HomeMy WebLinkAboutWrightsville YachtClub DCM#173-00Permit Class MODIFICATION/MINOR Permit Number 173-00 STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission r r m it for X Major Development in an Area of Environmental Concern pursuant to NCGS I I3A-118 X Excavation and/or filling pursuant to NCGS 113-229 Issued to Wrightsville Yacht Club, Inc., PO Box 1215, Wrightsville Beach, NC 28480 Authorizing development in New Hanover County at adj. to the AIWW at 6 Marina Street, in Wrightsville Beach , as requested in the permittee's letter received 2/13/24, including the attached workplan drawing (1) Sheet A1.00 "received 2/13/24". This permit, issued on May 9, 2024 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Marina Reconfiguration 1) Unless specifically altered herein, this Minor Modification authorizes a gazebo over existing decking and an ADA compliant wooden walkway, all as expressly and specifically set forth in the attached letter and workplan drawings. Any additional development activities may require a modification of this permit. [07J .0202(c); 07H .0209; G.S. 113-229(b)] 2) The roof of the gazebo shall not be designed for second story use. [07H .0208(b)(6)(F)] (See attached sheet for additional conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 13, 2028 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. ADDITIONAL CONDITIONS Permit No. 173-00 Page 2 of 2 3) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches are permitted. Lattice is specifically excluded from being used under this authorization. [07H .0208(a)(2)(G)] Sedimentation and Erosion Control 4) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. [07H .0209(d)(4); G.S. I I3A-102(a); 07H .0207; 07H .0208] 5) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. [07H .0209(d)(4); G.S. 113A-102(a); 07H .0207; 07H .0208] General 6) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. [07J .0209(a)] 7) All conditions and stipulations of the active permit remain in force unless specifically altered herein. [07J.0209(a)] NOTE: This Minor Modification shall be attached to the original Permit No. 173-00, which was issued to the permittee on 11/14/00, as well as all subsequent modifications, refinements, and renewals, and copies of all documents must be readily available on site when Division personnel inspect the project for compliance. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers assigned the project Action ID SAW-2000-01705. NOTE: The Division of Water Resources assigned the proposed project DWR Project No. 200012610 NOTE: A minor modification application processing fee of $100 was received by DCM for this project.
