We are hereby re-submitting the attached 401 Certification documents for the above
referenced project. The application was returne~'y your office per letter dated
November 14, 2007. This letter indicated that additional information is required.
Attached is a check for the corrected permitting fee amount of $240.00. On each copy
of the PCN application, we have stated that we intend to use Nationwide Permit 29
as required by the US Army Corps of Engineers. Mr. Brent Horne, Vice President of
Topkicks, Inc. has been added as the individual Owner/Applicant on each copy. Finally,
the 401 Certification box has been checked on all five copies.
Please understand that the drawings were not prepared by our firm and are too large
for our scanning device. Mr. Ian McMillan indicated to me, during a phone
conversation, that .pdf files are not a requirement at this time. Therefore, we are re-
submitting the paper copies that were returned to Owner by NCDENR. Mr. McMillan
said that it is acceptable to write in the additional information requested. Please note
that we initially submitted seven (7) copies NCDENR while only five (5) copies were
returned to Owner. These are the five (5) copies that are being re-submitted.

Important notice: 401 Certification/Isolated Wetlands Permits Fee Increase -The North
Carolina General Assembly approved an increase for application fees for all regulatory
programs administered by DWQ, effective July 1, 2007. However, please note that this
does not mean that the increased application fees for the 401 Certification/Isolated Wetlands
Permit Programs will be retroactive to July 1, 2007. The Director of DWQ determined that
the fee increase will specifically become effective for the 401 Program on September 1,
2007. All applications received as of September 1, 2007 will be subject to the new fee
schedule.

SPECIAL CONDITIONS
1. In order to compensate for impacts to 0.076 acres of wetlands, the permittee shall make payment to
the North Carolina Ecosystem Enhancement Program (NC EEP) in the amount determined by the NC
EEP, sufficient to perform the restoration of 0.076 acres of non-riparian wetlands in thle'' White Oak
River Basin, Cataloging Unit 03030001.
Construction within jurisdictional areas on the property shall begin only after the permit~~e has made
full payment to the NC EEP and provided a copy of the payment documentation to the dolrps, and the
NC EEP has provided written confirmation to the Corps that it agrees to accept respons~t~ility for the
mitigation work required, in compliance with the MOU between the North Carolina Ddpartment of
Environment and Natural Resources and the United States Army Corps of Engineers, 'Wilmington
District, dated November 4, 1998.
2. The permittee should provide post construction pictures of the mitigation area demonstrating that the
old tractor path ruts have been removed from the stream and riparian system as described in the
restoration plan dated May 16, 2007..
3. The permittee should sew the restored area with a wetland seed mix void of any Fescue'dr Bermuda
grasses.
4. The penmittee should contact this office at the conclusion of the mitigation construction to arrange
an onsite inspection of the restored area.
REGIONAL CONDITIONS
1. For all NWPs that involve the construction/installation of culverts, measures will be included in the
construction/installation that will promote the safe passage offish and other aquatic organisms. The
dimension, pattern, and profile of the stream above and below a pipe or culvert should not ~e modified
by widening the stream channel or by reducing the depth of the stream in connection with the
construction activity. The width, height, and gradient of a proposed opening should be such as to pass
the average historical low flow and spring flow without adversely altering flow velocity. Spring flow
should be determined from gage data, if available. In the absence of such data, bankfull flow can be used
as a comparable level.
In the twenty (20) counties of North Cazolina designated as coastal counties by the Coastal Are~~
Management Act (CAMA): All pipe and culvert bottoms should be buried at least one foot belq~v normal bed
elevation when they are placed within the Public Trust Area of Environmental Concern (AEC) d/or the
Estuarine Waters AEC as designated by CAMA, and/or all streams appearing as blue lines on Ufiited States
Geological Survey (LJSGS) quad sheets.
In all other counties:
Culverts greater than 48 inches in diameter will be buried at least one foot below the bed of the' stream.
Culverts 48 inches in diameter or less shall be buried or placed on the stream bed as practicably dud
appropriate to maintain aquatic passage, and every effort shall be made to maintain the existing channel
slope. The bottom of the culvert must be placed at a depth below the natural stream bottom to provide for
passage during drought or low flow conditions.
Destabilizing the channel and head cutting upstream should be considered in the placement of the culvert.

A waiver from the depth specifications in this condition may be requested in writing. The waiver will be
issued if it can be demonstrated that the proposal would result in the least impacts to the aquatic
environment.
All counties: Culverts placed in wetlands do not have to be buried.
2. Discharges in wetlands and in perennial streams for stormwater management facilities at~~ prohibited
under this NWP.
3. Single-family recreational facilities are not authorized by this NWP. Recreational facili~i~s that are
incorporated into serving an entire residential development can be authorized by this NWP.
4. Discharges of dredged or fill material into waters of the US, including wetlands, within the floodway,
resulting in permanent above-grade fills are not authorized by this NWP.
5. Discharges of dredged or fill material into waters of the US, including wetlands, within tlb.$ mapped
FEMA 100-year floodplain, below headwaters (i.e. > five cfs) resulting in permanent above-~rade fills
are not authorized by this NWP.
6. This NWP may not be used to authorize the discharges of dredged or fill material into waters of the
United States that have been identified or designated by the State of North Carolina as:
a. Outstanding Resource Waters
b. High Quality Waters
c. Coastal Wetlands as defined by North Carolina's Coastal Area Management
Act

Attach a vicinity map clearly showing the location of the property with respect to local
landmazks such as towns, rivers, and roads. Also provide a detailed site plan showing property
bo~jndaries and development plans in relation to surrounding properties. Both the vicinity map

DR~Q - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 lineaz feet of total impacts to perennial
str~e~ms.
US.¢1.CE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Per#nits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment aze minimal. Factors
including size and type of proposed unpact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but aze not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similaz
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
An applicant may also choose to review the current guidelines for stream restoration in DWQ's
Draft Technical Guide for Stream Work in North Cazolina, available at
http://h2o.enr.state.nc.us/ncwetlands/strmgide.html.

and/or map, if offsite), affected stream and river basin, type and amount (acreage/lineaz feet)
