North of Josephine Road the tract is primarily forested and south of the road it is primarily agricultural land. Indicate Which of the Following Apply: A. Preliminary Determination ® There appear to be waters, including wetlands on the above described project area/property, that may be subject to Section 404 of the Clean Water Act (CWA)(33 USC § 1344) and/or Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403). The waters, including wetlands have been delineated, and the delineation has been verified by the Corps to be sufficiently accurate and reliable. The approximate boundaries of these waters are shown on the enclosed delineation map dated 7/22/2021, and updated on March 4, 2022. Therefore, this preliminary jurisdiction determination may be used in the permit evaluation process, including determining compensatory mitigation. For purposes of computation of impacts, compensatory mitigation requirements, and other resource protection measures, a permit decision made on the basis of a preliminary JD will treat all waters and wetlands that would be affected in any way by the permitted activity on the site as if they are jurisdictional waters of the U.S. This preliminary determination is not an appealable action under the Regulatory Program Administrative Appeal Process (Reference 33 CFR Part 331). However, you may request an approved JD, which is an appealable action, by contacting the Corps district for further instruction. ❑ There appear to be waters, including wetlands on the above described project area/property, that may be subject to Section 404 of the Clean Water Act (CWA)(33 USC § 1344) and/or Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403). However, since the waters, including wetlands have not been properly delineated, this preliminary jurisdiction determination may not be used in the permit evaluation process. Further, an AJD, a proffered individual permit (and all terms and conditions contained therein), or individual permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it becomes appropriate to make an official determination whether geographic jurisdiction exists over aquatic resources in the review area, or to provide an official delineation of jurisdictional aquatic resources in the review area, the Corps will provide an AJD to accomplish that result, as soon as is practicable. (S&EC) evaluated the Island Creek property shown on the attached maps for potential endangered species. The property is located at Josephine Road in Johnston County, NC. Surface waters on -site flow into Swift Creek and Cow Branch in the Neuse River Basin, which has been classified in the "Classification and NC DWQ Standards Applicable to Surface Waters and Wetlands of North Carolina" as C; NSW. We obtained the attached automatically generated official species list from the U.S. Fish & Wildlife Service (FWS) and N.C. Natural Heritage Program (NHP) report identifying the protected species on or within one mile of the project area that could potentially be affected by the project. These FWS & NHP reports were updated as of the date of this report. The official species list is valid for 90 days. We conducted preliminary habitat assessments to identify suitable habitat for the individual species listed on the official species list. Detailed botanical surveys were conducted within the optimal survey windows for the listed plant species. The preliminary habitat assessments included assessing the physical characteristics of the streams, identifying forest types, and looking for evidence of the listed species on - site. This survey did not include any detailed sampling or netting of aquatic species, nor did it include any detailed mist netting or acoustic surveys for bat species. The results of the search are discussed below. Island Creek - S&EC Threatened & Endangered Species Report Page I of 7 February 23, 2024 S&EC Project #14748.W7 RESULTS: The FWS official species list identified the following species for the Evaluation limits: • Tricolored Bat, (Perimyotis subflavus), Proposed Endangered • Red -cockaded Woodpecker (Picoides borealis), Endangered • Neuse River Waterdog (Necturus lewisi), Threatened • Carolina Madtom (Noturus furiosus), Endangered • Atlantic Pigtoe (Fusconaia masoni), Threatened • Dwarf Wedgemussel (Alasmidonta heterodon), Endangered • Yellow Lance (Elliptio lanceolata), Threatened • Monarch Butterfly (Danaus plexippus), Candidate Of the species identified on the official species list, the NHP report identified Federally threatened and endangered species within the project area and within one mile of the project area. These occurrences are for the Neuse River Waterdog, Dwarf Wedgemussel, Yellow Lance, and Atlantic Pigtoe, ranging from 2015 to 2022 in Swift Creek. Additionally, there is an occurrence from 1991 for the Green Floater within 1 mile of the site. Other State listed species were found within the project area as listed in the attached NHP report. The NHP report identified one natural area and three managed areas within the project area and within one mile of the project area. The natural area is the Neuse River / Swift Creek Aquatic Habitat, and the managed areas are designated USFWS critical habitat for Atlantic Pigtoe, Neuse River Waterdog, and Yellow Lance. TRICOLORED BAT (Perimyotis subflavus): S&EC personnel conducted preliminary surveys of potential suitable habitat for the Tricolored Bat's within the project area. Relying upon the findings of the December 2021 Species Status Assessment (SSA) Report for the Tricolored Bat. Due to the nature of the project being residential development, which will include tree removal, we concluded that the project would "May affect, not likely to jeopardize the existence of the species" for TCB's. Please anticipate a special condition on NWP approvals stating to consult with USFW S at the time of the TCB's final listing. During our evaluation, we found no evidence of individual RCWs within the project area. The NHP report did not list any known element occurrence within the project area or within one mile of the site. We found no ideal suitable habitat (e.g., Long Leaf pine forests) within the project area. S&EC utilized the RCW SLOPES Manual when making the determination. Given the lack of suitable habitat, we concluded that the project would have "No effect" on RCWs. NEUSE RIVER WATERDOG (Necturus lewisal: S&EC personnel conducted preliminary surveys of the streams on -site for potential suitable habitat for the Neuse River Waterdog. The NHP report did list a known element occurrence within the project area and within one mile of the site from 2022 in Swift Creek. The NHP also identified critical habitat for the Neuse River Waterdog within Swift Creek. This species is found in the Neuse River and Tar River basins. The suitable habitat this species is found in is typically medium to large streams and rivers with a moderate gradient and large bed material. The Neuse River Waterdog also needs riffles, runs, and pools. While we did not specifically sample for the species, we also did not find any evidence of the species while conducting our preliminary surveys of the streams for potential suitable habitat. Our preliminary survey concluded that potential suitable habitat does exist on -site. Swift Creek is critical habitat for the Neuse River Waterdog. There are no proposed impacts to Swift Creek. However, there are two proposed road crossings on perennial streams flowing into Swift Creek, and three proposed pedestrian bridges. One of the bridges is located on a perennial stream, and two bridges are located in the floodplain of Swift Creek. Due to these observations, we have concluded that the project would "May affect, not likely to adversely affect" the Neuse River Waterdog. The attached Stormwater & Erosion Control Plans are currently under review. S&EC recommends consulting with USFWS to determine if additional measures are needed to protect the Swift Creek aquatic habitat. While we did not specifically sample for the species, we also did not find any evidence of the species while conducting our preliminary surveys of the streams for potential suitable habitat. Our preliminary survey concluded that potential suitable habitat does exist on -site. Swift Creek is suitable habitat for the Carolina Madtom. There are no proposed impacts to Swift Creek. However, there are two proposed road crossings on perennial streams flowing into Swift Creek, and three proposed pedestrian bridges. The NHP report did list a known element occurrence within the project area and within one mile of the site from 2022 in Swift Creek. The NHP also identified critical habitat for the Atlantic Pigtoe within Swift Creek. The suitable habitat for this species consists of medium sized creeks to large rivers with excellent water quality. This species typically lives in streams with coarse sand and gravel with moderate to high flowing water. While we did not specifically sample for the species, we also did not find any evidence of the species while conducting our preliminary surveys of the streams for potential suitable habitat. The NHP report did list a known element occurrence within the project area and within one mile of the site from 2021 within Swift Creek. The Dwarf Wedgemussel has little to no preference for stream size, flow condition or bed material. Based on guidance from the USFWS staff, only 2nd order and larger perennial streams are considered suitable habitat. While we did not conduct detailed mussel surveys, no mussels (of any species) were observed during the preliminary suitable habitat survey. Our preliminary survey concluded that potential suitable habitat does exist on -site. Swift Creek is critical habitat for the Dwarf Wedgemussel. There are no proposed impacts to Swift Creek. However, there are two proposed road crossings on perennial streams flowing into Swift Creek, and three proposed pedestrian bridges. One of the bridges is located on a perennial stream, and two bridges are located in the floodplain of Swift Creek. Due to these observations, we have concluded that the project would "May affect, not likely to adversely affect" the Dwarf Wedgemussel. MONARCH BUTTERFLY (Danaus plexippus): The Monarch Butterfly is currently listed as a candidate species, and not yet listed or proposed for listing as threatened or endangered. Due to the current status of Monarch Butterfly, consultation with USFWS under section 7 of the Endangered Species Act is not required. FWS recommends conserving pollinator habitat where practicable. CONCLUSION: After completing the habitat assessments and preliminary surveys, S&EC completed the attached "Species Conclusion Table" and "Self -Certification Letter." Using language typically used by the FWS in their conclusion letters, we have concluded that it appears the proposed project is not likely to adversely affect any federally listed endangered or threatened species, their formally designated critical habitat, or species currently proposed for listing under the Endangered Species Act (ESA). The most recent drawings are a bit different from the original drawings showing less stream crossings and associated impacts. Can you share what the varioius shaded areas are on the map? Also what are the expected buffer impacts? I am asking the sewer or septic question because if sewer it could include stream crossings in which case we would recommend HDD vs open cut. Due to the property being adjacent to Swift Creek and contains tributaries feeding directly to Swift Creek here are some measures that we've been recommending to help get to a may affect not likely to adversely affect determination for the aquatic species. Please share these with your client and see if they could be incorporated. • Avoid removal of existing vegetation unless absolutely necessary. For example, leave lots wooded as long as possible, preferably until home construction begins and maintain as many trees as possible. • Educate the construction crew about the presence of sensitive species by providing information or installing signs on the silt fence near Swift Creek. I have attached an example of a sign (Word doc). • Access corridors for construction vehicles in or adjacent to the floodplain of the Swift Creek and other streams should be minimized as much as possible. • Implement stringent erosion control measures during construction adjacent to the tributaries and Swift Creek floodplain, including: A double row of silt fence, to ensure that erosion is captured effectively. Silt fence and other erosion control devices should not include outlets that discharge closer than 50 feet to the top of bank of any stream. Silt fence outlets for each row of silt fence should be offset to provide additional retention of water and sediment in the outer row. • The discharge outlets from stormwater infrastructure should be designed to avoid stream buffers, including the dissipator pad or any other structures. • Inspect all vehicles for leaks often. Repair any leaks and clean construction vehicles thoroughly to remove any residual dirt, mud, debris, grease, motor oil, hydraulic fluid, coolant, or other hazardous substances from construction vehicles. • Inspections, repairs, cleaning, and/or servicing must be conducted either before the vehicle, equipment, or machinery is transported into the field or at the work site. • All drilling muds, wash -water runoff, and/or other harmful materials must be appropriately controlled to prevent entry into a waterbody or riparian zone. • Fuel and maintain vehicles or equipment and store potentially toxic substances (fuels, paints, solvents, lubricants, etc.) within a containment area in uplands. • Temporary and permanent stabilization measures should include only natural materials that are expected to degrade over time. • Revegetate with native species. Sericeo lespedezo is invasive and should not be used for stabilization or revegetation. Portions of any ROW that are not intended for long-term maintenance should be revegetated with native trees and shrubs. • Any spills of motor oil, hydraulic fluid, coolant, or similar fluids into the riparian wetlands or floodplain must be reported to the Corps and Service immediately. • Conduct bi-weekly inspections of all erosion and sedimentation controls adjacent to the floodplain of the tributaries and Swift Creek, and in uplands within 100 feet of the riparian zones of all streams. Maintain all controls as necessary to ensure proper installation and function. In addition to bi-weekly inspections, within 24-hours of rain events, inspect all of the erosion and sedimentation controls to ensure the integrity of the devices. Repair and replace sections of controls as needed to minimize the potential for failure. • If erosion and sedimentation controls fail causing sediment or erosion in the floodplain wetlands or stream buffer of the tributaries or Swift Creek, the Corps and Service must be notified within 24 hours to determine if any remediation is required. • In sensitive watersheds, we typically recommend designing stormwater systems to attenuate or retain the 1- to 100-year storm. Even if it is not possible to design for the 100-year storm, then we recommend that the system be designed to retain or attenuate the largest storm possible.
