A preliminary in- depth review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. The request must indicate the date by which you expect to submit the required information. The Division is allowed 90 days from the receipt of a completed application to issue the permit. Additionally, on September 4, 2012, this site was also inspected to determine compliance with the Stormwater Management Rules. DWQ file review and site inspection revealed that the site is not in compliance with the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent inspection. As indicated in the attached inspection report, the following deficiencies were identified: 1. Construction of the impervious area has started prior to obtaining a state stormwater permit, which is a violation of NCGS 143-215.1 and is subject to enforcement action pursuant to NCGS 143-215.6A. As long as the additional information requested (items 1 through 4) are provided within the given time frame, this site will not be issued a Notice of Deficiency or Notice of Violation. However, if the requested information is not provided within the specified time frame and the project must be returned, this site will be re-inspected and a Notice of Deficiency will be issued. By copy of this letter to the Jacksonville Building Inspection Office, NCDENR is requesting that the Building Inspector withhold building permits and Certificates of Occupancy for this project until the State Stormwater Permit is issued. The project is located on lot 10 of Freedom Village Shopping Center and Yopp road relocation. This High Density Subdivision was approved and permitted as SW8060718. This subdivision permit allows for 66,646 square feet of Built Upon Area (BUA). The site plan as shown includes 47,532 square feet of BUA, all draining to catch basins and to pond. The owner of the parcel is BBS of ENC, llc, Ms. Robin Strickland, manager, 21 13-A South Glenburnie Road, New Bern, NC. The developer is Mr. Mitchell Brydge of Brydge and Lee, 2113-A South Glenburnie Road,New Bern, NC. The above parcel was originally platted and permitted as Lot 10 of the Freedom Village/Yopp Road Relocation, stormwater permit SW8 (160718. Lot 10 is a 1.53 acre parcel site. The site plan proposes 71% impervious surface coverage, including an 11,140 sqft commercial/retail tire facility and 36,393 sqft of sidewalk,parking and driveway. The approved High Density permit included construction of a wet detention pond on Lot 9, which is located immediately north of Lot 10. In general, the existing parcel drains over a minimal grade across the site towards this existing, wet detention pond. The southerly adjacent parcel, Lot 11, is currently vacant. The pond drains over one half mile to Blue Creek, in the White Oak River Basin,classified as a SC, NSW water, Index 19-8. As seen on the attached drawings, all impervious surfaces will drain overland flow to catch inlets, into culverts and into the existing pond. Allowable Built Upon Area (BUA) per the Stormwater permit for Lot 10 is 66,646 sq ft. This is less than the proposed BUA of 47,532 sqft. The City Manager has directed the Stormwater Division to release its hold on the Site Plan Approval for Family Tire submitted by Brydge&Lee Inc. As you are aware through previous emails and conversations,the property is currently permitted by the N.C.Division of Water Quality(Permit No. SW8 060718). Per item i. on page 5 of 10 of this permit, "Each lot within the subdivision,whose ownership is not retained by the Permittee,must submit a separate Offsite Stormwater Management Permit application package to the Division of Water Quality and receive a permit prior to any construction on the lot. The permit also states,"Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C." The City's Site Plan Approval does not relieve the applicant from the responsibility of obtaining the Offsite Stormwater Management Permit required by the Division of Water Quality.
