite area that drains onto our site is already at its full build out potential. It is a
portion of NCDOT Public ROW, that is the sliver of land on the back side of a roadside
ditch that drains into the existing field and not back towards the ditch. All other areas
are diverted to avoid the SCMs.
5. Please verify that the electronic repository is complete when making submittals. It was noted
that a drainage area plan, showing the drainage area to each SCM, which is required, was
provided in the hard copy submission, but not in the electronic copy.
The drainage map showing the drainage area to each SCM is included in the
calculation package as the last page.
6. Provide PDFs of all revisions, 2 hardcopies of revised plan sheets, Application, and
Supplement-EZ, 1 hardcopy of other documents, and a response to comments letter briefly
describing how the comments have been addressed.
